PLANNING & ENVIRONMENT COMMITTEE MEETING AGENDA 7 DECEMBER 2021
3. ASSESSMENT
3.1 Instruments for Statutory Assessment
Under the Planning Act 2016 the application must be assessed against each of the following
statutory planning instruments to the extent they are relevant to the development:
State Planning Policy;
South East Queensland Regional Plan;
Planning Regulation 2017;
Noosa Plan 2006.
3.2 State and Other Statutory Instruments
State Planning Policy
The state mapping for bushfire differs from the mapping within the Noosa Plan 2006. Where there
is an inconsistency between a State planning policy and local government planning instrument, a
State planning policy applies instead of a regional plan or local planning instrument. As such the
SPP bushfire mapping prevails with respect to the currency of the methodology used to assign risk
classes hence is to be used as the trigger for assessment under Council’s Natural Hazards Overlay
Code in lieu of the Noosa Plan 2006 Natural Hazards Bushfire Overlay.
Figures 4 and 5 below show the Noosa Plan 2006 and State bushfire hazard mapping over the
site.
