Noosa Shire Council,
PO BOX 141

Attention: Blake Coulston

Dear Blake,

RE: Response to Information Request relating to a Change to Approval (other than a minor change) to
           MCU17/0002.01 to include Short-term Accommodation

I refer to Council’s Information Request issued on 14 May 2021 in relation to the above-mentioned application.

In accordance with Part 3 Section 13 of the Development Assessment Rules and the Planning Act 2016, we herby provide a
response to the items raised in the request as detailed below:

Issue

For the justification for PO6 of the Driveways and Parking Code, Council requires the likely numbers of users for the use.
Meaning the total number of guests that each dwelling unit will have.

Information Required

      1. Provide additional justification for PO6 of the Driveways and Parking Code indicating the number of users the Short-
           term Accommodation will have.

Response

The proposed short-term accommodation use is not intended to allow for any greater number of persons to be
accommodated onsite than would reasonably be accommodated within the existing Duplex.

The existing duplex contains 1 x 3 bedroom unit and 1 x 2 bedroom unit, having a total of 5 bedrooms. It is considered that 2
persons could reasonably be expected to be accommodated in each bedroom. Therefore, the use would have a total of 10
persons to be accommodated onsite at one time. Our client would be satisfied for a condition to be imposed to this effect.

As detailed in the original application material, the proposed use would have no additional demand on vehicle parking to that of
the existing duplex development. It would also provide sufficient parking having consideration to the type and intensity of the
use and the likely number and type of vehicles to be generated by the development in accordance with PO6 of the Driveways
and Parking Code.

Issue

The application has indicated that a code of conduct will be used to ensure that no negative impacts to the surrounding area
will occur. Since the premises consists of swimming pools, it is requested that the applicant provide an indication of what the
‘house rules’ will be for the outdoor entertaining areas / swimming pools to ensure no negative impacts to the surrounding area.

Information Required

    2. Provide the section of the code of conduct for the usage of the outdoor entertainment areas / swimming pools.

Response

Our client has advised that the following clauses, which relate to the use of outdoor entertainment areas, will be included
within a code of conduct that is to be established for the use:

    a) All outdoor areas, including balconies, decks, and the like, must not be used after 9pm each night and the pool area
must not to be used after 8pm each night.
    b) The use of the premises must not:
          i. detrimentally affect the residential amenity (including but not limited to noise, overlooking, light spill or odour)
enjoyed by residents in the vicinity of the premises; or
         ii. cause a nuisance (including a noise nuisance);
        iii. result in behaviour including:
             • loud aggressive conduct;
             • yelling, screaming, arguing; or
             • excessively loud cheering, clapping and singing.
iv. create a level of noise above the acceptable levels described by Queensland Government legislation for
             environmental protection (noise).

The abovementioned operating procedures are consistent with other short-term accommodation uses that Council has
recently approved in the nearby area.

This office trusts that the information supplied comprehensively addresses all of the issues relating to the information request.
