A development approval for a Development Permit for a Material Change of Use - Low impact industry and Operational Works (Civil, Landscape, Driveway, Car Parking, Stormwater & Sewer) was issued on 6 April 2021.
The applicant suspended the appeal period and made representations on 15 April 2021 to the development approval conditions. The representations are detailed below but relate to annotations to an approved Landscaping plan requiring the planting of Meleleuca Quinquenervia.

Assessment of Representation
The request to amend the plans to remove reference to three Meleleuca Quinquenervia, to be replaced with three Cupaniopsis Anacardioides was referred to Council’s Ecologist for comment. The proposal was supported as Cupaniopsis Anacardioides are considered suitable species to locate in this area and will provide sufficient screening to the side of the building. It is noted that no change Conditions are required, rather a change to the annotation on the following approved plans referenced in Condition 2:

conclusion & reasons for decision
The request to amend the plans to remove reference to three Meleleuca Quinquenervia, to be replaced with three Cupaniopsis Anacardioides is supported as Cupaniopsis Anacardioides are considered a suitable species to locate in this area and will provide sufficient screening to the side of the building.
RECOMMENDATION
With regard to Application No. MCU21/0002 and OPW21/0015, and the representations made, Council on 15 April 2021 decided to:

The accompanying approved plans nominate the inclusion of three (3) Meleleuca
Quinquenervia between the buildings western wall and the retaining wall. We seek to have
the plans amended to nominate Cupaniopsis Anacardioides in lieu as they are less invasive
to the building and related footings and retaining wall structure.
