Building & Planning
GENERALLY IN ACCORDANCE REQUEST
9 RULES ROAD POMONA QLD 4568
(LOT 190 MCH 1261)
MCU21/0150.02
Dear Council,
On behalf of the owner, please find attached the following documents in support of a “Generally
in Accordance” Request for the proposed Dwelling at 9 Rules Road, Pomona
1. PREVIOUSLY APPROVED Drafting Set
2. REVISED Drafting Set of newly proposed Dwelling
3. DECISION NOTICE MCU21/0150
The subject property is covered by a Council Material Change of Use Approval (MCU21/0150)
as well as a subsequent GIA Request (MCU21/0150.02) - we have since received advice from
Noosa Council that a further GIA Request is applicable for this project.
The approved dwelling (MCU21/0150.02) is not being constructed due to a change of ownership
of the property. Instead, the client plans to construct a new dwelling as per the attached
REVISED drafting set. Due to the design alteration, Noosa Council requires a GIA request for
the revised design.
The previously approved design was a 2 bedroom dwelling (65m2 internal GFA) with a 37m2
patio area, totalling 102m2. This dwelling was designed as a “future Secondary Dwelling” hence
the 65m2 internal GFA. The REVISED design is intended to be the primary dwelling and is a 2
bedroom dwelling (90m2 internal GFA) with a 30m2 patio area, totalling 120m2.
The revised design seeks to construct a new dwelling in a substantially similar location and
configuration to that which was previously endorsed. Importantly, the dwelling will remain within
the approved (and already) cleared area, and compliant with all accepted environmental and
development benchmarks.
The revised design;
● Remains single storey
● Maintains a low building height
● Retains similar roof form and articulation

Key siting outcomes remain unchanged;
● Comparable setbacks and spatial relationship to boundaries
● No intensification of development footprint towards Rules Road frontage
● No change to the established access arrangements
● No change to (already installed) wastewater system or position
● No additional clearing or site disturbance beyond the previously contemplated envelope
● Flood planning level maintained
● Continued compliance with the low-density intent of the Rural Residential Zone
It is our opinion that the revised dwelling plans are Generally In Accordance with MCU21/0150
as:
● The siting remains consistent.
● The scale and built form remain comparable.
● The planning intent is unchanged.
● The intensity of use is not increased.
● There are no additional adverse impacts.
Accordingly, we respectfully request written confirmation from Council that the revised plans are
accepted as being Generally In Accordance with the existing approval.
Should Council require any additional clarification or supporting information, please do not
hesitate to contact our office.
Yours faithfully,
Isaac McDonald
