PROPOSAL
The applicant seeks an extension to the currency period for 2 years. The site has recently been sold and more time is required by the applicant to fulfil the conditions of the approval.  The applicant advises the following:
The applicant is in the process of acquiring the site and has commenced the process of fulfilling the development approval requirements. To date, detailed survey has been undertaken by RPS to prepare the required new survey plan. Additionally, town planning and legal counsel has been engaged to advise the further requirements of the development approval. The applicant has all intention to enact the development approval in a timely manner. The additional time requested allows all requirements of the approval to be carried out prior to the expiration date ….

A development approval for a Development Permit to Reconfigure a Lot (2 Lots into 2 Lots) was approved on 9 November 2012. Boundaries for existing allotments will be reconfigured for administrative purposes to facilitate future business ventures over the site. Details area as follows:

Proposed Lot 1 is 5.465 hectares and proposed Lot 2 is 14.773 hectares (comprising two portions of 0.2532 hectares and 14.52 hectares).

Proposed Lot 1 will allow the tourist park currently situated on the eastern area of Lot 2 to establish on its own lot, separate from the balance of the retreat.  Proposed Lot 2 will incorporate the remaining retreat (currently situated on Lot 2 on RP135678) including accommodation, eco centre, hotel, equestrian facilities and car wash as well as undeveloped land currently identified as Lot 1 on RP 135678.  In addition, existing dams and vegetated bushland will be comprised within Proposed Lot 2.
On 15 January 2015, Council extended the relevant period by 4 years, expiring on 19 November 2018.
On 7 November 2018, Council extended the relevant period by 2 years, expiring on 19 November 2020.  The COVID provisions for extension of current development permits introduced in July 2020 for 6 months applies to this, resulting in the relevant period being extended until 19 May 2021.
The original application was not required to be publicly notified.
assessment
The applicant has requested an extension to the currency period to the development approval under section 86 of the Planning Act 2016.  The applicant applied on 30 April 2021, prior to the expiration of the currency period.
The previous approval was a code assessable application under The Noosa Plan. The subject site is located in Environment and Conservation and Visitor Accommodation zones of the Noosa North Shore Locality. This zoning is consistent with the zoning under which the original approval was issued.
The previous assessment describes how the proposed boundary realignment will not compromise the site’s ability to maintain its intended zoning functions.  Furthermore, there have been no changes to The Noosa Plan provisions impacting the site and the proposed boundaries ensure environmentally sensitive areas are protected from fragmentation.
Given the above it is considered reasonable to grant the applicant the requested extension. The proposed extension meets the requirements of section 86 of the Planning Act 2016 and is recommended for approval for a further 2 years.
There were referral agencies associated with the original application. For an extension, the process does not include referring the extension application to a referral agency in accordance with sections 86 and 87 of Planning Act 2016 (PA).  A copy of the decision notice associated with this application will be provided to SARA.

RECOMMENDATION
That Council note the report regarding Application No. REC12/0066.03, for a Development Permit for Reconfiguring a Lot - Extension to Currency Period, situated at 1 Beach Rd Noosa North Shore Qld 4565 described as Lot 1 RP 135678, Lot 2 RP 135678, and approve the extension to the currency period. The currency period ends for this development approval on 19 May 2023.
