PLANNING & ENVIRONMENT COMMITTEE MEETING AGENDA 7 DECEMBER 2021 EXECUTIVE SUMMARY The application is seeking retrospective approval for a Home-based Business. The application encompasses a small-scale meat processing facility located in an existing 51.7m2 shed. The shed has been retrofitted to facilitate the processing of wild game (venison) and is solely operated by the landowner who resides on the lot. The meat and products are sold by the operator at local markets and directly to restaurants. No onsite sales are proposed, and no deliveries or commercial vehicles would attend the site. The relevant assessment benchmarks support home-based businesses provided they are facilitated where the nature, scale and intensity of the activity is compatible with the low density rural residential character and amenity of the surrounding locality. It is considered that proposed use maintains a domestic scale and operates in a manner that is subordinate to the residential use on the premises. Externally the activity maintains a residential appearance from all adjoining properties and is not visible from Patterson Drive. Despite submissions received from surrounding residents it is considered that the home-based business will not unreasonably impact on the amenity of the rural residential character of the area, with the shed well insulated to mitigate potential noise impacts. The proposal complies with the Rural Residential Zone Code and the Home-based Business Code and is therefore recommended for approval. Director Environment & Sustainable Development (Acting) Leo Jensen comment: It is noted that during the assessment period a submitter raised concerns via social media that Council’s assessing officer Wilhelm Koschade may have a conflict of interest in the assessing this matter. The assessing officer has an interest in hunting as a recreational pastime. This matter was investigated and whilst there may be a perceived conflict of interest by others, it was determined that no real conflict existed to warrant another officer to undertake the assessment. The officer has no relationship with the applicant. The report has been fully reviewed by the Development Assessment Manager Kerri Coyle and Director Environment & Sustainable Development (Acting) Leo Jensen.
