Dear Sir/Madam
Re: Breach Identified for property located at 31 Flooded Gum Pl BLACK MOUNTAIN QLD 4563,
described as Lot 14 SP 161828 - Property No. 158281
Council has recently received a complaint with respect to the above mentioned property in relation to tree
removal. An inspection by a Council Officer has confirmed there is currently an earthworks and clearing
breach on site.
Works in a Landslide Overlay requires a Development Permit for Operational Works (Earthworks).
Clearing of trees for a house pad will requires a Development Permit for Operational Works (Clearing).
Such approval has not been obtained and therefore the work is being operated/undertaken in breach of
both the Noosa Plan and the Planning Act 2016.
To resolve this matter, the following options are required:
1. Stop all earthworks;
2. Immediately stabilise the disturbed areas and install suitable sediment and erosion control
measures. The stabilisation and E&SC must be under the direction of an RPEQ;
3. Submit an Operational Works application for clearing and earthworks (both can be included in one
application). The application will need to include suitable plans and a report to address the overlay
and other site specific issues. The plans/reports must be prepared by an RPEQ.
Please take action to address this matter and confirm in writing/email your actions by close of business
27/01/2020, marked to the attention of Michael Greeff. If you do not respond to this request within this
timeframe, we will review our options to remedy this breach.
Should you have any further queries in relation to the above, please do not hesitate to contact me on the
above provided number.
Yours faithfully
Michael Greeff
