Risk
The construction of the Digital Hub is due for completion in the first quarter of 2018. Should Council
decide not to award the tender for management services at this time, there is potential that the
building may be completed prior to management arrangements being finalised and implemented.

Consultation

External Consultation - Community & Stakeholder

External independent legal advice was sought from King and Co Solicitors regarding the tender
process and Council’s options to progress this tender.

Council can resolve to not award this tender under Local Government Regulation 2012 S.228 (8)
– “A local government may decide not to accept any tenders it receives” and Conditions of Tender
clause 14.1 – “The Principal will not be bound to accept the lowest or any Tender”.
