MATERIAL CHANGE OF USE TO ESTABLISH MULTIPLE HOUSING & VISITOR ACCOMMODATION
215 DAVID LOW WAY, PEREGIAN BEACH 41

balustrades as well as an appropriate colour palette, which is consistent with existing
development, as well as the coastal landscape; and,
 The proposed development provides a quality landscaping outcome that is consistent with the
landscaping qualities of the Peregian Beach area.

         Environment
 The proposed development retains and protects an area of 5,276m2 for environment and
conservation purposes. It is noted that this area was required to be dedicated as a reserve
associated with Court Approval (Appeal 2587 of 2008). Despite this, the development has not been
enacted upon and this development would replace the current Court Approval, should it be
           approved.

Community Expectations (Residents and Local Businesses)
 The proposed development is consistent with Council’s and the community’s expectations on the
site, due to the existing approved ‘Essence of Peregian’ development remaining current and
containing very similar land use elements, as well as built form/character.

144. Accordingly, based on the above, the proposed development complies with the Strategic Framework,
Desired Environmental Outcomes, as well as the Overall Outcomes of the Eastern Beaches Locality
Code. The Eastern Beaches Locality has been addressed in full and is included within Appendix 12 of
         this Town Planning Report.

5.5.1.2 Building Height – Probable Solution S4.1
145. The proposed development generally complies with the preferred maximum building height of 8
metres specified within with code, with all detached units containing a maximum building height not
exceeding 7 metres in height, when considered from the finished ground level. When considered from
the Natural Ground Level, there are a number of roof forms associated with the detached Multiple
Housing Units that exceed the 8 metre height limit, as demonstrated in Figure 22 below.

146. Further, the Visitor Accommodation and shared Multiple Housing building, which is proposed to be
constructed in Stage 2, contains a total building height not exceeding 12 metres (as demonstrated in
         Figure 23 below).
