Officer: Blake Coulston Direct Telephone: 07 53296420 Our Reference: DBW21/0068 Your Reference: 2357/21 27 May 2021 BJE Nash C/- Fluid Building Approvals Sunshine Coast 172 Brisbane Rd MOOLOOLABA QLD 4557 [email protected] Dear Sir/Madam Information Request Planning Act 2016 I refer to your application and advise that Council requires further information to satisfactorily assess the proposal. application details Application No. DBW21/0068 Street Address: 79 Garnet St Cooroy Qld 4563 Real Property Description: Lot 192 MCH 976 Planning Scheme: Noosa Plan 2020 (25 September 2020) INFORMATION REQUIRED The information requested is set out below: Issue AO6.1 of the Biodiversity, Waterways and Wetlands Overlay Code seeks that development does not occur within the riparian buffer area. PO6 also stipulates that any new development in a riparian buffer area and wetland area should be avoided. In the submitted planning report it is noted that only 80% of the site is covered in riparian buffer area and that there are no alternative locations to position the shed. After a review of the site it is considered that there are still alternative locations for the proposed shed that are outside the riparian buffer and which also maintain the required setbacks. Information Required Amend the proposed plans to relocate the proposed shed outside of the riparian buffer. Issue In responding to AO5.5 of the Rural Residential Zone Code, the application material has stated the amount of roof cover that is exceeding the required 500m2 (112m2) but has not demonstrated or proved this. Information Required Provide a plan illustrating the calculation of roof cover for all buildings and structures that is existing and proposed on the site. Issue The non-compliance with AO5.5 of the Rural Residential Zone Code triggers the assessment of PO5. The main performance outcome when assessing the increase of roof cover is that the building does not present an appearance of bulk to adjacent properties, roads or other areas in the vicinity of the site. To accurately assess the appearance of bulk to the adjoining properties further clarification is required detailing the extent of existing and proposed structures on site that could be seen by adjoining neighbours and the streetscape. Information Required Provide further explanation as to how the proposal will not have the appearance of bulk to adjacent properties, roads and other area by elaborating on what proportion of the buildings are seen by affected parties. (On-site meeting may also be organised to assist in addressing this requirement) Issue AO6.2 of the Rural Residential Zone Code states that the storage of chemicals or machinery in buildings or structures is not to be within 100m of a dwelling house or a waterway. As stated in the application material, the intended purpose of the shed is for storage and the restoration of vehicles. This would usually result in the storage of chemicals and machinery. Information Required Provide justification in regards to PO6 of the Rural Residential Zone Code; or Clarify if chemicals or machinery will be stored within the proposed shed. Issued A recent issue on the site was the use/storing of trucks associated with the planning schemes defines as a Transport depot and the use of a new driveway adjacent to the western boundary. Council requires elaboration on the type of vehicles that will be stored in the proposed shed in order to assess PO7 of the Rural Residential Zone Code. Information Required Elaborate on the type and amount of vehicles that will be stored in the proposed shed, including details of vehicles to be restored and who owns these vehicles. Issue As previously noted, there was an issue regarding the use/storing of trucks and the use of a new driveway which was causing noise and air quality issues, which impacted the amenity of residents of associated, adjoining or nearby premises. Information Required: Provide justification / solutions to ensure that noise and dust is minimised and will not have an impact on the conditions enjoyed by residents of associated, adjoining or nearby associated. due date for response to information request The due date for providing the requested information is 26 August 2021 Email your response to [email protected].
