PLANNING & ENVIRONMENT COMMITTEE MEETING AGENDA 8 SEPTEMBER 2020
The flood immunity of the public road network immediately adjacent to proposed Lot 2 has also
been assessed. In this regard the study shows that the road network does have very low flood
immunity, but not just in proximity to lot 2, as a number of sections along its length are likely to be
inundated during flood times. Therefore, the ability to achieve an area on lot 2 above the probable
maximum flood is a desirable outcome of the proposed boundary realignment and offers an
improved outcome to the existing lot layout.
To address the findings of the flood study the applicant has amended their subdivision plan to
include a building envelope over the area that is flood free in the probable maximum flood event to
ensure any future dwellings are built in this area. This building envelope is also located clear of
the riparian buffer area identified by the Noosa Plan 2006 Biodiversity Overlay.
It is therefore recommended that Council settle the appeal and agree to the amended subdivision
plan and enter into an Infrastructure Agreement with the applicant to provide for improvements to
the existing bridge in Crawfords Road.
Previous Council Consideration
Ordinary Meeting Minutes, 19 March 2020, Item 4, Page 5
That Council note the report by the Manager Development Assessment to the Planning &
Environment Committee Meeting dated 10 March 2020 regarding Planning & Environment Court
Appeal No D7/2020 and agree to defend the appeal.
Finance
The Infrastructure Agreement provides that the applicant must pay the cost of erecting the signs
and 50% of the cost of replacing the bridge girders to Council prior to sealing the plan of survey.
The estimated cost of installing the signs is $500 and replacing the bridge girders is $33,300.
Risks & Opportunities
There will be further costs for Council if this matter continues on to trial and from the findings of the
flood study it is clear that the proposed boundary realignment is a significant improvement to the
existing lot layout. The bridge is also located in Council’s road reserve and is ultimately Council’s
responsibility.
