PLANNING & ORGANISATION COMMITTEE MEETING AGENDA 3 FEBRUARY 2015
Simplified “charges breakup” agreement as negotiated with Unitywater. The proposal that
was presented to Council at the Planning and Organisation Committee of 19 August 2014
was accepted by Unitywater on 23 December 2014 reducing the number of apportionments
from 12 to 3 development categories to apply uniformly across the whole Noosa area;
Automatic increase provision.
This was previously referred to as indexation and the legislation now also requires the
resolution to state how such increases are to be worked out.
To maintain simplicity and consistency with former contributions and charges policies that
still remain effective for many current approvals, it is preferable to continue using the
Consumer Price Index as the basis for applying indexation (subject to the limitations of the
legislative requirements) rather than further complicating the process with a new and more
complex 3 year rolling average Produce Price Index. As Noosa’s charge rates are
predominantly already set at the current statutory maximum, the automatic increase
provision (indexation) will only occur if the Minister increases maximum adopted charges;
Offsets and refunds for developer provided trunk infrastructure.
The legislation has mandated that offsets apply against the whole infrastructure charge and
not limited to an amount apportioned to a specific network;
Re-valuing infrastructure for offsets and refunds.
Under the legislation the applicant may request a revaluation of the establishment cost of the
trunk infrastructure being provided by the development for offsetting against infrastructure
charges.
Conversion applications to change non-trunk infrastructure to trunk infrastructure.
These applications, if approved, then also enable the development to access the offsets and
refund provisions for providing the infrastructure. The template provided by the Local
Government Association of Queensland has been used as the process and criteria for
assessing such applications.
The legislation requires that:
“A charges resolution must state the day when an adopted charge under the resolution is to
take effect”; and
“The charges under the charges resolution take effect:
a) if the charges resolution is uploaded on the relevant local government website before
the beginning of the day stated in the resolution as the day for the charges to take
effect - on the day stated in the resolution; or
b) otherwise - on the day the charges resolution is uploaded on the website.”
The date proposed for the amended resolution to take effect is therefore Monday 16 February 2015
following Council’s decision at the Ordinary Meeting of Thursday, 12 February, 2015 and this is
reflected in the report recommendation.
A “track changed” version of Council’s current Adopted Infrastructure Charges Resolution (No.1)
highlighting all the amendments made is available for information if requested.
