5.    CONCLUSION & REASONS FOR DECISION
The proposed reconfiguration seeks to subdivide the existing 4.07 hectare lot into 2 lots and includes
a new boundary which dissects the riparian buffer area. The planning scheme seeks to protect
riparian buffer areas and waterways from development so as to ensure the protection of ecologically
important areas.
The applicant proposes an environmental covenant and rehabilitation to part of the riparian buffer
area but this will be managed by multiple land owners. Furthermore, the proposed extent of
environmental covenant and rehabilitation is not sufficient and will not provide adequate protection
to the riparian buffer area. The creation of a new lot boundary through the riparian buffer raises
concern as it will likely result in additional vegetation removal due to the current state and planning
scheme exemptions for vegetation clearing. Accordingly, the application is recommended for refusal.
