Justification
The Development Approval was originally issued for the purpose of creating the following lots:
Lot Area Purpose
Lot 101 (Bunnings site) 22,590m2 Bunning Warehouse Site
Lot 103 (Northern lot) 4,073m2 Trade Supplies Store
(MCU22/0051)
During the currency of this reconfiguring a lot (ROL) approval, Bunnings have obtained approval for a Material
Change of Use (MCU) for a Hardware and trade supplies (MCU22/0051), to be located on approved lot 103
identified within Figure 1 below. This MCU approval was initially issued on 2 November 2023 and was subject
to representations which were not resolved until 21 May 2024.
Enacting the ROL has been on hold pending the outcome of this MCU application. Now that the MCU approval
is in place, this extension is sought in order to provide time for the ROL to be enacted.
This extension to the currency period is sought to allow time to obtain necessary operational works approvals
and undertake the works necessary to enact the ROL. The 5-year extension is also sought to align the ROL
approval with the MCU approval recently obtained over the site, which remains current until 26 October 2029,
one month after the requested currency date for this ROL approval.
Figure 1 ROL Approval Plan Figure 2 2020 Aerial of Subject Site
At the time the application was originally made in April 2014 the planning scheme in force was The Noosa Plan
2006 (superseded planning scheme), under which the subject site was wholly included within the Industry
Zone. The Noosa Plan 2006 was superseded by the current Noosa Plan 2020 (current planning scheme),
which was endorsed by Noosa Council on 16 July 2020 and came into effect on 31 July 2020.

Despite a new planning scheme coming into effect, the zoning for the site is has not significantly changed, with
the land still Included within an industrial zoning (medium impact industry) and the overall intent of this zone
being generally consistent with the planning intent for the site at the time of the original approval.
The key development parameters for the site under the Noosa Plan 2020 are largely reflective of the
requirements of the superseded Noosa Plan 2006. As such the approved subdivision plan is generally
compliant with the performance outcomes and acceptable outcomes of the Reconfiguring a Lot Code under
both planning schemes, including the minimum lot areas, minimum dimensions, and lot layout.
Planning Scheme Zone Minimum Lot Size Min Width / REC14/0005
Dimension Compliance
Noosa Plan 2006 Industry Zone 1,000m2 20m
Noosa Plan 2020 Medium Impact 1,000m2 20m
Industry
The northern portion of the site (Proposed Lot 103) is not affected by Biodiversity, Waterways and Wetlands
Overlay under the Noosa Plan 2020 and site vegetation clearing has been addressed as part of the MCU
approval over the site.
In addition to the above we note that a pre-lodgement meeting was previously held with Council to discuss the
Bunnings site (Council ref: PLM20/0019). As part of the pre-lodgement meeting Council confirmed that “the
minimum lot size and intent of the new scheme is similar to the superseded planning scheme and no significant
concerns are raised”.
Planning Schemes typically have lifespans of at least 10 years, and thus we do not envisage the strategic
intent of the land substantially changing prior to 2030.
