Hi Michael, We refer to councils correspondence dated 12th March. With regard to the new business activity within Thomas Surfboards, specifically the training and exercise facility “ProMovement", we intend to make an application as requested and have requested a proposal from planners to expedite this as soon as possible. With regard to our some of the existing business activities within Thomas Surfboards, specifically the barber shop and coffee shop we will rely on councils moratorium on further breach action against existing businesses considered non-compliant until their review of the planning scheme was complete. The relocation of these existing business activities from Eumundi Rd to Project Ave is not introducing a new business within the Industrial zone. Please note that the Captain Sip Sops activity within Thomas Surfboards has evolved as a business and today includes design, development, testing, demonstration, wholesale and sale of Captain Sip Sops hair and grooming products. We believe council should also consider that the subject premises (4 Project Ave) was previously identified as being non-compliant in its entirety (offices and retail) and the proposed tenancy split is significantly compliant, in terms of the 60% manufacturing, 20% associated office and 20% associated retail mix. Furthermore, the impacts on traffic, reverse amenity or use area mix is less than that which was previously allowed for under the moratorium. As previously advised in the correspondence from P&E Law on our behalf, upon the adoption of the new Noosa Plan an application (if required) will be made under the newly adopted scheme. We are happy to meet with council discuss the matter in more detail. The three uses not complying are: 1. Captain Sip Sops (Barber) – 3 x Application Fee Multiplier. 2. Pro Movement (Gym) – 1 x Application Fee Multiplier. 3. Coffee Shop – 3 x Application Fee Multiplier. Council has previously written to the owner of the property and Captain Sip Sops indicating that all these uses required an application to Council prior to the commencement of their use. As the uses have commenced you are currently operating in breach of The Noosa Plan and the Planning Act 2016. Following discussions with you today, Council can advise that an application must be submitted for the 3 individual uses. Please take action to address this matter and confirm in writing/email your actions by close of business Friday 16th March 2018, marked to my attention. Should you have any further queries in relation to this matter, please don’t hesitate to contact me on the numbers below.
