Height
Acceptable Outcome AO7.1 of the Low Density Residential Zone Code states:
The applicant is proposing a built form that includes a basement and a two storey built form above
(3 levels overall) and as such does not comply with AO8.1 of the Medium Density Residential Zone
Code. The proposal is therefore required to comply with corresponding Performance Outcome
PO8 of the Medium Density Residential Zone Code, which states:
Assessment
The dwelling includes a basement level beneath the lower and upper floors. Where this basement
is exposed due to the falling topography, the building presents as 3 storeys This is most evident in
the rear (eastern) elevation and parts of the southern and northern side elevations. In these
locations, the building reads as a three-storey form rather than two storeys.
While not an additional “storey” in a planning sense the proposed roof terrace and stair access
element sit above the upper floor ceiling plane. Visually, this can contribute to an apparent third
storey component, particularly when viewed obliquely or from lower land. However, this is generally
treated as a roof form element, not a separate storey (subject to planning interpretation).
From the street (Kingfisher Drive) the dwelling reads predominantly as two storeys, as the
basement is largely concealed by excavation and levels. From downslope and adjoining sites the
dwelling exceeds two storeys in built form expression, due to exposure of the basement, and
vertical stacking of three levels.
There are examples of houses in the surrounding area that are 3 storeys, including 26 Kingfisher
Drive, 20 Kingfisher Drive, 4 Pelican Street, 7 Pelican Street and 4 Brolga Plan.
This dwelling provides interest to the streetscape using a variety of materials and finishes in the
front façade. This includes vertical screens and a combination of brick and timber elements.
The proposed height of the development in metres is less than the maximum height of 8 metres
and this respects the scale of surrounding vegetation and does not unreasonably obscure views.
As the proposed dwelling exceeds two storey, the development must address Overall Outcome
(2)(d) of the Low Density Residential Zone Code, which states:
Document Set ID: 24807636
Version: 2, Version Date: 20/05/2026
Page 8
d. The bulk and scale of development located on that part of the site in the Low Density Housing
zone is consistent with the building height, gross floor area and site cover required by the
performance outcomes of this code.
This Overall Outcome requires that the building height is consistent with the performance outcomes
of this code. As such, the proposed development does not meet this Overall Outcome.
Setbacks
Acceptable Outcome AO12.1 of the Medium Density Residential Zone Code states:
The applicant is proposing the reduced setbacks from the rear boundary and side boundaries as
shown in the table above. As such, the development does not comply with AO12.1 and AO12.2 of
the Medium Density Residential Zone Code. The proposal is therefore required to comply with the
corresponding Performance Outcome PO12 of the Medium Density Residential Zone Code, which
states:
Document Set ID: 24807636
Version: 2, Version Date: 20/05/2026
Page 9
Assessment
The parts of the proposed dwelling within the rear setback include the storage area and lift in the
basement, bedroom 1 and the lift on the lower floor and bedroom 3 and the lift on the upper floor.
The proposed setback maintains the amenity of users of the subject site and the adjoining premises
by these building elements not being habitable spaces, which do not include windows.
The proposed rear setback does not unreasonably obstruct views or cause overlooking of private
open space or habitable areas of the adjoining premises, through the provision of a
varied/staggered rear setback between 4.5. - 6.8m, which responds to the shape of the subject lot.
The rear boundary interfaces with the driveway and circulation areas of the adjoining development
at 4 Pelican Street and there are no private open space areas. On the upper level of the dwelling,
there are louvres with operable screens covering the windows.
The reduced side boundary setbacks are limited to the parts of the dwelling that are 4.5m above
ground. The proposed setbacks are varied with portions that exceed the minimum i.e. 2.5m-4.0m
from the side boundaries. The portions that are less than the minimum setback (proposed 1.5m)
interface with the adjoining two-storey dwelling that is setback 2.0m-2.50m from the property
boundary. To ensure the amenity between these neighbouring properties is maintained and
opportunities for overlooking are reduced, it is considered reasonable to apply the standard
screening condition to the Decision Notice for this development.
The development maintains adequate distance between the adjoining properties and existing
vegetation and additional landscaping will help buffer these developments.
Space for landscaping in the forms of trees and shrubs is provided between buildings at ground
level. The proposed side boundary setbacks are well landscaped with a combination of trees,
shrubs and groundcovers.
Along Kingfisher Drive and the surrounding streets there are similar examples of reduced rear
setbacks, demonstrating that the proposal is consistent with the predominant character of the
surrounding.
There are no areas of ecological importance within or near the subject land.

Document Set ID: 24807636
Version: 2, Version Date: 20/05/2026
Page 10
Length of Wall
Assessment
The development proposed a wall length of 20m and as such does not comply with AO14.3(a) of
the Medium Density Residential Zone Code. The development is required to comply with the
corresponding Performance Outcome PO14 of the Medium Density Residential Zone Code,
which states:
The proposed 22.2m length of wall along the southern façade is comparable in design and extent
to the existing dwelling house. A similar setback has also been established along this boundary.
This will ensure that the development does not detract from the visual amenity of the adjoining
properties.
Individual design elements such as 2.6m tall by 0.9m wide windows are proposed along this facade
of the building on both the lower and upper levels. This combined with a brick screen and fireplace
flue within the façade adds visual interest to this side of the building.
The proposed dwelling sits within a landscape setting and achieves a soft landscape area of
178m2.
Roof Forms
The proposal includes a rooftop terrace and as such does not meet AO19.5 of the Medium Density
Residential Zone Code. The proposed is therefore required to address the corresponding
Performance Outcome PO19 of Medium Density Residential Zone Code, which states:
Document Set ID: 24807636
Version: 2, Version Date: 20/05/2026
Page 11
Assessment
As shown on the east (street) elevation and sections, the proposed rooftop terrace is below the
maximum height of 8m above natural ground, and the design contributes positively to the skyline
and the surrounding character by screening the terrace from view from the street with solid
balustrading.
There are several other examples of development in the surrounding area that includes a rooftop
terrace, including a 2 storey house at 16 Kingfisher Drive; a 3 storey duplex at 20 Kingfisher Drive;
the 3 storey duplex neighbouring the site at 26 Kingfisher Drive; a 2 storey house at 32 Kingfisher
Drive; and a 3 storey house at 7 Pelican Street.
The terrace is setback more than 15m from the front boundary and is centrally located towards the
rear of the roof. The combination of the solid 1.2 metres balustrading and the over 4m setbacks
from the side boundaries will not create opportunities for overlooking to the private open of
neighbouring properties. It is noted that the side boundaries of the subject land do not interface
with the private open space areas of the neighbouring properties.
4. CONSULTATION
4.1. Referral Agencies
A SARA referral agency response – with conditions dated 25 September 2025 was received by
Council. The response conditioned that certification was to be submitted to SARA to confirm that
the subject site had been remediated and cleared of unexploded ordinances and the proposed use
can be suitably managed on the site.
4.2. Internal Council Referrals
The application was forwarded to the following internal Council officers for review and/or comment:
• Senior Development Engineer, Development Assessment
Council’s Senior Development Engineer has provided in an Internal Memo (ECM doc ref
24740636) their assessment and recommended conditions for the Decision Notice.
5. CONCLUSION & REASONS FOR DECISION
The proposed development generally complies with the requirements of the planning scheme and
does not raise any significant issues that cannot be addressed by reasonable and relevant
conditions. The application is therefore recommended for approval.
The report is provided in accordance with Section 63(5) of the Planning Act 2016.
