if an application were made under the new framework would also require the proponent to ensure
safe koala movement and avoid fragmentation of koala habitat.
Accordingly given the Planning Act 2016 provides that Council may give weight to amended or
replaced assessment benchmarks after the change application is made but before it is decided,
additional grounds of refusal have been included for Council’s consideration.
3 Conclusion
In the absence of a suitable resolution of issues it is therefore recommended that Council now
decide the application and refuse the application given it’s inconsistency with the planning
requirements for the site.
