PROPOSAL
The applicant seeks approval to change to an existing development approval for a Town Planning Consent – Duplex Dwelling.
The proposed additions include the proposed gym/rumpus room, lower ground floor, ground floor and first floor, in addition to external modifications. The proposed gym/rumpus room can only be accessed externally and is 2.8 metres in height, and it is within a close proximity to the western side boundary. The changes to the lower ground floor include the relocation and enlarging of the laundry, renovating and enlarging the bathroom, bedroom and living room, and an extension under the existing ‘sunken’ deck. The proposed additions to the ground floor will comprise of a new study and ensuites, a minor increase to the size of the kitchen and a proposed pergola within a close proximity to the eastern side boundary.
The additions to the first floor consist of modifications to the master bedrooms existing balcony. Further, the external modifications include an awning over the existing eastern side deck, new external cladding as a replacement of existing deteriorating timber cladding/shadowclad, new timber soffit to all eaves and updating the front façade with new aluminium screen and composite cladding and panelling.

Town Planning Consent TPC 2816 for a Duplex Dwelling was issued approved March 1995. An approved change for deck additions and relocation of swimming pool for Unit 1 was issued December 2005. An approved change for a swimming pool for Unit 2 was issued August 2009.

Under the Planning Act 2016 the application must be assessed against each of the following statutory planning instruments to the extent they are relevant to the development:

Planning Regulation 2017;
The Noosa Plan 2020.

Statutory Process
The applicant has requested to make a minor change to a development approval under s78 of the Planning Act 2016. An application for a minor change to a development approval can only be made in circumstances where a change would constitute a ‘minor change’.
The proposed change to the development approval requested by the applicant is determined to constitute a minor change on the grounds that:
the development would not result in substantially different development as;
the change does not include prohibited development;
the change would not require the application to be referred to an additional referral agency or cause a referral agency to have regard to new matters prescribed by regulation;
where the original application was code assessable, the change would not cause the application to become impact assessable.
Statutory Instruments – Planning Scheme
The development at the time of the original approval complied with all the relevant provisions of the superseded planning scheme. The superseded planning scheme parameters are similar to that of the Noosa Plan 2020 provisions. Therefore the alterations and additions comply with the superseded planning scheme and considered to meet the provisions of the Noosa Plan 2020.

Table 1 below shows the plot ratio and site cover for the development.

The applicant proposes an increase in GFA of 94m2 resulting in a proposed plot ratio of 0.38:1. In addition, the proposed works increase the site cover by 14m2, leading to an overall site cover of 40%. Performance Outcomes PO10 and PO11 of the Medium Density Residential Zone Code states: Site Cover of development does not exceed 40% of the site area and Plot Ratio of development does not exceed 0.4:1. The proposal does not exceed the allowable site cover and plot ratio.
Side Setbacks
Acceptable Outcome AO12.3 of the Medium Density Residential Zone code seeks buildings and structures meet a 1.5 metre setback up to 4.5 metres in height to boundaries other than road frontages and rear boundaries.
The proposed gym/rumpus room and the proposed pergola are setback 1.5 metres from the side boundaries.
The setback between the proposed pergola and the side boundary is highlighted in Figure 15, and measured at 1.5 metres. The proposed pergola will provide protection to the existing ground floor deck (Figure 16) from the weather and is approximately 2.5 metres in height. A site visit confirms the balcony of the adjoining property faces a south-western direction and towards the location of the proposed pergola (Figure 18). Further, figure 19 demonstrates the view from the deck is comprised of mature trees and will still be visible after construction of the pergola. The proposed pergola is setback the required 1.5 metres and is considered not to obstruct significant views, nor adversely affect the private open space of the adjoining property.

The setback between the gym/rumpus room and the side boundary is highlighted in Figure 21, and measured at 1.5 metres. The proposed gym/rumpus room is approximately 2.8 metres in height (Figure 22) and is situated next to the existing building (Figure 23). A site visit confirms the access to the adjoining property deck faces a south-eastern direction and towards the location of the proposed gym/rumpus room (Figure 24). The proposed gym/rumpus room is setback the required 1.5 metres and is considered not to obstruct significant views, nor adversely affect the private open space of the adjoining property.

conclusion & reasons for decision
The proposed development generally complies with the requirements of the planning scheme and does not raise any significant issues that cannot be addressed by reasonable and relevant conditions. The application is therefore recommended for approval.
The report is provided in accordance with Section 63(5) of the Planning Act 2016.
RECOMMENDATION
With regard to Application No. 51995.1490.05 51995.1490, to make a minor change to an existing approval for TPC 2816, a Duplex Dwelling situated at 1/3 Parkedge Rd Sunshine Beach Qld 4567 described as Lot 1 GTP 105103, Council on decided to:
A.	Include additional condition 18 relating to unit 1 to read as follows:
B.	Note the report is provided in accordance with Section 83(9) of the Planning Act 2016
Additional Condition - 27 April 2021 for 1/3 Parkedge Road, Sunshine Beach.
