fees are charged for mixed waste.
Waste storage areas must provide for adequate separation of all reusable, recyclable
and waste materials. These must be located so that they are convenient and safe to
use.
The Plan must contain the following information:
a. The areas for the storage and separation of waste shown on a site plan;

2. SITE DETAILS
2.1. Background
Previous boat sheds
In the late 60’s the site was run by the Queensland Government as a marine biology research
facility. The fisheries patrol operation was established in the 1970’s, comprising an office and
boat shed. The site has continually been used for fisheries patrol operations since that time.
There have been a number of extensions and modifications to the original boatshed. The
boatshed was redeveloped in 1981 and an extension to the boatshed was approved in the year
2000. This boatshed was demolished in 2017. Refer to Figure 2 – Previous boat shed.

Figure 2 – Previous boat shed
New Shed construction
During mid to late 2017, the old boat shed utilised by the Department of Agriculture and Fisheries
was demolished, six trees removed (Eucalyptus and Melaleuca) and a new larger building
constructed in its place.
Section 11
PLANNING & ENVIRONMENT COMMITTEE MEETING AGENDA 9 JUNE 2020
The construction of the shed and removal of vegetation prompted a number of complaints from
residents at that time, the main issue being it’s larger size (height and footprint), and its impacts
on amenity (mainly views).
Council officers advised the Department of Housing and Public Works that the new boat shed
constituted a Material Change of Use and the removal of vegetation in the Riparian Buffer Area
required an Operational Works application. Council’s legal advice confirmed approval was also
needed, as the shed was substantially larger in scale than what previously existed. The original
shed was 4.99 metres in height, with a floor area of 136m2. The as constructed shed is 7.521
metres in height with a floor area of 183m2. The Department advised the height of the shed was
necessary to facilitate the type of boats to be stored on site.
However, at that time the Department disagreed this was the case, and instead notified Council
of its intent to commence the process for a Community Infrastructure Designation over 2 Russell
St, Noosaville and part of 4A Russell St (access to the Noosa River Holiday Park). Council
indicated its lack of support of this approach because it seemed unlikely that this would procure a
satisfactory outcome for residents, it circumvented the Noosa Plan, and could potentially create
unnecessary administrative burdens for Council in terms of process should Council chose to
redevelop the Noosa River Holiday Park. This is because historically and currently, access to the
fisheries shed is via the entrance to and through the Noosa River Holiday Park, which is an
informal arrangement between the State and Council. The Department later advised they would
not proceed with the designation, advising an application under the Noosa Plan would be
submitted (this proposal).
It is important to note, since the demolition of the shed, the use has not recommenced on site,
and the built form is not yet completed as proposed by this application. In 2018, the Department
completed a renovation of the existing smaller office building, adjoining the shed, which has seen
little noticeable change from its original built form. This office building is not subject to this
application, but is located on the same site. Refer Figure 3 – Office building.

2.2. Site Description
The Queensland Boating and Fisheries Patrol (QBFP) operate from the shed and brick patrol
building on Lot 157 SP143417 at 2 Russell Street, Noosaville. The Noosa River Holiday Park is
located adjacent to the QBFP site on Lot 4 SP143417. Refer Figure 4 – Subject site.
Figure 4 - Subject site
2.3. Surrounding Land Uses
The site is bounded by the Noosa River to the north, residences to the west and the Noosa River
Holiday Park to the east and south. The Coast Guard also located on the Noosa River, is
situated on the same land parcel as the Noosa River Holiday Park due east of the QBFP site.
This area of Noosaville is predominately characterised by 3 storey multiple dwelling units.
Gympie Terrace a short distance away is marine and recreational based, including boat hire and
water taxi/ferry stops on the water side, with residential units, shops and restaurants opposite the
Noosa River.
3. ASSESSMENT
3.1. Instruments for Statutory Assessment
Under the Planning Act 2016 the application must be assessed against each of the following
statutory planning instruments to the extent they are relevant to the development:
• State Planning Policy;
• South East Queensland Regional Plan;
• Planning Regulation 2017;
• The Noosa Plan.
Section 13
PLANNING & ENVIRONMENT COMMITTEE MEETING AGENDA 9 JUNE 2020
3.2. State and Other Statutory Instruments
State Planning Policy
The Noosa Plan is generally consistent with the State Planning Policy July 2017 (SPP).
State Planning Policy 2017 - Coastal Management District
The site is located in a Coastal Management District (CMD). A CMD is a coastal area that is
considered to need protection or management, especially with respect to the area’s vulnerability
to erosion, value in maintaining or enhancing coastal resources or for planning and development
of the area. The site is also mapped under the State Planning Policy as subject to medium and
high storm tide hazard and the erosion prone area.
The Coastal Environment State Planning Policy (SPP) recognises that some development is
coastal dependent requiring land adjoining the foreshore and access to tidal water in order to
function affectively. The SPP states:
4. Coastal-dependent development in areas adjoining tidal water is facilitated in preference to
other types of development.
5. Opportunities for public use of and access to, and along, state coastal land is maintained or
enhanced in a way that protects or enhances public safety and coastal resources.
The location of the QBFP operation is compliant with the SPP as it is a coastal dependent
development that in order to function effectively, is required to be located adjacent to the
foreshore and tidal water. The location of the QBFP provides officers and emergency services
with immediate access to the Noosa River to maintain public safety. The use has operated at its
current location since 1974 and although the building has increased in size, the proposed works
do not intensify how the site is used.
South East Queensland (SEQ) Regional Plan
The site is located within the Urban Footprint area of the SEQ Regional Plan. The proposal is
consistent with the regional policies of the SEQ Regional Plan.
Planning Regulation 2017
The following assessment benchmark from the Planning Regulation 2017 applies to the
application:
• SEQ Development Area
The proposal is for urban activity within the Urban Footprint and is consistent with the
assessment benchmarks contained in the Planning Regulation 2017 for the SEQ Region.
3.3. Statutory Instruments – Planning Scheme
The application must be assessed against the whole of the Noosa Plan to the extent the
provisions are relevant to the development, including the following Codes:
• Noosaville Locality Code
• Infrastructure Uses Code
• Natural Hazard Overlay Code - Acid Sulphate Soils and Flood
• Biodiversity Overlay Code - Riparian buffer area
• Heritage Overlay Code (Noosa River Holiday Park site only)
• Landscaping Code

Locality Provisions
The subject site is located in the Noosaville Locality and is zoned Open Space Recreation. The
proposed use is identified as an inconsistent use within the zone and is required to follow an
impact assessable application process.
The overall outcomes for the Noosaville Locality seek that new uses and works are located,
designed and managed to –
• Be compatible with other uses and works;
• Avoid significant impacts on the amenity enjoyed by users of other premise or surround
area, including acoustic and visual qualities;
• Avoid significant adverse effects on the natural environment, including native habitat
removal, fragmentations and attrition;
• Variety in the built form is emphasise through the historical development of the locality and
the many architectural styles;
• The mixed urban character of Noosaville is maintained through the retention of older
building forms and the introduction of new buildings that complement old building forms by
incorporating low rise, low scale, well-articulated buildings, lightweight building materials
and pitched roof forms that contribute to the skyline; and
• For the Open Space Recreation Zone—areas of open space contribute to the desired
lifestyle of residents by offering a variety of passive and active recreational experiences
that are conducive to community interaction and wellbeing.
The current use has been operating since the 1970’s. The QBFP Noosa patrols from Coolum
Beach in the south to Rainbow Beach in the north. QBFP boats are stored within the shed and
require immediate access to the Noosa River and the ocean beyond via an existing boat ramp
adjacent to the site. Patrols are conducted from the site to ensure compliance amongst activities
of recreational and commercial fishers. Operationally, it is crucial that there are capabilities for
fast response to any issues on the river or off shore. The site is available to other agencies such
as the Queensland Police Service, Maritime Safety and the Marine Animal Access Team for
emergency responses.
The constructed boat shed structure is not in keeping with the character of Noosaville, as it
appears bulky and has an industrial appearance. The boat shed as constructed is approximately
183m2 and 7.521 metres high at the highest point of the roof line. It has plain side walls, a
pitched roof and double dark reddish brown garage doors. This type of building is not appropriate
on Noosa River, as it is highly visible from the Noosa River Holiday Park, nearby residences and
Noosa River. Removal of vegetation has meant there is very little softening of the built form.
These concerns were conveyed to the State at the time of construction of the shed.
The Department undertook a visual impact analysis of the new boat shed (March 2018) and
indicated a willingness to look at some improvements to the constructed boat shed as well as
undertake some improvements (including a reduction in floor area) to the adjacent existing office
building. The analysis also identified the need for some planting that will offset the loss of the
original planting (particularly south west part of the land and between the shed and foreshore
park/ Noosa River Holiday Park) and to soften the views of the shed from Russell Street and
Noosa River Holiday Park users.
The applicant has since worked with a local architect to improve the design of the constructed
boat shed as submitted with this application. The plans indicate the shed is better articulated than
previously constructed, using a combination of lightweight materials and skillion style roof form
that maintains the mixed urban character of what is typical in Noosaville. The revised roof form is
more of a domestic scale and contributes more positively to the surrounding environment. The
modified appearance will also better integrate with the existing office building which has been
recently renovated.
Section 15
PLANNING & ENVIRONMENT COMMITTEE MEETING AGENDA 9 JUNE 2020
The proposal revises the as constructed design to reduce the overall height from the existing
pitch roof ridgeline of RL 7.521 metres to RL 6.223m relative to natural ground level by removing
parts of the existing roof and lowering it to form a simpler, lower profile skillion roof. The resultant
differential height between the previous shed and the proposed shed is 1.233 metres. The
proposal also includes:
• new vertical timber cladding (dark grey timber finish) around shed (including horizontal
battens up to the height of the roof on western and eastern elevations);
• a new colour palette to minimise reflectivity and assist the building to recede into the
environment;
• upgrades to the office building for design and colour palette to unify the office and shed
buildings;
• landscaping design proposal to soften the building design; and
• newly constructed 1.8m high black galvanised fence on the eastern side of the QBFP
building.
The proposed modified boatshed will still be visible from the nearby residential development.
However, it is less dominating within the local area, due to the proposed reduction in height,
change in roof line, use of natural colours and finishes (including timber) and landscaping to
screen and soften the built form. This design is considered appropriate and is in keeping with the
Noosaville river side urban character.
Access (Noosa River Holiday Park)
The boatshed adjoins and gains access through the Noosa River Caravan Park located at Lot
131 SP143417 which is identified as a Queensland Heritage Place (place id 602706). The
boatshed has relied on the Caravan Park for site access for many years. Refer to Figure 5 –
general access area through over Noosa River Holiday Park land.
Figure 5 – general access area through over Noosa River Holiday Park land
Page 15 of 55
Section 16
PLANNING & ENVIRONMENT COMMITTEE MEETING AGENDA 9 JUNE 2020
The official designation for the reservation for recreation and camping for the Noosa River
Holiday Park (Russell Park) occurred in 1956. The land and amenities have been improved over
time on this site. Historically there has been realignment to the boundaries between the fisheries
patrol operation site and the Noosa River Holiday Park site. Access to the fisheries operation
through the Noosa River Holiday Park has occurred since inception of the fisheries land use. The
application seeks retrospective approval of a building and as such, the design and layout
continues to rely on access via the Noosa River Holiday Park.
Access through the Noosa River Holiday Park is to continue informally to maintain flexibility for
the Noosa River Holiday Park. The QBFP Operational plan indicates that 2 QBFP vehicles
access the site for operational purposes and 2 staff utilise on street parking in Russell Street.
There have been instances whereby QBFP operational vehicles have conflicted with the entry to
the Noosa River Holiday Park. To overcome this, Council’s property area have recommended a
condition be included that there is to be no parking on the driveway within the adjacent Noosa
River Holiday Park site.
Staff who drive to the site in private vehicles utilise street parking in Russell Street or in car parks
shown in Figure 6 – Parking, which are part of the Noosa River Holiday Park land. This is
considered acceptable as it is reflective of previous arrangements and there will generally be
approximately two private staff vehicles utilising car spaces at any one time, although it may vary.
It has been observed there is plenty of parking on Russell Street, even at peak holiday times.
Figure 6 – Parking
Heritage
The proposed works on Lot 157 adjoin the Noosa River Holiday Park site (Lot 131) which is a
designated state heritage place under the Queensland Heritage Act 1992. The Noosa River
Holiday Park was developed in 1929 and State heritage listed in 2009 in order to conserve its
cultural heritage for the benefit of the community and future generations. The State Heritage
register recognises this site as important in that it demonstrates the evolution of public camping
and recreation activities in a prime waterfront location. The Noosa River Caravan Park illustrates
the policy of colonial governments of reserving Crown land for public camping and recreation
purposes in prime waterside areas, a practice which was common, but is now rare.
As discussed previously, the QBFP shed is accessed by vehicles through the Noosa River
Holiday Park. The access and this proposal does not impact on the cultural heritage significance
of the Noosa River Holiday Park, as the access arrangements are to continue as they have in the
past.
Section 17
PLANNING & ENVIRONMENT COMMITTEE MEETING AGENDA 9 JUNE 2020
Flood
The site is located on the Noosa River and is subject to Council flood overlay mapping, and tidal
surge. The site is in the flood hazard area (1% AEP to year 2100) under Noosa Plan’s Natural
Hazard: Landslide and Flooding Hazard Overlay.
The site is protected by a sea wall at the boundary of the site adjacent to the tidal waterway. Due
to the nature of the boatshed use, which is dependent on its location adjacent to tidal water, it is
therefore not possible to avoid the natural flood hazard area.
It is noted that the boat shed is not a habitable structure and the finished floor level of the
constructed shed is approximately 150mm higher than the former boat shed.
Biodiversity – Riparian Buffer
The site is located in the Riparian buffer area as identified on the Biodiversity Overlay map. This
also affects the adjoining Noosa River Holiday Park. Refer Figure 7 – Riparian Buffer area.
Specific outcome O5 of the Overlay Code seeks that development is managed so as to avoid, or
where avoidance is not practicable, minimises or mitigates the impacts upon the Shire’s
biodiversity values and natural resources and that new development in the riparian buffer area is
avoided. Probable Solution S5.1 recognises that infrastructure maybe necessary to provide
access to a watercourse for recreational purposes. QBFP staff and emergency services are
dependent on immediate access to the Noosa River to maintain public safety, both for
recreational and commercial purposes and the proposal facilitates this.
The Code also seeks that vegetation be retained and conserved in its present form or improved
in order to contribute to the biological diversity of Noosa Shire. Some vegetation removal has
previously occurred on site for site maintenance, and to facilitate the new boat shed. The
proposal will provide for new landscaping as discussed further below.
Figure 7 – Riparian Buffer area
Landscaping
Existing vegetation on the subject land and adjoining land includes some shrubs, a Callistemon
sp., a Cocos palm, and two large Cottonwood trees (Hibiscus tiliaceus) framing the entrance to
the boatshed. Some trees were removed from the subject land in early 2017 as part of building
works reportedly due to structural damage to the existing office building, including two large
Paperbark trees, a large Eucalypt, and a smaller Eucalypt near the water. Two large trees in on
Page 17 of 55
Section 18
PLANNING & ENVIRONMENT COMMITTEE MEETING AGENDA 9 JUNE 2020
the southern side of the building on the Noosa River Holiday Park land have also been removed
by Council, as they posed a risk. The existing Cocos palm in the south-western corner of the site
is nominated for retention.
The landscape concept plan has been provided and proposes tall screening trees to both soften
the building, and offset the loss of the removed vegetation. The applicant proposes low hedging
along most boundary fences interspersed with small to medium trees up to 6 - 7m height (based
on the height of the boatshed) using species suitable for the river foreshore selected from the
Noosa Planning Scheme Policy.
Community Consultation by the Applicant
Prior to submitting the application, the applicant conducted some targeted community
consultation in April and August 2019. This involved a mail out to 45 local residents (Russell
Street and Munna Crescent) inviting community members to meet with the applicant’s project
team to discuss. It provided the applicant with the opportunity to understand community
concerns regarding the development of the boat shed and accept feedback which resulted in
design changes, in particular the building materials, building height and landscaping.
Following this engagement, options were explored to decrease the overall height of the building
by 1.2 metres, introduce a panel lift door (in place of a roller door) and replace the pitched roof
with a skillion style roof.
The applicant sought advice from Noel Robinson Architecture to assist in the evolution in design,
which is shown in the proposal plans.
Letters from the applicant were then sent to residents in October 2019 providing an overview of
the feedback received, an update on the design process and timeframes for the lodgement of the
development application. An additional letter was also sent by the applicant to residents when the
development application was lodged with Council to advise residents about viewing application
material and the further opportunity to comment on the formal public notification process.
4. DRAFT PLANNING SCHEME
The draft Noosa Plan has rezoned the QBFP land from Open Space Recreation to Community
Facilities, annotating it as ‘Marine Industry (Slipway)’. This change in zoning recognises the
existing use on site.
The overall outcomes of the Community Facilities zone are:
a) The Community Facilities zone primarily accommodates a variety of community related
activities and infrastructure, as well as certain special residential and recreation uses to meet the
current and future needs of the community; and
b) Development provides for the continued use of community land for the specific purpose
annotated on the zone map, and where the use is no longer meeting a community need, is
replaced with another community related activity.
The use is consistent with this zone and the proposal is generally consistent with the Overall
outcomes for the Noosaville Local Plan and the draft Noosa Plan in general.
5. CONSULTATION
5.1. Referral Agencies
The application was referred to the Department of Infrastructure, Local Government and Planning
(SARA).
The Department is a referral agency for Material change of use applications for those sites
adjoining a Queensland heritage place.
The Department has responded with 2 conditions that require development to be in accordance
with the relevant plans and for the applicant to provide them with written notice of (re)
commencement of the Service and Utility – Type 1 Depot use.

5.2. Other Referrals
The application was forwarded to the following internal Council officers:
• Environment Officer, Development Assessment
• Engineering Officer, Development Assessment
• Property Advisor, Corporate Services
5.3. Public Notification
The application was publicly notified for 15 business days in accordance with the Planning Act
2016. No properly made submissions were received.
6. CONCLUSION & REASONS FOR DECISION
The proposed built form utilises a combination of lightweight materials and a skillion style roof
form that maintains the mixed urban character of what is typical in Noosaville, which is especially
important on Noosa River. The proposal represents a contemporary adaptation of surrounding
residential building character, which is appropriate to the location and improves the current
amenity and appearance of the site. New native established vegetation planting is proposed that
is fast growing and suitable for the Noosa River foreshore which will assist to soften the built
form.
The site plays a key role in protecting the ecological value of the Noosa River and ensures
sustainable and safe use of waterways and fishery resources. Despite the use being inconsistent
with the Open Space Recreation zone, the proposal upgrades facilities that are dependent on
direct access to the Noosa River in order to maintain public safety. Further, although the shed
has increased in size, the proposed works do not intensify the existing operation, within the
coastal management district and riparian buffer area.
The proposal is therefore recommended for approval, including reasonable and relevant
conditions.

REPORT
1. PROPOSAL
The applicant seeks approval to change an existing development approval for a Material Change
of Use of Premises for a Retail Business Type 5 - Vehicle uses, Retail Business Type 2 – Shop,
and Entertainment & Dining Business - Type 1 - Food & beverages, approved on 10 January
2017. The applicant is seeking an increase of 17.13m2 to the current use area approved for
Entertainment & Dining Business - Type 1 - Food & Beverages, trading as Ricks Bakery.
The application material states:
The proposed extension will support additional preparation benches to make Ricks renowned
pies. At present the business has four (4) staff working on one (1) bench preparing and making
pies, breads and pastries. The proposed 17.3m2 extension will allow for a more efficient working
environment, allowing the pies, breads and pastries to be prepared and made with the same staff
numbers but on separate benches. The extension is strictly an extension of the kitchen space
which is currently constrained.

2. BACKGROUND
A development approval for Retail Business Type 5 – Vehicle uses, Retail Business Type 2 –
Shop, and Entertainment & Dining Business – Type 1 – Food & Beverages was issued on 12
January 2017. An Entertainment & Dining Business - Type 1 - Food & Beverages use is an
impact inconsistent use within the Industry Zone under the Noosa Plan. The original application
was approved, despite conflicting with the planning scheme, as the food outlet was replacing an
existing lunch bar located on the site, and it was considered the food outlet would continue to
service surrounding workers and the travelling public without negatively impacting on surrounding
uses.
Section 24
PLANNING & ENVIRONMENT COMMITTEE MEETING AGENDA 9 JUNE 2020
Subsequent changes have been approved to the original approval, including:
• A Generally in Accordance letter was issued on 15 March 2017 approving a minor
alteration to the roof design (slope) of the main building (MCU16/0084.01);
• A Permissible Change to the development approval was approved on 5 May 2017, deleting
conditions relating to stormwater treatment and targets which were incorrectly conditioned
(MCU16/0084.02); and
• A Minor Change to the development approval was approved on 24 October 2017, deleting
a condition relating to the design of the canopy over the fuel dispensing area
(MCU16/0084.03).
3. ASSESSMENT
3.1. Instruments for Statutory Assessment
Under the Planning Act 2016 the application must be assessed against each of the following
statutory planning instruments to the extent they are relevant to the development:
• State Planning Policy;
• South East Queensland Regional Plan;
• Planning Regulation 2017;
• The Noosa Plan.
The following codes from the Noosa Plan are applicable to this development:
• Noosaville Locality Code;
• Business Uses Code;
• Engineering Works Codes.
3.2. Statutory Process
The applicant has requested to make a minor change to a development approval under s78 of
the Planning Act 2016. An application for a minor change to a development approval can only be
made in circumstances where a change would constitute a ‘minor change’.
The proposed change to the development approval requested by the applicant is determined to
constitute a minor change on the grounds that:
• the development would not result in substantially different development as the addition of
17.13m2 to the rear of the building within an existing roofed void area would not
dramatically change the built form in terms of scale, bulk and appearance;
• the change does not include prohibited development;
• the change would not require the application to be referred to an additional referral agency
or cause a referral agency to have regard to new matters prescribed by regulation;
• where the original application was code assessable, the change would not cause the
application to become impact assessable.
3.3. Statutory Instruments – Planning Scheme
The subject site is located within the Industry Zone. An Entertainment & Dining Business - Type 1
- Food & Beverages use is an impact inconsistent use within this zone under the Noosa Plan.
Condition 2 and Condition 4
2. Development undertaken in accordance with this approval must generally comply with the
approved plans of development. The approved plans are listed in the following table unless
otherwise amended by these conditions.

Council
4. The approved Use Area of the Entertainment and Dining Business is 90m².
Applicant’s Request
The applicant is requesting to change the existing approval, stating:
The minor change proposes a material increase of 17.13m2 GFA to the current floor area
approved for Entertainment & Dining Business - Type 1 - Food & Beverages, trading as
Ricks Bakery. The extension is proposed at the rear of the current tenancy for additional
back of house preparation area for the bakery. No further changes to the current layout are
proposed as a result of this extension.
The applicant provided the following commentary in regards to the operation of the business:
‘…they do not wholesale, nor do they intend to. They don’t expect production to increase
due to the small increase in floor area, it literally just allows them to spread out more as
they are currently working on-top of each other. Increase in production is inevitable
depending on the time of year and external factors but that occurs for their business
anyway, no different to how it has operated since they were established.’
Changing the existing approval to allow for the additional use area would require a change to
Conditions 2 and 4.
Assessment of Request
Built Form and Use
The subject site is located within the Industry Zone. An Entertainment & Dining Business - Type 1
- Food & Beverages use is an impact inconsistent use within this zone under the Noosa Plan. An
Entertainment & Dining Business - Type 1 - Food & Beverages use is generally more
appropriately accommodated in commercial zones (eg. Neighbourhood Centre, Business Centre,
Visitor Mixed Use etc). However the original development application was approved as:
• a food outlet is a commonly expected component of a contemporary service station
development,
• it was replacing an existing lunch bar located on the site, and
• it was considered the food outlet would continue to service surrounding workers and the
travelling public without negatively impacting on surrounding uses.
The proposed extension is located within an existing roofed void area to the rear of the property
and, as such, won’t be visible from the front of the building, complies with setback and height
requirements and won’t increase the existing footprint of the building (refer to Figure 5). The built
form of the proposal does not raise any concerns.
Section 26
PLANNING & ENVIRONMENT COMMITTEE MEETING AGENDA 9 JUNE 2020
Figure 5: Extension to be located to rear of building
The existing tenant, Rick’s Bakery, has been operating on the site since 2017, and has been
located and managed to be compatible with other uses on and in proximity to the site. Council
has not received any complaints or feedback in relation to any adverse impacts on existing
industrial uses or food outlets in proximity to the bakery. As the proposed extension is for an
existing use, it will not reduce the existing amount of Industry zoned land available for
development for industrial purposes.
The bakery trades in retail sales only and does not produce wholesale goods. The applicant
proposes the extension for the purposes of providing a more efficient work space for the ‘back of
house’ area of the bakery. As such, the proposal is relatively minor and is unlikely to adversely
affect other food outlets or industrial uses within the nearby industrial area and retail centre.
Noosa Shire currently has only one other approved Entertainment & Dining Business - Type 1 -
Food & Beverages attached to a service station development, being the KFC at 143 Eumundi
Noosa Road, directly opposite the subject site and approved 24 September 2015. The KFC has a
Gross Floor Area of 151m², a drive-thru facility, and operates from 10am to 10pm daily.
Car Parking
The original development application and approval provided the required number of carparks for
the uses on site, which included nine spaces for the Entertainment & Dining Business - Type 1 -
Food & Beverages component of the development. The minor change application does not
trigger the requirement for additional carparking under the planning scheme, as the Driveways
and Carparking Code excludes kitchen and food storage areas in the carparking calculation.
4. DRAFT PLANNING SCHEME
The subject site is located within the Medium Impact Industry Zone under The New Noosa Plan.
Development within the Medium Impact Industry Zone is proposed to provide for medium impact
industry and other uses and activities that support industry activities and do not compromise the
future use of premises for industry activities. The zone aims to avoid the development of
incompatible uses, or uses which are more appropriately located in other zones in order to
protect land for industry activities
A food and drink outlet in excess of 60m2 in this zone is impact and inconsistent under the draft
scheme. The draft scheme encourages food and drink outlets only where directly ancillary to and
associated with a bondafide industry use on the site, whilst ‘complementary’ food and drink
outlets (i.e. standalone businesses not trading in goods produced onsite) are not supported in the
Medium Industry Zone. In addition, Service Stations are also impact and inconsistent under the
Page 26 of 55
Section 27
PLANNING & ENVIRONMENT COMMITTEE MEETING AGENDA 9 JUNE 2020
draft scheme, and as such, the original development application would likely not have been
supported, unless the applicant was able to demonstrate a need for an additional service station
in this locality.
5. CONSULTATION
5.1. Referral Agencies
Not applicable.
5.2. Other Referrals
Not applicable.
6. CONCLUSION & REASONS FOR DECISION
The minor change to increase the use area of the premise is proposed to allow a more efficient
workspace for existing employees and the applicant does not intend to increase production for
retail sales. While the proposed use is not consistent with the intended industrial uses for the site,
the proposal is considered a relatively minor extension, remains consistent with the floor area of
other approved café/restaurant uses operating in association with service stations along Eumundi
Noosa Road and does not impact on the land available for industrial uses.

EXECUTIVE SUMMARY
Not Applicable
RECOMMENDATION
That Council note the report by the Manager Development Assessment to the Planning &
Environment Committee Meeting dated 9 June 2020 regarding Planning & Environment Court
Appeal No. 1219 of 2020 and agree to defend the appeal.
REPORT
On 19 March 2020, Council, at its Ordinary meeting resolved to refuse an application for:
• Material Change of Use 14 dwellings units in the form of:
o 2 x Detached Houses; and
o 12 x Multiple Housing Units.
• Reconfiguring of 1 lot into 4 lots plus an access easement as follows:
o Lot 1 – 7,507m² for 12 detached Multiple Housing Units;
o Lot 2 – 1,050m² for 1 Detached House;
o Lot 3 – 950m² for 1 Detached House;
o Lot 4 – 8,543m2 proposed to be dedicated to Council as conservation park; and
o An access easement to provide access to proposed Lot 2 though Lot 1.
The application was refused for the following reasons:
1. The proposed development is contrary to the Noosa Plan’s Strategic Framework and the
Desired Environmental Outcomes as
(i) The proposal does not satisfactorily protect the site’s significant environment values.
(ii) The proposal does not maintain a satisfactory wildlife corridor through the site and
intrudes into the riparian buffer to the site’s watercourse.
2. The proposed development is contrary to the Overall and Specific Outcomes of the Noosa
Heads Locality Code as
(i) The proposed uses are inconsistent with and therefore strongly inappropriate in the
Open Space Conservation Zone.
Section 37
PLANNING & ENVIRONMENT COMMITTEE MEETING AGENDA 9 JUNE 2020
(ii) The applicant has not satisfactorily demonstrated the proposed development footprint
is commensurate with the site’s constraints and values.
(iii) The proposal will adversely impact on the sites and the adjoining road reserve’s
scenic and environmental values.
(iv) The proposed built form will adversely impact on the visual amenity of nearby
properties in Attunga Heights.
(v) The proposed development does not respect the scale and character of the
surrounding development.
3. The proposed development is contrary to the Specific Outcomes of the Noosa Heads
Locality Code for population density, gross floor area, site cover, building height and
setbacks.
4. The proposed development is contrary to the Biodiversity Overlay Code as the proposal
does not satisfactorily manage, minimise or mitigate its impacts on the site’s ecologically
important areas, ecological linkages for the koala population and the site’s watercourse
with the development resulting in excessive clearing of protected vegetation.
5. The proposed subdivision is contrary to the Reconfiguring a Lot Code as:
(i) The proposed lots and lot boundaries fragment the site’s wildlife corridor and the
riparian buffer to the site’s watercourse.
(ii) The proposal is to subdivide land in the Open Space Conservation zone.
(iii) The applicant has not demonstrated appropriate access for Lot 3 for construction
purposes is available or achievable.
(iv) The proposed parkland lot, Lot 4, includes part of the bushfire protection zone for the
multiple dwelling units and steep slopes which will require ongoing monitoring and
future management, inappropriately burdening Council’s resources.
6. The proposed development has not been designed to avoid any potential instability and
associated problems and seeks to clear excessive vegetation that assists in stabilising the
site and the development in the long term contrary to the Natural Hazards Overlay Code
and Reconfiguration of Lot Code.
7. The proposed development will adversely impact on the vegetated character of the
adjoining pedestrian path in Edgar Bennett Avenue road reserve enjoyed by residents and
visitors to the area due to the scale and extent of development proposed along this
boundary and limited landscape opportunities to screen the development. The proposed
works for the driveway and associated retaining walls are also likely to adversely impact on
the vegetation within the road reserve and result in the removal of some existing mature
vegetation.
8. The proposed stormwater management strategies for water quality for the multiple housing
development on lot 1 conflict with the Water Sensitive Design Code, which requires natural
treatment strategies and systems and are contrary to the Reconfiguration of Lot Code.
9. The proposed proprietary device has not been accepted by Stormwater Australia as a
satisfactory water quality treatment system for this area. Therefore, the proposed
development may adversely impact on the downstream ecosystem due to changes in water
quality.
10. The proposed development is contrary to the draft Noosa Plan provisions which are more
protective of the site’s environment values and consequently more restrictive of
development.
11. The application attracted a considerable number of public submissions raising valid
grounds of objection to the development.
Section 38
PLANNING & ENVIRONMENT COMMITTEE MEETING AGENDA 9 JUNE 2020
12. The proposed development is contrary to Schedule 10 Division 3 of the Planning
Regulation 2017 as the development is situated in a koala assessable development area
and does not avoid, minimise or mitigate interfering with koala habitat or propose a
satisfactory offset to address any significant residual impact.
13. The proposal is contrary to the State Planning Policy as the proposed development will
adversely impact on koala habitat, with koala populations recognised as being matters of
both national and state environmental significance.
A report on this application was originally presented to the Planning & Environment Committee
Meeting on 11 June 2019 and subsequently referred to the General Committee on 17 June 2019
due to the significance of the application. On 13 June the applicant stopped the decision making
period for 130 business days to allow representations to be made by the applicant to Council
officers regarding the application.
On 23 October 2019 an email with an attached letter was received from the applicant, with the
letter raising a number of questions relating to the application and requesting a meeting with
Council officers.
On 13 November 2019 a meeting was held between Council officers and the applicant to review
the issues raised in the letter. At this meeting Council officers reiterated the issues associated
with the grounds of refusal recommended by officers. At the conclusion of the meeting the
applicant advised that they would discuss these concerns with the property owner and seek
direction on providing amended plans.
After a number of follow up calls and emails by Council officers seeking advice on the applicant’s
intention with the application, the applicant advised on 4 March 2020 that they would not be
submitting further information and would like the application decided in its current form.
Accordingly the matter was reported to Council’s General Committee meeting on 16 March 2020,
with the application decided at the Ordinary meeting in March 2020.
Refer to Council’s Planning & Environment Committee Agenda, 11 June 2019, Item 4, page 60
for a full copy of the assessment report (https://www.noosa.qld.gov.au/downloads/file/623/2019-
06-11-planning-environment-committee-agenda-pdf)
An extract from the executive summary of the officer report to Council in June 2019 is provided
below for Council’s reference:
The site is characterised as containing significant environmental values with the site’s vegetation
identified as Environmental Protection by the Noosa Plan’s Biodiversity Overlay and of concern
regional ecosystem by the Vegetation Management Act. The site includes an important wildlife
corridor linking vegetation from Settlers Cover/Noosa Inlet through to Peppers Resort and the
Noosa National Park. A watercourse further traverses the site, which flows into the Noosa River.
The site contains sandy soils and has steep slopes, with slopes varying between 20o and 45o and
a history of a least one known land slippage. Edgar Bennett road reserve runs parallel to the
site’s western boundary with a public pathway constructed in this road reserve. Peppers Resort is
located on the site’s eastern boundary.
A previous development application for 30 multiple dwelling units and 12 accommodation units
for the site was approved by Council in 2005. This application was subsequently ‘called in’ by the
Minister due to the site’s wildlife corridor and in March 2006, the approval was amended by the
Minister to preserve a 50m wildlife corridor through the site. This approval has now lapsed.
The Noosa Plan zones approximately 1.35ha of the site as Open Space Conservation, with 2
small areas zoned Detached Housing and an area adjacent Peppers Resort zoned Attached
Housing. The proposed development extends significantly into the areas zoned Open Space
Conservation and outside the area’s zoned for development. The applicant submits that there is
good reason for this and being guided by comprehensive site-specific technical reports, the
development has been located on less constrained land offering significant benefits.
Section 39
PLANNING & ENVIRONMENT COMMITTEE MEETING AGENDA 9 JUNE 2020
The applicant’s submission is agreed with to a limited extent as the proposed development is
located in part in an area that contains more moderate slopes, and which is currently infested by
weeds. This layout has for the most part also removed the need to construct a bridge across the
site’s waterway as was proposed in the previous development approval. The proposed multiple
dwelling units have also been desirably designed as individual buildings stepping down the slope
set on posts, rather than combining the units into one larger building with a basement car park
and requiring significant earthworks as previously approved.
Notwithstanding this, the proposal extends approximately three quarters along the site’s western
boundary into steeper slopes and more intact vegetation. The proposed extent and layout of the
development in this area also impacts on the visual amenity and vegetation within Edgar Bennett
road reserve (public pathway) as the proposal includes limited setbacks and opportunities for
landscaping and significant earthworks are proposed for the driveway with up to 2m high
retaining walls required on the boundary. A number of the proposed multiple dwelling units,
including units 1, 2, 11 and 12 at either end will also be highly prominent being 3 storeys and
setback 2m from this road reserve boundary in places. Notably multiple dwelling units 3 – 10 will
predominantly present as 1-2 storeys with the lower levels unlikely to be visible from the
pathway.
The proposed site layout does not maintain a sufficient wildlife corridor through the site,
inappropriately reliant on the adjoining Peppers Resort land, which includes the main resort
driveway and retaining walls, narrowing the corridor to approximately 23m in part. Construction
access for proposed lot 3 may also adversely impact on this corridor as the current access
easement terms do not support access for construction via Peppers Resort. The proposed lots
and lot boundaries also fragment this wildlife corridor and intrude into the riparian buffer to the
site’s watercourse with insufficient building setbacks proposed.
The proposed conservation park lot, lot 4, also includes part of the bushfire protection zone for
the multiple dwelling units and given the potential for further land slips and the consequential
impacts on the uphill units that may arise, this lot would require ongoing regular monitoring and
future management. This would inappropriately burden Council resources and therefore
dedication of lot 4 to Council as conservation park is not recommended, notwithstanding its
desirable environmental values.
The proposal further substantially exceeds the Noosa Plan provisions pertaining to site density,
building height, gross floor area, site cover and boundary setbacks and while some increased
building height may be warranted on the site due to the site’s slope, the proposed building height
is excessive in places and is not all in keeping with the surrounding built form. The proposed
building height and reduced setbacks will also adversely impact on nearby resident’s visual
amenity and the treed public pathway enjoyed by residents and visitors to the area.
A review of the application against the draft new Noosa Plan provisions concludes that the
proposed development would conflict with the draft outcomes sought. The draft Noosa Plan does
identify some medium density development area directly off Attunga Heights. However, the
proposed development exceeds this potential development area identified by the draft Noosa
Plan, with the draft scheme reinforcing the current planning scheme requirements to protect the
site’s environmental values.
On this basis, the development as proposed is considered to not meet a substantial number of
outcomes sought by the Noosa Plan, and as such the development is considered an
inappropriate development impacting on the site’s environmental values and is recommended for
refusal.
As a result of Council’s decision to refuse the proposed development, the applicant has lodged
an appeal to the Planning & Environment Court. The applicant seeks that the development
should be approved with reasonable and relevant conditions. Notably a number of submitters
have elected to join the appeal as co-respondents.
It is in order for Council to defend the appeal and the recommendation is worded accordingly.

PLANNING & ENVIRONMENT COMMITTEE MEETING AGENDA 9 JUNE 2020
Previous Council Consideration
Ordinary Meeting, 19 March 2020, Item 4, Page 10
That Council note the report by the Contract Planner to the Planning & Environment Committee
Meeting dated 11 June 2019 and the Further Report to the General Committee Meeting dated 16
March 2020 regarding Application No. MCU18/0015 for a Development Permit for Material
Change of Use (2 Detached Houses and Multiple Housing – type 4 Conventional – 12 Units) and
Reconfiguring a Lot (1 into 4 lots plus Access Easement) situated at 27 Attunga Heights, Noosa
Heads and:
Section 41
PLANNING & ENVIRONMENT COMMITTEE MEETING AGENDA 9 JUNE 2020

RECOMMENDATION
That Council note the report by the Manager Development Assessment to the Planning &
Environment Committee Meeting dated 9 June 2020 regarding Planning & Environment Court
Appeal No. D63 of 2020 and agree to defend the appeal.
REPORT
On 19 March 2020, an application to change a development approval for Operational Works for a
Jetty at 60 The Peninsula, Noosaville was refused under delegation for the following reasons:
1. The proposed changes are contrary to Specific Outcome O11 and Overall Outcome a) of
the Watercourses Works Code as:
a. The white finish, thickness of material and overall design of the structure is obtrusive
on the open watercourse and landscaped surroundings and does not blend with the
surroundings;
b. The structure presents unnecessary and avoidable cluttering of the watercourse;
c. The structure is inconsistent with the open character and amenity of the watercourse
and other structures on the waterway; and
d. The proposed handrail is inconsistent with handrails for jetties in Noosa Waters,
which are of an open style handrail consisting of evenly spaced vertical posts and a
single horizontal rail, with no decorative infills.
The original development approval for the jetty included the following condition:
4. The proposed ‘hamptons style’ handrail is not approved. The handrail for the jetty must be
an open style handrail consisting of evenly spaced vertical posts and a single horizontal
rail.
The approved plans for the jetty were also annotated to specify that the handrail must be in
accordance with the conditions of approval.
Despite the development approval, the owner constructed the jetty handrail in accordance with
their original plans, with a ‘hamptons style’ handrail provided to the jetty.
On inspection of the jetty by officers, the owner was advised of the non-compliance who elected
to lodge an application to change the development approval for the jetty.
Officers noted the following in their assessment:
Section 43
PLANNING & ENVIRONMENT COMMITTEE MEETING AGENDA 9 JUNE 2020
“Any infill of the hand rails is inconsistent with the Watercourse Works Code. Any works in the
Noosa Waters canal should ‘reflect the character and setting of the work’s immediate surrounds
or locality’ (O11 of the Watercourse Works Code).
A site inspection revealed that the all handrails in the vicinity of the site (and generally in Noosa
Waters) consist of vertical posts and a horizontal rail with no decorative infills. This simplistic
design ensures that the jetties remain as operational low key structures and do not become a
feature in the Noosa Water’s canal system, or an extension of a dwellings recreational space.
There is a risk that embellishing handrails in Noosa Waters may lead to visual ‘cluttering’ of the
watercourse.”
As a result of Council’s decision to refuse the proposed change, the applicant has lodged an
appeal to the Planning & Environment Court. The applicant seeks that the change application be
approved.
It is in order for Council to defend the appeal and the recommendation is worded accordingly.

RECOMMENDATION
That Council note the report by the Manager Development Assessment to the Planning &
Environment Committee Meeting dated 9 June 2020 regarding Planning & Environment Court
Appeal No. D67 of 2020 and agree to defend the appeal.
REPORT
On 19 March 2020, Council, at its Ordinary meeting resolved to refuse an application for a bar to
operate in association with an approved distillery industrial business at 5 Taylor Court for the
following reasons:
1. The proposed Entertainment & Dining Business – Type 3 Bar use is identified as an
inconsistent use in the Industry Zone of the Cooroy & Lake Macdonald Locality.
2. The proposed site is not suitable for the commercial use being located outside of the
Cooroy business centre, in an isolated location, with no pedestrian connectivity or
accessibility to public transport for patrons to the bar contrary to Specific Outcomes O30
and O31 and Overall Outcomes d) and f) of the Business Uses Code.
3. The proposal is contrary to Overall Outcomes 6.7.2 a)i , iii and pp) i of the Cooroy & Lake
Macdonald Locality as the proposed bar:
3.1. will potentially undermine the intended use of the land in Taylor Court for industrial
uses to the exclusion of inconsistent uses; and
3.2. conflicts with the approved industrial uses on the site and hinder industrial uses
operations.
4. The proposal is contrary to Overall Outcomes 14.110.2 c) and d) and Specific Outcome O7
of the Driveways and Parking Code as the applicant has not satisfactorily demonstrated
that there is sufficient car parking on site for the proposed use, with limited opportunities for
street car parking.
5. The proposed use is specifically identified as an inconsistent use on the site under the draft
planning scheme as industrial land in Taylor Court is intended to be used for industrial
functions only to the exclusion of retail and commercial uses.
6. There are no discretionary matters which would warrant approval of the development
proposal.
7. For the aforesaid reasons, approval of the development proposal would not advance the
purpose of the Planning Act 2016.
The proposed bar has an area of 55m2 and is proposed to operate 3pm to midnight on Fridays
and 12pm to midnight on Saturday and Sundays. The proposed distillery (177m2) was previously
Page 45 of 55
Section 46
PLANNING & ENVIRONMENT COMMITTEE MEETING AGENDA 9 JUNE 2020
approved to operate from the site under another development approval granted for 39 industrial
tenancies in November 2018.
The proposed bar is separately defined by the planning scheme and while may be
complementary to the proposed distillery, requires a separate approval from Council and is
contrary to the provisions of The Noosa Plan.
The proposed bar is identified as an inconsistent use for the site, is not well located being
isolated from the township and urban areas of Cooroy with no footpath and public transport
opportunities for patrons. The proposed bar also has the potential to conflict with the approved
industrial uses on the site, impact on their ability to operate the industrial uses approved for the
site and erode one of the remaining key industrial estates in Noosa Shire.
The proposed bar is more appropriately located within a tenancy readily found in Cooroy’s
Business Centre Zone or within the new Venture Drive Enterprise and Gateway West Makers
precincts proposed by draft planning scheme.
Alternatively to support the distillery operations the applicant has the option to establish a small
ancillary tasting area within the distillery. This would permit the applicant to offer tastings to
customers and for the distillery to be frequented by distillery tour patrons. Customers after
sampling would also be able to purchase bottled liquor to takeaway. It would though not permit
the sale of beverages or food for consumption on site.
Refer to Council’s Planning & Environment Committee Agenda, 10 March 2020, Item 1, page 3
for a full copy of the assessment report (https://www.noosa.qld.gov.au/downloads/file/2103/2020-

As a result of Council’s decision to refuse the proposed development, the applicant has lodged
an appeal to the Planning & Environment Court. The applicant seeks that the development
should be approved with reasonable and relevant conditions.
It is in order for Council to defend the appeal and the recommendation is worded accordingly.

situated at 5 Taylor Ct Cooroy and:
A. Refuse the application for the following reasons:
1. The proposed Entertainment & Dining Business – Type 3 Bar use is identified as an
inconsistent use in the Industry Zone of the Cooroy & Lake Macdonald Locality.
1. The proposed site is not suitable for the commercial use being located outside of the

2.2. conflicts with the approved industrial uses on the site and hinder industrial uses
operations.
3. The proposal is contrary to Overall Outcomes 14.110.2 c) and d) and Specific
Outcome O7 of the Driveways and Parking Code as the applicant has not
satisfactorily demonstrated that there is sufficient car parking on site for the proposed
use, with limited opportunities for street car parking.

RECOMMENDATION
That Council note the report by the Pest and Contracts Officer to the Planning & Environment
Committee Meeting dated 9 June 2020 and approve the following Biosecurity Surveillance
Program for the Noosa Council region in accordance with section 235 of the Biosecurity Act
2014:
A. Survey Area 1: 1 July to 30 September each year until the end of 2024, for the localities of
Cooroy, Cooroy Mountain, Tinbeerwah, Cooroibah and that part of Doonan that is within
the Noosa Council boundary;
B. Survey Area 2: 1 October to 31 December each year until the end of 2024, for the
localities of Black Mountain, Federal, and those parts of Ridgewood and Eerwah Vale that
are within the Noosa Council boundary;
C. Survey Area 3: 1 January to 31 March each year until the end of 2024, for the localities of
Kin Kin, Pinbarren, Cooran and that part of Como that is within the Noosa Council
boundary; and
D. Survey Area 4: 1 April to 30 June each year until the end 2024, for the localities of
Cootharaba and Boreen Point.
REPORT
Background
Council’s legal obligations under the Biosecurity Act 2014 are to ensure that any biosecurity
risks in relation to invasive plants and animals on private land, that are either prohibited or
restricted, are managed accordingly. Due to the economic, environmental and social impacts of
invasive plants and animals, the Act provides considerable powers to authorised persons to
ensure compliance by entering properties to undertake inspections. These inspections can be
undertaken through a Surveillance Program of a defined part of the region. Surveys must be
approved by Council and advertised.
Council has been undertaking this program for a number of years with its previous approved
Biosecurity Surveillance Program running from 2016–2020 and prior to this a Pest Survey
Program was approved by Council under the Land Protection (Pest and Stock Route
Management) Act 2002.
Approved Biosecurity Surveillance Program
A Council Resolution is required to approve the Biosecurity Surveillance Program from 1 July
2020 to 31 December 2024.
The surveillance program will provide relevant officers the necessary authority to enter
properties in accordance with the Biosecurity Act 2014, to facilitate a coordinated approach to
the management of invasive species across the region.
It is proposed that the surveillance program would consist of an annual inspection each year for
Page 48 of 55
Section 49
PLANNING & ENVIRONMENT COMMITTEE MEETING AGENDA 9 JUNE 2020
the period of 1 July 2020 to 31 December 2024. The region would be divided into four survey
areas with a different area surveyed each quarter. Inspections would be undertaken in each
area at the following times:
A. Survey Area 1: 1 July to 30 September each year until the end of 2024, for the localities
of Cooroy, Cooroy Mountain, Tinbeerwah, Cooroibah and that part of Doonan that is
within the Noosa Council boundary;
B. Survey Area 2: 1 October to 31 December each year until the end of 2024, for the
localities of Black Mountain, Federal, and those parts of Ridgewood and Eerwah Vale that
are within the Noosa Council boundary;
The Surveillance Program will involve authorised Council officers visiting a selection of private
properties in each area (usually with the owner present) to record the presence or absence of
prohibited or restricted invasive plant/s or animal/s using a mobile mapping system (ArcGIS
Collector App).
Examples of Prohibited plants or animals are Tropical Soda Apple (Solanum viarum), Water
Soldiers (Stratiotes aloides), Red-eared Slider Turtles (Trachemys scripta elegans) and American
Corn Snakes (Pantherophis guttatus).
Examples of Restricted invasive plants or animals are Fireweed (Senecio madagascariensis),
Groundsel Bush (Baccharis halimifolia), European Fox (Vulpes vulpes) and Feral Red Deer
(Cervus elaphus).
If prohibited invasive species are found on a property this information will be referred to
Biosecurity Queensland for their follow up as they are the lead agency for prohibited invasive
species.
If restricted invasive species are found on a property, the landowner is formally advised and
provided with information on what has been found and how to carry out control of the plant/s or
animal/s on their property. A written or verbal request to take reasonable action to control the
plant/s or animal/s may also be provided at this time.
If this action is not taken, the council officer may issue a statutory order under the Biosecurity Act
2014 requesting that control be undertaken within 30 days. If this order is not complied with it, the
Council officer could then arrange for a contractor to enter and clear the property of the restricted
invasive plant/s or animal/s at the landowner’s expense.
During the past four years of the previous Biosecurity Surveillance program (2016 – 2020) a total
of 45 written requests were made to landowners for the control of restricted invasive plant/s on
their properties. This resulted in 13 Biosecurity orders being issued and only 3 instances where
enter and clear action was taken.
As the statistics of the previous surveillance program indicate, the focus of the program is
primarily about educating landowners about the invasive species that are present in our area and
how they can be effectively managed on their properties to reduce their impact.
Previous Council Consideration
Ordinary Meeting Minutes, 18 August 2016, Item 1, Page 8
That Council note the report by Pest and Contracts Officer to the Services & Organisation
Committee Meeting dated 9 August 2016 and approve the following Biosecurity Surveillance
Program for the Noosa Council region in accordance with section 235 of the Biosecurity Act
(2014):
A. Survey Area 1: 1 July to 30 September in each of the four years from 2016 to 2020 for the
localities of Cooroy, Cooroy Mountain, Tinbeerwah, Cooroibah and that part of Doonan that
is within the Noosa Council boundary;

B. Survey Area 2: 1 October to 31 December in each of the four years from 2016 to 2020 for
the localities of Black Mountain, Federal, and those parts of Ridgewood and Eerwah Vale
that are within the Noosa Council boundary;
C. Survey Area 3: 1 January to 31 March in each of the four years from 2016 to 2020 for the
localities of Kin Kin, Pinbarren, Cooran and that part of Como that is within the Noosa
Council boundary; and
D. Survey Area 4: 1 April to 30 June in each of the four years from 2016 to 2020 for the
localities of Pomona, Lake MacDonald, Ringtail Creek, Cootharaba and Boreen Point.
Finance
Property inspections will require approximately 1 day per week of an officer’s time, or
approximately 12 days in total, to complete each quarterly survey area for the four-year duration
of the surveillance program. The work is considered core business of the Pest Management
Team and is funded as part of the operational budget.
Risks & Opportunities
Early detection of new invasive species in our region is critical for preventing them from
becoming established and has significant benefits in terms of reducing their impact on our
environment, economy and social amenity. The costs associated with managing invasive species
increase significantly as they become more established and widespread.
With an increasing number of residents moving to the region (particularly the hinterland areas)
with sometimes limited understanding of rural lifestyles, invasive plants and animals can present
a problem on large and small acreage as well as urban fringe areas.
Failure to deliver the nominated surveillance program could:
• put at risk the control of invasive plants and animals throughout the region, causing
environmental damage, loss of biodiversity, agricultural productivity and community
amenity; and
• result in Council failing to meet its obligations under the Biosecurity Act 2014 to ensure
prohibited and restricted matter is managed in accordance with the Act.

RECOMMENDATION
That Council note the report by the Environment Services Manager to the Planning &
Environment Committee Meeting dated 9 June 2020 and approve the Environment Project
Grants funding recommendations for this round as outlined in Attachment 1 to the report.
REPORT
The Environment Grants Policy endorsed by Council in September 2019 states that the
Environment Grants program ‘will support the implementation of the Noosa Environment
Strategy, as well as Council’s other key environment strategies and plans, by enabling
collaboration with the community in initiatives that work towards the outcomes and targets
identified in the Noosa Environment Strategy’.
The grants program consists of three components;
1. Environment Project Grants for projects, programs or events that align with the Noosa
Environment Strategy and have a positive impact on the Noosa environment. These grants
are advertised twice a year, concurrent with the Community Project Grants.
2. Environment Alliance Grants provide organisational support to community groups that are
primarily focused on environmental activities. These agreements are entered into for a
three year period, and were most recently endorsed by Council in June 2019.
3. Multi-year Environment Collaborative Grants support longer-term, larger-scale strategic
initiatives that align with the Noosa Environment Strategy and have a positive impact on the
Noosa environment. These grants were most recently endorsed by Council in February
2020.
The purpose of this report is to seek a recommendation only on the latest rounds of stream 1 -

Applications for the Environment Project Grants opened on 18 February 2020 and closed on 25
March 2020. Promotion for the grants included:
• Two paid advertisements in the Noosa News

• Specific email to all non-for-profit community groups on the database of the Community
Development team
• Details published on Noosa Council’s website and promoted through social media

All promotion was concurrent with the Community Grants Program and the Regional Arts
Development Fund.
Four grant applications were received as part of this round of Environment Project Grants, and
were assessed by a member of the Environment Services Team with experience assessing
grants, and environmental subject-matter expertise. These recommendations were moderated by
the Environment Services Manager and Director, Environment & Sustainable Development.
COVID-19 impacts
During the advertising process for these grants, community changes as a response to COVID-19
were starting to be implemented. Initially to support applications, extensions were provided to two
applicants, so long as they sought permission for the extension prior to the original closing date
of 25 March 2020. Statements were also sought and received from all applicants as to the
potential impact of COVID-19 restrictions on their proposed projects.
Given that the projects won’t start until at least August and all have 12 months to run, none of the
applications were withdrawn, or were deemed unable to be considered based on current COVID
restrictions.
If COVID-related restrictions were to extend to the end of 2020, or be tightened, then two of the
projects recommended for funding would need to work with Council with regard to possible
extension for their projects. Neither are time sensitive or seasonal, so could still be delivered with
some delay.
Previous Council Consideration
This is the third round of Environmental Project Grants since they were separated from the
Community Grants program into their own grant stream. Previous reports have been prepared
and endorsed by Council in June 2019 and November 2019.
Ordinary Meeting Minutes, 19 September 2019, Item 6, Page 9
That Council note the report by the Environmental Services Manager to the Planning &
Environment Committee Meeting dated 10 September 2019 and:
A. Repeal the Environment Grants Policy adopted on 21 February 2019 and adopt the revised
Environment Grants Policy provided at Attachment 1 to the Report with the additional
words included under the heading of Council Policy: “All initiatives funded by the
Environment Grants Program will have tangible and measureable outcomes.”;
B. Note the Draft Multi-year Collaborative Environmental Grants - Operating Guideline
provided at Attachment 2 to the Report, developed by the Environment Levy Working
Group, as per the Environment Grants Policy; and
C. Approve the Environment Grants being directed towards outcomes of the Biodiversity and
Waterways, Wetlands & Coasts sections of the Noosa Environment Strategy, while the
Environment Levy remains the sole funding source for the Grants.
Finance
The funding for this round of grants will not be allocated until July 2020 and will therefore come
from the 2020/21 financial year budget. It is anticipated that $75,000 will be available for
Environment Project Grants for the financial year, consistent with amount available in the
2019/20 financial year. This will be spread over two advertised grant rounds, concurrent with the
Community Grants Program usually advertised in February and August of each year. This report
proposes to allocate $35,761, which will leave $39,239 available for the next round of
Environmental Project Grants, expected to be advertised in August 2020.
Risks & Opportunities
There is some risk to the proposed projects based on uncertainty around COVID-19 restrictions
for the remainder of 2020. These have been addressed by the applicants and with the current

trend of restrictions, are likely to be implemented on their original timetable. If circumstances
change, Council officers will work with applicants to seek to deliver the projects.
