Information Request MCU20 0146
Officer: Lisa Pienaar Direct Telephone: 07 53296514 Our Reference: MCU20/0146 Your Reference: 20200327 21 December 2020 TJ Morris & DJ Biss C/- Adapt Town Planning + Development Management PO Box 7618 SIPPY DOWNS QLD 4556 [email protected] Dear Sir/Madam Information Request Planning Act 2016 I refer to your application and advise that Council requires further information to satisfactorily assess the proposal. application details Application No. MCU20/0146 Street Address: 503 Middle Creek Rd Federal Qld 4568 Real Property Description: Lot 8 RP 835350 Planning Scheme: Noosa Plan 2020 (25 September 2020) INFORMATION REQUIRED The information requested is set out below: Issue – Flooding and proximity to Middle Creek The dwelling and secondary dwelling are proposed to be located in close proximity to Middle Creek which floods. The secondary dwelling is located approximately 13 metres from the top of the bank of the creek. The site plan indicates there are other opportunities on the site to locate the buildings that have greater distance from the creek. Council has no flood data and where there is an absence of data, local knowledge is required to establish the extent of flooding. Information Required Provide amended plans that increases the setback to the creek, or alternatively provide significant justification for the positioning of the dwellings with respect to local flooding events. If you choose the latter, provide justification around historical local flood events and that the dwellings floor levels are sufficient to avoid impacts from flooding. Issue - siting of dwellings in riparian With respect to Item 1 of this information request, the dwellings should be designed, sited, constructed and operated in a way that avoids adverse impacts on the Middle Creek’s ecological systems and processes. The dwellings proximity to the creek and the effluent disposal system associated with the dwelling sited close to the creek is of concern. In this instance setbacks to the creek can be increased which also will lessen impacts on the health of Middle Creek. The location of the dwellings may also compromise the integrity of the vegetation along the creek should it pose a threat to property. The location of the dwellings close to the creek also increase the extent of driveway in the riparian buffer area. Greater setback can be achieved and still have adequate setback to the front boundary. Information Required Provide amended plans that locate the dwellings with greater separation to the creek. Show the location of the effluent disposal system and potable water storage associated with the dwellings. Issue – 2 driveways The proposal includes an additional access point through a large extent of road reserve and results in 2 driveways. This is not likely to be supported. Access is easily achievable from the existing access point. Information Required Provide amended plans that relocate access to the existing access point. * Notes: a) An approved secondary dwelling attracts an infrastructure charge, a one off charge. b) No more than 1 dwelling and 1 secondary dwelling is allowed per lot. due date for response to information request The due date for providing the requested information is 21 March 2020. Please advise Council of your response to this information request in accordance with section 13 of the Development Assessment Rules. If you do not provide a response before the due date, it will be taken as if you have decided not to respond to the information request and Council will continue with the assessment of your application. other details You can follow the progress of this application online at www.noosa.qld.gov.au.
