5. ADVICE & INFORMATION
Patrick Murphy, Coordinator Planning - Comments
1. The site is zoned Medium Impact Industry.
2. It is noted that the pre-lodgement application form details the proposal as a Food and
Drink Outlet. During the meeting it was advised that proposed operational hours would
be:
Friday 5pm-8pm
Saturday and Sunday noon-8pm
A Food and Drink Outlet is defined as:
a. preparing and selling food and drink for consumption on or off the premises; or
b. providing liquor for consumption on the premises, if the use is ancillary to the use
in paragraph (a).
By virtue of the production of liquor being the industrial use on the site the provision of
liquor for consumption on the premises is not considered to be ancillary. Review of similar
enterprises has demonstrated that the tasting and consumption of liquor will be the
dominant use of the tastings and sales area as detailed on the proposed floor plan.
It is also noted that AO4 of the Medium Impact Industry Zone seeks that for a food and
drink outlet, excluding where a complementary use, the majority of the food or drink
prepared and sold incorporates the product or output of the industry activity on the site.
Compliance with this outcome would mean that the proposed use could not comply with
the Food and Drink Outlet definition.
3. The applicable use definition is ‘Bar’
Bar means the use of premises, with seating for 60 or less people, for—
a. selling liquor for consumption on the premises; or
b. an entertainment activity, or preparing and selling food and drink for consumption
on the premises, if the use is ancillary to the use in paragraph (a).
4. The classification of the use as a ‘Bar’ is consistent with Council’s approach to the most
recent applications which have included the provision of alcohol associated with a
brewery or distillery.
5. The application will need to demonstrate that the primary use is industrial (and the bar
is ancillary to this use) and that this use is appropriately located in an industrial area.
5. A Bar is an inconsistent use within the Medium Impact Industry Zone and subject to
Impact Assessment. An application would be assessed by a planning officer with the
final decision being made by Council. It is suggested therefore that consideration be
given to alternatives sites in Noosa such as Venture Drive Enterprise Precinct.
Codes informing assessment of the application would include, but not be limited to:
Noosaville Local Plan Code;
Medium Impact Industry Zone Code;

Business Activities Code; and
Works Codes
6. During the meeting it was advised that the proponent was also considering bringing food
trucks on to the site to provide food. Food trucks would be defined a Food and Drink
Outlet however would not comply with AO4 of the Medium Impact Industry Zone Code
as discussed above.
7. Car parking is required to be provided in accordance with Table 9.4.2.4 of the Driveways
and Parking Code. It is unclear as to why the area around the ‘Retail’ area on the
Proposed Floor Area Plan has been identified as Industry as it appears to be more
associated with the bar use
The following car parking rates are applicable:
Bar: 1 space per 20m2
Industry: 1 space per 50m2 up to 500m2
1 space per 100m2 in excess of 500m2
Office: 1 space 20m2
8. Any future development application on the site would need to comply with the relevant
landscaping requirements within the Noosa Plan 2020.
9. It is unclear how the proposal would comply with building requirements regarding access
to the toilets.
Diogo Carrico, Development Engineer - Comments
