7. ADVICE & INFORMATION
General Comments
Reconfiguring a Lot Code
One of the fundamental outcomes which will guide the assessment of the application is
Acceptable outcome AO26 and corresponding Performance outcome PO26 of the
Reconfiguring a Lot Code. The proposed development application is to clearly detail how
the realignment is an improvement of the existing situation, and is more in alignment with
the purpose of the Rural Zone etc. Supporting information may include a conceptual plan
of the rural operations on the site (i.e., extension for micro herbs, packing shed etc).
Acceptable Outcome AO26 - The rearrangement of lot boundaries results is an
improvement to the existing situation whereby the size and dimensions of proposed lots
comply more fully with Table 9.5.1.4 Minimum lot size and dimensions. and at least one of
the following is achieved:
a. the rearrangement of lots remedies an existing boundary encroachment by
a building or structure;
b. the rearranged lots will be made more regular in shape;
c. access is provided to a lot that previously had no access or an unsuitable access;
d. the rearranged lots better meet the overall outcomes for the zone and the local
plan area in which the site is situated;
e. the rearrangement of lots provides for a significant improvement in rural
productivity; or
f. the rearrangement of lots results in a significant improvement in the protection of
environmental values.
Rural Zone Code & Biodiversity, Waterways and Wetlands Overlay
Acceptable Outcome AO11.2
Natural Vegetation is retained wherever possible.
Performance Outcome PO11
Development does not have a significant adverse impact on the natural values of the site
including through:
a. loss of biodiversity values, fauna habitat and fish passage;

b. changes to natural drainage;
c. disturbance to any wetland systems;
d. erosion and the transport of sediments off site (including pollutants and other
contaminants which would affect the capacity of agricultural lands);
e. worsening of landslide or fire risk;
f. on-site effluent disposal;
g. creation of dust and air pollutants;
h. disturbance of buildings and features, including natural features, of cultural
heritage significance.
The rear boundary of proposed Lot 25 traverses an area subject to the Biodiversity,
Waterways and Wetlands Overlay. Any future application is to demonstrate how the
boundary realignment will not result in further fragmentation of rural land, or affect
biodiversity values.
It was discussed during the meeting that the proposal intends on retaining existing
vegetation on the site and the realignment will not result in any vegetation removal. It is
recommended the new alignment makes allowance for access between the rear boundary
and mapped area of biodiversity significance, free of constraints, without requiring
vegetation clearing.
The location of services are to be detailed on future plans to ensure all infrastructure is
wholly contained in each respective lot.
