EXECUTIVE SUMMARY
This report advises Council that an appeal has been lodged against conditions of an approval
determined at Council’s Ordinary Meeting dated 20 March 2025 relating to a development application
for material change of use for Food and Drink Outlet and Short-Term Accommodation (16 units) at
203 – 207 Gympie Terrace, Noosaville.

The appeal relates to conditions 3, 13, 18, 20, 21, 22, 23, 28, 30, 35(d), 37(d) and (e), 39, 40, 43,
59, 61, 62, 63 and 64 of the Decision Notice, these conditions include:
• The requirement to accommodate the waste collection and servicing on-site.
• Easement terms.
• The form of the access driveway.
• External works.
• The form of the rooftop pool area.
The matter is in order for Council to defend the appeal.

RECOMMENDATION
That Council note the report by the Manager Development Assessment to the Planning and
Environment Committee Meeting dated 10 June 2025 regarding Planning & Environment Court
Appeal D44 of 2025 and agree to defend the appeal.
