Policy and Legislative Considerations
Under Section 236 (1) (b) (ii) of the Local Government Regulation 2012, Council is not required
to tender for the leasing of the property as the lease is to a community organisation. The
requirements of this exception are that a relevant Council resolution is first obtained.

Lifeguard Services Agreement - The existing Lifeguard Services agreement expires on 28
October 2022 (at the cessation of the 1 X 5 year option). The proposed lease will consider
provisions for access and storage for an alternate lifeguard service provider should Council not
continue with SLSQ Lifeguard services after the current contract expiration date.
SLSQ Support Services - The proposed lease will allow SLSQ to continue to provide support
services (jet skis etc.) from the new storage facility for the full 20 year lease period. These
services are separate to those provided to Council in the Lifeguard Services Agreement and are
provided at no cost to the community.
