(PO Box 149) wurtuila Queensland Australia 4575 . . i TES a member of the RPS Group Pic Chief Executive Officer Sunshine Coast Regional Council PO Box 141 TEWANTIN QLD 4565 Sunshine Coast Regional Council Via Mail: Dear Sir / Madam RE: REQUEST TO CHANGE DEVELOPMENT APPROVAL PROPOSED BUILDING REFURBISHMENT UNIT 6 ON BUP9925 AT 81 HASTINGS STREET, NOOSA HEADS We write on behalf of the Applicant, our client, Or Guy and Michelle Skinner, in relation to lodging a change to development approval DNA102 for multiple dwelling units in accordance with Section 3.5.24 of the Integrated Planning Act; 1997, on land at 81 Hastings Street, Noosa Heads. This request to change the existing development approval is subsequent to that lodged by Conics (Sunshine Coast) Pty Ltd on 23 June 2009, which was conditionally granted by Council on 20 October 2009. As Council will recall, approval was granted for the proposed changes subject to conditions requiring amendments to the design; particularly in relation to a reduced roofline. Given this previous request for a change to the development approval was determined by Council in October of 2009, it is not considered necessary to reiterate the detailed history of development over the site. Rather, it is considered pertinent to just focus on the variations between the previous revised design and the built form proposed in this instance, as this would presumably be of most relevance to the assessing Officer. Proposed Changes to Development Approval The principle changes proposed to the development still relate to the addition of Bedroom 4 and associated bathroom on the third level, as well as the adjoining new games room and minor extension to the raised deck in the north-eastern comer of the site. A number of cosmetic changes to the building are also proposed, as depicted on the submitted proposal plans. It is important to note that the overall design has been developed in order to achieve a specific built outcome while improving the energy efficiency of the unit, to the extent that with the inclusion of the ‘pop up roof to allow and encourage movement of natural ventilation. It is intended that the works associated with the extension to the deck will ensure no detrimental impacts on the existing vegetation, though the proximate Pandanus Penduculatus will require translocation. As per previous discussions with Council Officers, efforts will be made to minimise the distance of translocation within the site, with ongoing measures implemented to ensure its successful retention over time. 7486-1007.PM.bh - Subsequent request for CDA urban growth and infrastructure

The changes sought by this application are expected to alleviate Council's previously expressed concems in
relation to the visibility of the proposed changes when viewed from prominent locations in and around
Hastings Street; the most notable of which is the Noosa Surf Club. Reference is made to the attached
‘Perspective View from Surf Club’ prepared by dm2architecture, which clearly illustrates that the proposed
alterations to the building will have no visual impact on the built form when viewed from Noosa Beach. We
note that Council verbally confirmed their general acceptance of the design outcomes sought by these plans
at a meeting held at Council on 6" November 2009. We therefore respectfully request that Council's
consideration of this request be given priority such that a resolution is reached in a timely manner.
In accordance with section 3.5.24 we ask that Council consider the above matters and issue an Amended
Decision Notice reflecting the above representations.
To assist Council with their consideration of this request, this application is supported by:
e Architectural Plans prepared by dm2architecture;
e The approved form duly completed with an accurate description of the land (IDAS Application
Form Part 2 - Request to change and existing approval);
e The written consent of the Body Corporate; and
e The fee in accordance with the 2009-2010 Development Application assessment fee schedule,
calculated as being $721.00. Please note that this fee was confirmed with Jack Lewis as being the
applicable fee for this request as a result of Council's recent dealings with the site.
We trust this information is sufficient for your purposes, however should you require any further details or
clarification, please do not hesitate to contact the writer by telephone on 07 5436 7807.

INTEGRATED PLANNING ACT 1997 Form 2, Version 4,1, 3 March 2008 OFFICE USE ONLY 433062 Advice for completing Form 2 General advice Form 2 may be used for any one of the four types of request for changing an existing approval - an extension of the period before an approval lapses (under IPA, section 3.5.22) to change or cancel a condition of approval (under IPA, section 3.5.33} to change the development approval other than a change of condition (under IPA, section 3.5.24) to change conditions of a rezoning approval given under the Local Government (Planning and Environment) Act 1990 (P&E Act) (under IPA, section 6.1.35A) Form 2 is not an approved form under the IPA. The assessment manager, concurrence agency or court may have their own form for the purpose of making a request to change an approval. In the case of a request to change conditions of a rezoning approval, the P&E Act establishes the process to be followed and provides for the local government to determine the required form. The entity that shoutd receive the request is: for an extension of the period before an approval lapses - the assessment manager (even if the approval was granted by the court (IPA, section 3.5.22(9)) to change or cancel a condition of approval - the entity that decided or required the condition (i.e. the assessment manager, a concurrency agency or the court) to change the development approval - the assessment manager to change conditions of a rezoning approval - the local government When paying fees to the Environmental Protection Agency by electronic funds transfer (EFT) for requests relating to environmentally relevant activities (ERAs) or coastal development, use the process from the information sheet Electronically paying fees to the Environmental Protection Agency (EPA) and attach the form Electronic Funds Transfer (EFT) payment notification to the request. Qt Any person may make a request to change an approval. However, in the case of a development approval for building work or operational work for the supply of community infrastructure on land designated for the community infrastructure, only the person supplying the infrastructure may make a request (IPA, section 3.5.33(3A)). a2 If the request is made to a concurrence agency or the court, notice of any subsequent change or cancellation of a condition must be given to the assessment manager (IPA, section 3.5.33(9)). Q6 . If the person making the request is not the owner of the land to which the approval attaches, the request must be accompanied by the owner's consent. (IPA, sections 3.5.22(3), 3.5.24(3), 3.5.33(3)). . However, owner's consent is not required if the approval is for: * — amobile and temporary ERA; or ¢ building work or operational work for the supply of community infrastructure on land designated for community infrastructure (IPA, section 3.5.33(3A)). Q7 The request must also be accompanied by the written agreement of the chief executive from whom evidence of resource allocation or entitlement would be required if an application for approval were being made. (IPA, sections 3.5.22(5), 3.5.24(5), 3.5.33(3C)) Qg For a request to extend the period before an approval lapses, or to change a development approval, each concurrence agency for the approval Must be given written notice of the request (IPA, sections 3.5.22(1), 3.5.24(1)). Q10 For a request to change a development approval, if the subject of the request involved a building referral agency, that agency also needs to be given notice of the request (IPA, section 3.5.24(1)). For a request to change conditions the opinion of a relevant building referral agency must be given regard to by the entity deciding the request (IPA, section 3.5.33(9)).
