REPORT
The purpose of this report is to submit to Council a final version of the local law amendments for
advertising devices following a second round of public consultation as contained in Attachment 3-
Administration and Other Subordinate Local Law (Amendment) Subordinate Local Law (No.1)
2019 and Attachment 4- Administration (Amendment) Local Law (No.1) 2019 (draft local law) for
adoption.
1. Background
During the preparation of Council’s new planning scheme it was determined that advertising
devices were best regulated under a more prescriptive local law approach rather than a planning
scheme. Therefore, when the new planning scheme takes effect, advertising devices will be
regulated under a local law and not under the planning scheme.
The draft local law consolidates current advertising device provisions operating under The Noosa
Plan and two local laws into a single local law. The key current provisions remain largely
unchanged in the draft local law, with total signage allowances per tenancy up to 10sqm and up
to 4sqm for individual signs remaining unchanged, except for the Noosaville and Cooroy
Industrial zones (excluding Eumundi Noosa Road and Walter Hay Drive) where individual sign
size has increased to 6sqm.
The draft local law was first placed on public notification for an initial 5 week period from 21 June
2019. At the request of local business associations, the consultation period was extended for a
further 2 weeks and closed on 9 August 2019.
A number of issues were raised both in support and objection to the draft local law.
Overwhelmingly, submissions in objection to the draft local law related to the proposed
introduction of an approvals process and annual licence renewal fees as well as the proposed
prohibition of A-frames, tear drop flags and real estate directional signs.
A report was submitted to Council at its meeting on 17 October 2019 recommending a revised
version of the draft local law for further public consultation. Amongst other matters, Council
resolved to make the following changes to the draft local law:
