REPORT
BACKGROUND
By virtue of legislation, local governments are empowered, and are required to make numerous
decisions in order to properly discharge their powers and responsibilities for the communities they
serve.
To streamline operations, in accordance with section 257 of the Local Government Act 2009 (LGA),
a Local Government may, by resolution, delegate a power of the Local Government under the LGA
or another Act to:
The Mayor; or
The Chief Executive Officer (CEO).
Pursuant to section 259 of the LGA, a CEO may delegate the CEO’s direct powers to an
appropriately qualified employee or contractor of the Local Government. The CEO is also able to
on-delegate powers that have been delegated to CEO from Council.
The diagram below obtained from the Local Government Association of Queensland’s (LGAQ)
publication titled ‘Local Government Delegations’ provides an illustrative overview of the
Queensland delegations model.
