5.         Proposed Development Details

5.1        Material Change of Use
This report demonstrates that the proposed Material Change of Use of Premises for a Personal Training Studio
(Entertainment & Dining Business – Type 2 Recreation, Amusement and Fitness) on the site is an inconsistent
use as defined within the Noosa Plan 2017. As a consequence of an Advisory letter from Noosa Council, the
operator of Noosa Strength Centre is formally lodging this application. Refer to Architectural Plans prepared by
Zest Building Design in Appendix A.
The proposed use is not one of a traditional gymnasium model but operates more as a personal training studio
with no more than 6 clients in attendance at any one time. Class size range from one on one personal training,
to a maximum of a 6-person group fitness class. Refer to Photographs 1 and 2 below which illustrate examples
of the small group fitness classes.
There are no facilities such as in other more traditional gyms for members to access 24 hours and undertake a
workout utilising equipment and machines by themselves (refer to Photographs 3 and 4). All classes and
training has a personal trainer in attendance and must be booked in advance, this ensures no perceived
impacts on adjoining tenancies.
The applicant seeks approval to formalise the existing personal training studio within tenancy 2 on the site. The
lower floor of the tenancy will comprise:
     -   Reception area,
     -   Free weights and (gym),
     - Gymnasium floor activity space, and
     -   Change room including toilet.
The mezzanine area will be used for:
     - Storage area for weights and equipment
The above uses are to be located in the existing building on site with no new works proposed.

5.3        Staffing
One personal trainer is on site at all times and conducts the small training classes and one on one personal
training sessions.

5.4        Carparking
In accordance with the Noosa Plan 2017, Type 2 Recreation, Amusement & Fitness uses have a carparking rate
of:
        1 space per 20m2, or part thereof, of use area;
        OR
        1 space per 3 persons capable of being entertained at any one time, whichever is the greater.

It is noted that several areas of the studio do not contribute to actual car parking generation and these include
the reception, amenities, stairs, and equipment storage areas. The personal fitness studio has a total Use Area
(as defined by the Noosa Plan) of 77.3m2. Accordingly, the Noosa Plan requires four carparking spaces to be
provided.
                                                                                                                 14

                                                                                        2/37 Gateway Drive, Noosaville

The industrial complex in which the personal fitness studio is located incorporates 20 carparking spaces. In
conjunction with the small class sizes, the starting time of the classes have been staggered so that they do not
coincide with the peak use of the other tenancies on site. Sufficient carparking is able to be provided on site to
meet the Specific Outcome as detailed within the Noosa Plan.

Previous recent approvals by Council for a Gymnasium in Selkirk Drive recognised the peak times within fitness
centres and the potential loading on existing parking infrastructure. The small scale use proposed falls well
within the accepted car parking parameters Noosa Council has previously accepted.

6.         State Planning Interests

6.1 State Interests (State Assessment Referral Agency)
The State Assessment and Referral Agency (SARA) provides a single State agency lodgement and assessment
point for development applications, where the State has an interest under Schedule 10 of the Planning
Regulation 2017. A review of the State interests has been undertaken and no SARA Triggers were identified in
relation to the proposed fitness studio located in an existing industrial complex.

6.2        State Planning Policy
The State Planning Policy 2017 (SPP) defines the Queensland Government’s policies about matters of
state interest in land use planning and development. The SPP only applies to development assessment if
the planning scheme has not yet appropriately integrated the SPP. If there is a discrepancy between a local
planning scheme and a state planning policy, then what is outlined in the state planning policy overrides the
planning scheme. The Noosa Plan does not reflect the SPP and assessment against the SPP is required.
Part E of the SPP details the interim development assessment requirements for the following state
interests:
 State Interest                       Comment
 Liveable Communities                 Not applicable
                                      The site is well serviced by the existing emergency service
                                      infrastructure.
 Mining and extractive resources Not applicable
                                      The site is not within a key resource area (KRA), the separation
                                      area of a KRA or the transport route separation area of a KRA.
 Water quality                        Not applicable
                                      The proposed use is located in an existing industrial complex within
                                      the urban zoning and does not involve a premises of 2,500m2
 Natural hazards, risk and resilience Not applicable
                                      The proposed use is located in an existing industrial complex.
 Strategic airports and aviation Not applicable
 facilities The site is not within close proximity to a strategic airport or aviation
                                      facility.

6.3        State Development Assessment Provisions
 The State Development Assessment Provisions (SDAP) set out the matters of interest to the state for
 development assessment, where the state assessment and referral agency (SARA) is responsible for
 assessing or deciding development applications as assessment manager or as a referral agency. The SDAP is
 not applied by local government in the assessment of this impact-assessable planning report.

7.         Noosa Plan Considerations

7.1        Locality and Zone
The subject property is located in the Noosaville Locality within the Industry Zone of the Noosa Council. The
following extracts are taken from the Noosaville Locality Plan in Part 11 of the Noosa Plan 2017 and state the
relevant overall outcomes for the Noosaville Locality.

9.7.2 Overall outcomes for the Noosaville Locality
a) New uses and works are located, designed and managed to—
       i be compatible with other uses and works;
       ii maintain the safety of people and works;
       iii avoid significant adverse impacts on the amenity enjoyed by users of other premises or surrounding
       area, including acoustic and visual qualities; and
       iv avoid significant adverse effects on the natural environment, including native habitat removal,
       fragmentation and attrition;

j) Residents of the Noosaville Locality enjoy high levels of convenience and accessibility to urban services;

l) Accessibility to recreational opportunities provides residents and visitors with valued lifestyle opportunities;

ee) Significant retail and commercial uses provide residents and visitors with a range of low to high order goods
and services;

vv) For the Industry Zone—land in this zone—

         iv does not accommodate uses that would harm the environment through excessive noise, odour, dust,
         or other waste;
         v is developed in a fashion that does not detract from the character of its locality or impact on the
         major road network;
         vii provides for a high level of runoff water quality to Eenie Creek and Lake Doonella
Comment:
The proposed personal fitness studio is consistent with the Overall Outcomes for the Noosaville Locality. The
use presents a low intensity use of the site and does not pose any adverse impacts on the surrounding existing
industrial businesses as evidenced by other gyms and dance studios existing harmoniously with industrial uses.
The existing adjoining uses are predominantly warehouse type uses (plumbing and agricultural feed supplies)
with no industrial manufacturing occurring and the fitness studio will be compatible with these uses.
There will be negligible vehicular traffic generated as a result of the proposed personal fitness studio with a
maximum of six participants per class attending prior to 9.30am and after 5.00pm. These hours are
complimentary with the other existing uses on site where possible peak loads for car parking are staggered due
to the differing uses occurring.
Previous recent approvals by Council for a Gymnasium in Selkirk Drive recognised the peak times within fitness
centres and the potential loading on existing parking infrastructure. The small scale use proposed falls well
within the accepted car parking parameters Noosa Council has previously accepted.

                                                                                                                      18

                                                      MCU to establish Entertainment & Dining Business – Type 2 (Gym)
                                                                                        2/37 Gateway Drive, Noosaville

The proposed use is located in an existing building and will not impact on the surrounding major road network.
The use will not produce excessive noise, odour, dust or other waste. The proposed fitness studio will have
lesser impacts than approved industrial uses.
The proposed personal fitness studio is well located to provide the Noosaville residential population with a
quality personal fitness training service and provides a further recreational facility for visitors and residents.

7.2        Land Use Definition
The proposed development has been defined under the Noosa Plane 2016 as;
Primary Use: Business Uses
Use Class: Entertainment and dining business
Use: Type 2 Recreation, amusement & fitness – The use of premises involving recreation or amusement
activities, including cinema, health & fitness club, gym, sport activity or brothel.
Comment: The proposed development is consistent with the above definition.

7.3        Level of Assessment
In accordance with the Assessment Table 11.9 f o r the Industry Zone in the Noosaville Locality, the
development is subject to Impact Assessment.

7.4 Applicable Development and Overlay Codes
The following Codes are applicable to the proposed development:
    •         Noosaville Locality Code;
    •         Business Uses Code;
    •         Driveways and Carparking Code;;
    •         Waste Management Code; and

Comment:
Where probable solutions are not met, an alternative solution demonstrating compliance with the specific
outcome is provided below, including sufficient planning grounds to justify the conflicts with the probable
solutions.

    7.4.1          Noosaville Locality Code
Comment: The proposal is consistent with the majority of the specific outcomes outlined in Tables 11.23 of
the Noosaville Locality Code. The proposed personal fitness studio is located in an existing industrial complex
and no alterations to the external built form are proposed. The existing premises is air-conditioned and
consists of a tilt up slab construction which will minimize any noise impacts from the fitness studio. There will
be negligible vehicular traffic and noise generated from the proposed used use as a result of the fitness studio

                                                                                                                  19

                                                                                          2/37 Gateway Drive, Noosaville

catering for small class sizes (maximum of six participants per class) and one-on-one training programs.

The entrance to the gym is from the central driveway and carparking area. No external works are proposed and
therefore the use will not affect the visual amenity of the area and will retain the existing character of the area.

    7.4.2          Business Uses Code
Comment: The proposed personal fitness studio has been assessed and is consistent with the majority of the
specific outcomes outlined in Tables 14-6 and 14-8 of the Business Uses Code. Whilst the proposed use does
not comply with Acceptable Solution S10.1-S10.3 the use is considered to comply with the most relevant
outcomes and does not impact on the hierarchy of centres.

There will be little disturbance to the environment as the proposed use will not generate excessive noise,
odour, dust or other waste. Negligible vehicular traffic and noise will be generated from the site as the
proposed small fitness studio will cater for small class sizes (maximum of six participants per class) and one-on-
one training programs. The use presents a low scale activity that will not negatively impact upon the adjoining
industrial uses or the residential uses to the west.

Standard water, sewer, electricity and telecommunication connections are provided. The configuration of the
existing industrial estate presents a high level of accessibility and functionality. The site is accessed via existing
pedestrian, cycle and vehicular infrastructures which connect the site to the surrounding residential
communities. The site is easily accessible at all times.

Sufficient carparking spaces are provided on-site for participants and staff with the small fitness classes
commencing and concluding before and after the opening and closing of the adjoining industrial uses. The
existing building incorporates a change room, toilet and shower for participants and staff (refer to
Architectural Plans prepared by Zest Building Design in Appendix A).

    7.4.3          Driveways and Carparking Code
Comment: The proposed development has been assessed and is consistent with the Probable Solutions
described in Tables 14.49-14.51. The proposed complies with the required carparking spaces as demonstrated
in Section 5.4 of this report. The proposed use is located within an existing industrial complex which
incorporates a central carparking area and two driveways. It is noted that several areas of the personal fitness
studio do not contribute to actual carparking generation. These areas include;
    -    Reception,
    -    Equipment storage area, and
    -    Amenities.

    7.4.4          Waste Management Code
Comment: The proposed development complies with the relevant Probable Solutions detailed in Table 14.60
of the Waste Management Drainage Code. The existing industrial complex where the proposed use is to be
located incorporates adequate area for on-site storage and collection of recyclable and non-recyclable waste
materials. As a small personal fitness studio minimal waste generation is to be expected.

                                                                                                                    20
