2. BACKGROUND
A development approval for a Material Change of Use for Multiple Dwelling (5x small Dwellings)
was approved on 29 April 2025.
3. ASSESSMENT
3.1. Instruments for Statutory Assessment
Under the Planning Act 2016 the application must be assessed against each of the following
statutory planning instruments to the extent they are relevant to the development:
• State Planning Policy;
Page 3 of 6
Document Set ID: 24237340
Version: 7, Version Date: 08/01/2026
Page 4
• South East Queensland Regional Plan;
• Planning Regulation 2017; and
• Noosa Plan 2020 (25 September 2020).
3.2. Statutory Process
The applicant has requested to make a minor change to a development approval under s78 of the
Planning Act 2016. An application for a minor change to a development approval can only be made
in circumstances where a change would constitute a ‘minor change’.
The proposed change to the development approval requested by the applicant is determined to
constitute a minor change on the grounds that:
• the development would not result in substantially different development as the proposal does
not:
o dramatically change the built form in terms of scale, bulk and appearance; or
o remove a component that is integral to the operation of the development; or
o introduce new impacts or increase the severity of known impacts; or
• the change does not include prohibited development;
• the change would not require the application to be referred to an additional referral agency
or cause a referral agency to have regard to new matters prescribed by regulation;
• where the original application was code assessable, the change would not cause the
application to become impact assessable.
3.3. Statutory Instruments – Planning Scheme
The original application was lodged and assessed under the now superseded Noosa Plan 2020.
Pursuant to s81 of the Planning Act 2017, Council must consider the planning scheme in effect
when the original development application was lodged, however Council may give weight to Noosa
Plan 2020 (Amendment 2) as the planning scheme in effect at the time of the minor change
application being assessed.
The following codes from Noosa Plan 2020 are applicable to this development:
• Medium Density Residential Zone Code
• Hinterland Villages Local Plan Code;
• Dual Occupancy and Multiple Dwelling Code
• Works Codes;
• Regional Infrastructure Overlay Code (Water Resource Catchment and Water Supply
Buffer Area).
Existing Condition 16
Any street fencing must not exceed 1.8 metres in height, be set back an average of 1 metre and
articulated to provide visual interest by stepping the design. Any fencing on the front boundary
must either:
a. not exceed a maximum height of 1.2 metres
b. be of open construction.
Applicant’s Request
The applicant has requested existing condition 16 be removed from the Decision Notice to facilitate
the requirements of the State’s Referral Agency Response which require noise attenuation
measures to be implemented within the development.
These changes are reflected in the updated landscape concept plans submitted with this request
and do not alter the approved development layout or increase impacts on surrounding properties.

Assessment of Request
The proposed development is located on a State-controlled road and is subject to a Referral
Agency Response issued by SARA/DTMR under reference 2411-43615 SRA. Condition 4 of this
response requires measures to manage transport-related noise impacts in accordance with
Mandatory Part 4.4 of the Queensland Development Code, including the provision of noise
barriers.
In response, updated landscape concept plans have been submitted incorporating amendments
to the front fence design. These amendments include the installation of a 2.2-metre-high acoustic
fence along the site frontage and the eastern boundary of Unit 1. To visually screen the acoustic
fence, a 2-metre-wide landscaped buffer is proposed in front of the fence.
The requested changes to the front fence design, the eastern boundary and the additional
landscape buffering are supported
Recommendation
These changes have been made in direct response to Condition 4 of the Referral Agency
Response (SARA/DTMR Ref: 2411-43615 SRA), which requires measures to manage transport-
related noise impacts in accordance with MP4.4 of the Queensland Development Code. The
inclusion of a 2-metre-wide landscaped buffer to screen the acoustic fence further enhances visual
amenity and is considered an appropriate response to the imposed conditions. It is recommended
that Condition 16 be removed. The amended Landscape Concept Plans will replace the approved
Landscape Concept Plans as a Reference Document and the relevant table in the Decision Notice
will be updated as follows:

4. CONSULTATION
4.1. Referral Agencies
The applicant was referred to the following Referral Agencies:
• Department of Infrastructure, Local Government and Planning (SARA)
The Department is a referral agency for a Material Change of Use within 25m of a State transport
corridor and land within 100m of a State controlled road intersection.
The Department has responded advising that it supports the application from a Department of
Transport and Main Roads perspective, subject to conditions relating to the road access location
and the required road access works.
4.2. Internal Council Referrals
Not applicable
5. CONCLUSION & REASONS FOR DECISION
The proposed development generally complies with the requirements of the planning scheme and
does not raise any significant issues that cannot be addressed by reasonable and relevant
conditions. The application is therefore recommended for approval.
The report is provided in accordance with Section 83(9) of the Planning Act 2016.
