Dear Sir/Madam

RE: EXTENSION APPLICATION ______________________________
EXTENSION OF CURRENCY PERIOD FOR DEVELOPMENT APPROVAL MCU17/0025 MATERIAL
CHANGE OF USE FOR INDUSTRIAL BUSINESS TYPE 1 WAREHOUSE AND OPW17/0095 FOR
OPERATIONAL WORK (ADVERTISING DEVICES) ON PREMISES AT 62 AND 64 -66 RENE
STREET, NOOSAVILLE DESCRIBED AS LOT 59 ON RP228906 AND LOT 280 ON SP104321

Martoo Consulting has been engaged by the new owner of the above site to request an extension to
the currency period for the above Material Change of Use and Operational Works approvals applicable
for the site. The owner seeks to extend the relevant period by an additional 2 years to ensure
construction and use of the site can be undertaken and finalised within the prescribed period.

The site has had the following development history:

 Approval Date Comments

 MCU17/0025 - Warehouse Approved 21.09.2017 MCU: 4 year currency
 OPW17/0095 – Signage OPW: 2 year currency

                                                        Applicant Response lodged 31.05.2021
                                                        Pending Council assessment and decision

The site was recently sold with the new owner progressing with the design and construction phase of
the project. The new owner is committed to commencing construction of the project as soon as
possible as demonstrated by lodgement of the Operational Works application for civil works. However
due to the uncertainties associated with COVID, including the sourcing of labour and materials as well
as satisfying finance requirements, the applicant is concerned that they make not be able to have the
project finalised within the specified time frame and requests a 18 month extension until 21st
September 2023.

In support of the extension of currency, the owner notes:

 The current approval was issued 21.09.2021 and was due to lapse 21.09.2021

 The amendments to the Planning Act declaring COVID 19 as an applicable event
provides for an extension of currency periods by six months which results in the
             application now lapsing on 21.03.2022.

 The above lapsing date may not allow sufficient time to attain relevant operational works
approvals, building approvals, commence construction and commence the use.

 The applicant has experienced delays in negotiating with Unity Water and Council
              regarding an acceptable sewer diversion.

 The applicant has experienced delays in the preparation of relevant documentation due to
              the current construction boom.

 COVID has increased issues associated with supply chains and obtaining building
              materials.

 Concerns are raised about commencing the project and not having sufficient time to
finalise the construction and commence the use.

 Financiers are seeking assurances that the project will have a current approval for the
              site.

STATUTORY REQUIREMENTS:

In accordance with Section 87 of the Planning Act 2016, in assessing an extension application, the
assessment manager may:

87(1) When assessing an extension application, the assessment manager may consider any
matter that the assessment manager considers relevant, even if the matter was not relevant to
        assessing the development application.

ASSESSMENT:

The current development approval was assessed under the now superseded Noosa Plan 2006 which
detailed that a warehouse (self storage) was a consistent code assessable application. The Noosa
Plan 2020 now includes the site in Medium Impact Industry zone which details self storage facilities as
inconsistent and impact assessable uses.

The original approval was considered to meet the provisions of the superseded Noosa Plan 2006 and
was approved subject to conditions. The current proposal has been reviewed against the relevant
codes of the Noosa Plan 2020 and is considered to meet the provision of the Code except in relation to
the use of the site for self storage.

The Medium Density Industry Zone Code includes the following outcome in relation to self –storage;

The overall outcomes sought for the Medium impact industry zone are as follows: -
         (i) warehouses for self-storage facilities are avoided to protect industrial land from
                 underutilisation;

The development approval for the site was issued in 2017 and the use of the site for self storage would
have been considered when assessing the demand for the use in the preparation of the Noosa Plan

2020. Whilst the existing approval does not comply with the Noosa Plan 2020, the approval is still
current with the extension required to ensure a valid permit throughout construction.

It is noted that the site adjoins an existing constructed self-storage facility and is a logical extension to
this existing facility with access provided along the rear from this adjoining site. The proposed building
is also designed such that is could be easily converted to industrial uses if required in the future.

The applicant has spent considerable funds on progressing the development and intends to commence
construction as soon as the operational works permit is issued.

The proposed extension of the currently period will not impact on the intent of the Noosa Plan and is
considered to meet the criteria of the Act. The applicant requests an extension of the currency period
as detailed below:

     MCU17/0025 & OPW17/0095 - a further 18 month extension until 21.09.2023

This development application has been prepared in accordance with the Planning Act 2009 and is
being submitted with the following attached completed Council form. Councils application fees will be
paid upon confirmation of Councils fee.
