7 Development Assessment
7.1 Statutor y Instruments
Under the Sustainable Planning Act 2009, the application is required to be assessed against the following
statutory planning instruments:
• State Planning Policies;
• the South East Queensland Regional Plan;
• State Planning Regulatory Provisions;
• the Planning Scheme for the local government area; and
• any Temporary Local Planning Instrument in place for the local government area.
The proposal has been assessed against the State planning instruments and is considered to comply with
the relevant legislation. An assessment of the proposal against the Noosa Plan is detailed in section 7.2
below.
7.2 Noosa Plan 2006
7. 2. 1 No o s av i ll e L o c a lit y P la n
T he Noosa Plan includes the site in Noosaville Locality Plan and provides the site with an Attached
Housing zone. An extract of the zoning map for the Planning Area is detailed below.:
Zone Map 8 - Noosaville Locality
The Noosa Plan 2006 defines a fitness centre as:
Entertainment and dining business means the conduct of a business activity, where entertainment,
amusement, recreation or meals are afforded. The term includes the following types:
Type 2 Recreation, amusement & fitness - The use of premises involving recreation or amusement
activities, including cinema, health & fitness club, gym, sport activity or brothel.
The Noosa Plan 2006 indicates that Entertainment and dining business uses are inconsistent impact
assessable uses in the industry zone.

7. 2. 2 Ap p li c ab le C o d es
The proposed undefined use is indicated as being impact assessable and is required to be assessed
against the provisions of the entire Noosa Plan. The Codes that are most relevant with regard to this
proposal include the:
• Noosaville Locality Code
• Business Uses Code
• Engineering works Codes
• Landscaping Code
7.2.2.1 Noosaville Locality Code
As the use is inconsistent it is relevant to assess the proposal against the relevant Overall
Outcomes of the Noosaville Locality and the specific zone. A comparison is detailed below:
a) New uses and works are located, designed and managed to—
i be compatible with other uses and works;
ii maintain the safety of people and works;
iii avoid significant adverse impacts on the amenity enjoyed by users of other premises,
including acoustic and visual qualities; and
iv avoid significant adverse effects on the natural environment, including native habitat
removal, fragmentation and attrition;
Proposal consistent with the outcome as the use will not impact on the existing industrial businesses on
site as evidenced by other gyms and dance studios existing harmoniously with industrial uses. The
existing uses are also predominantly warehouse type uses with no industrial manufacturing occurring
and the fitness centre will be compatible with these uses.
The entire fitness centre is to be air-conditioned and combined with the tilt up slab construction will
minimize any noise impacts from the fitness centre. No external works are proposed and therefore the
use will not affect the visual amenity of the area.
c) Noosaville retains its role as a focus for visitor accommodation and services in the Shire;
The proposed fitness centre will provide a further recreation facility for visitors and residents in the area.
q) Gibson Road, part of Mary Street, Noosa Parade, Reef Street, Weyba Road, Walter Hay Drive,
Eenie Creek Road, Beckmans Road and Eumundi -Noosa Road are protected as parts of the Noosa’s
major road network;
The proposed use is located in an existing building and will not impact on the surrounding major road
network.
o) The function, safety and visual amenity of the Noosa’s major road network are protected;
The proposed use is located in an existing building and will not impact on the surrounding major road
network.
For the Industry Zone — land in this zone —
ii. is protected for industrial functions including Industrial business Type 2 to the exclusion of
incompatible uses including Residential Uses , Community Uses, Commercial business and most
sport and recreation uses and Retail business uses;
The outcome recognizes that some forms of sport and recreation uses require greater floor areas than
able to be provided in the traditional commercial centres of the area and will be appropriate for the
industrial area. This has been accepted by Council who has approved a number of gyms/training
studios and dance studios within the Noosaville industrial estate.

The applicant has investigated the surrounding commercial zoned land and advises that they require at
tenancy with a minimum of 500m2 up to 1000m2 for the full service fitness centre that they wish to
provide. The subject site has a floor area of 669m2 and is well located to surrounding residential and
business areas.
iv does not accommodate uses that would harm the environment through excessive noise, odour, dust,
or other waste;
The proposed fitness centre is to be located in an existing approved industrial complex and being fully
air-conditioned will not have any openings to the surrounding area.
v is developed in a fashion that does not detract from the character of its locality or impact on the
major road network;
The proposed fitness centre is to be located in an existing approved industrial complex and will not be
highly visible to the surrounding area. The existing road network will not be affected by the proposed
use.
vi provides important industries and service-related businesses to the whole of Noosa, but particularly
the coastal area and the north-east area of the former Maroochy Shire; and
The proposed fitness centre is a business that provides a health service for its members and as a
womens only fitness centre will service the entire Noosa and Doonan area.
vii provides for a high level of runoff water quality to Eenie Creek and Lake Doonella;
Proposed fitness centre will have lesser impacts than approved industrial uses.
A comparison of the proposal against the Noosaville Locality Code is included in Attachment B.
7.2.2.2 Business Uses Code
The proposal has been reviewed against the overall outcomes of the Business Uses Code and is
considered to comply with the most relevant outcomes which include:
a) Existing and future populations have access to an adequate level of goods and
services;
The applicant has reviewed the current supply of fitness centres in the area and has identified a
market for a womens only fitness centre for the area. The centre will provide a new type of fitness
centre not currently provided in the area.
c) Business Uses contribute positively to the Shire’s economy and employment;
The proposed fitness centre will provide up to 13 jobs and will contribute to the local economy.
d) Business Uses are located where there is an appropriate level of infrastructure and a wide range
of functions to support those uses;
The site is located in an existing building which is well serviced by existing infrastructure and has good
access to the existing road network.
e) Business uses in an urban zone, have appropriate connection to reticulated sewerage, water
supply, stormwater drainage, electricity, and telecommunications services;
The site is connected to all essential services.
f) Business development has high levels of accessibility and functionality;
The proposal has good pedestrian, cycle and vehicular access to the surrounding area and the site is
easily accessible at all times.
h) Business development is consistent with the hierarchy of centres across Noosa; and

Applicant: Gelherdt No 2 Pty Ltd
The proposal does not impact on the hierarchy of centres and is required to be located in the industrial
area due to the large floor areas required.
i) Business Uses are energy and water efficient
The proposed fitness centre will incorporate energy efficient lighting and water saving devices.
The proposal has been reviewed against the provisions of the Business Code and is considered
to comply with the relevant requirements as detailed in the table below. Whilst it is noted that site
does not fall within a designated centre under the hierarchy of centres of the Noosa Plan, an
examination of the criteria is considered relevant to the proposal and is included in Attachment
C.
7.2.2.3 Engineering Works Code
In accordance with the Noosa Plan, Type 2 Recreation, amusement & fitness uses have a
carparking rate of:
1 space per 20m2 , or part thereof, of use area;
OR
1 space per 3 persons capable of being entertained at any one time, whichever is the greater.
It is noted that several areas of the centre do not contribute to actual car parking generation and
these include the reception, offices, amenities, recreation room, crèche and equipment storage
areas.
The applicant engaged TTM Consulting Pty Ltd to undertake a preliminary parking analysis on
the site. This analysis included as Attachment D concludes that the on-site parking demands are
significantly lower than Councils parking requirements and that subject to restrictions relating to
class operations, no external parking would occur.
7.2.2.4 Landscaping Code
The existing site is well landscaped with existing substantial trees retained around the perimeter
of the site.
7. 2. 3 O v e rl a ys
The site is mapped as being affected by Koala Habitat Area, Low Potential Acid Sulphate Area and
Medium Bushfire Hazard area. As the use is located in an existing building the proposal does not trigger
assessment against the Overlays.
8 Conclusion
The development application has been submitted to the Noosa Council as the Assessment Manager of
the application under the Sustainable Planning Act 2009. This application seeks a Development Permit
for a Material Change of Use of Premises for an Entertainment and Dining Business Type 2
Recreation, Amusement & fitness (fitness centre) on the site which is impact assessable development
under the Noosa Plan 2006.
This application can be supported on a number of grounds as provided in detail in the above report.
These grounds include:
The proposed fitness centre requires a large floor area to cater for gym equipment and other
facilites of a full service gym, which is not available in surrounding commercial areas.
The site is well located on the edge of the industrial estate and has good access to existing
pedestrian, cycle and public transport routes.
No new buildings are proposed on the site;

Dear Mick,
RE: 8 Selkirk Drive, Noosaville – Preliminary Parking Analysis
1. Introduction
TTM Consulting have been engaged to undertake a preliminary analysis of parking demands and availability at
an industrial complex at 8 Selkirk Drive, Noosaville. It is understood that this analysis is sought to determine if
parking availability is sufficient to provide a gym within Tenancy 5. This analysis is for information only.
2. Subject Site
An aerial image of the site is provided in Figure 1 (source: Nearmap).

demands. The total GFA and GFA excluding patios and balconies of occupied units is 4,261m 2 and 4,030m2
respectively.
Page 29
3. Parking Requirement and Provision
TTM have not been able to obtain the development approval for 8 Selkirk Drive, Noosaville. As such, the
approved use is not known, however TTM anticipate the site was approved as an Industrial Business Type 1
Warehouse. The Noosa Plan (including amendments to 16 September 2013) identifies the parking
requirement for this use is 1 space per 50m2 use area.
The use area of each Unit is not supplied. The development is provided with 94 parking spaces. For this parking
provision to be compliant, the total use area of the site would have to be no more than 4,700m2. This equates
to 91.4% of total unit area from Table 1, or 97.7% of total Unit area excluding balconies and patios. For the
purpose of this assessment, TTM will identify the ‘use area’ as 91.4% of total unit area.
Table 2 shows the total Unit areas, estimated ‘use areas and estimated parking requirements for key scenarios.
Table 2: Total Unit Area, Estimated Use Area and Estimated Parking Requirement
Scenario Description Total Unit Area Estimated Use Area Estimated Parking
Requirement (spaces)
A Total Site 5,140m2 4,700m2 94
B All occupied Units 4,261m2 3,894m2 78
C All occupied Units 3,542m2 3,237m2 65
excl. Unit 5
D All Units excl. Unit 4,421m2 4,040m2 81
5
E Unit 5 only 719m2 657m2 13
Based on the estimation of ‘use area’ and Unit area, it is anticipated that Unit 5 would generally have
requirement for 13 spaces or 13.8% of all spaces on-site.
4. Surveyed Parking Demands
TTM undertook a parking demand survey of the subject site on Wednesday 31st August 2016. This is considered
to be an average day with normal parking demands and is also a peak operating day for the gym. The results
of the parking demand survey are provided in Attachment 2. The following provides a summary of the results
of the survey:
The peak parking demand was found to be 41 cars. As such, the car park had a maximum occupancy
of 43.6%. This peak occurred at 12:30pm and relates to a parking demand of 1 space per 103.9m2 Unit
Area.
Page 30
Up to 2 owners/staff parked within their premises. Adding these cars to the peak demand results in
total parking demand of 43 cars or 45.7% car park occupancy. This relates to a parking demand of 1
space per 99.1m2 Unit Area;
Before 12:30pm and after 1:00pm, the peak parking demand was found to be 36 spaces with a car
park occupancy of 38.3%;
Trucks were generally loaded/unloaded in parking aisles/vacant parking spaces however 1 used the
loading zone.
Allowing for cars parked within tenancies, the parking area had a minimum availability for 51 cars
between 12:30 and 1:00pm. Outside these times the minimum availability was 58 cars.
5. Gym Usage
TTM have received information on proposed gym operation by an operator of the Fernwood Fitness gym in
Morayfield. The subject site would generally operate the same, with class numbers and sizes based on overall
membership which is anticipated to be 600 persons or 60% of number of memberships at the Morayfield gym.
This information is provided in Attachment 3.
Table 3 provides an overview of anticipated staff and patrons onsite at various times of the day based on this
information. The maximum demand is based on full classes and the highest anticipated attendance. The 85 th
percentile demand is based on the average class size between January and March.

* Class sizes are a maximum of 20 persons each with a peak average of 15 persons per class (Jan to March). At other times of the year,
class sizes will be much lower (6-12 persons). Patron numbers are based on class being run concurrently or with overlap between
classes ending and beginning.
# PT sessions have a maximum of 3 persons or an average of 2 persons per session.
6. Council Parking Requirements - Gym
The gym use is an Entertainment and Dining Business – Type 2 Recreation, Amusement and Fitness in the
Noosa Plan. The parking requirement for this use is the greater of:
1 space per 20m2 use area; or
1 space per 3 persons capable of being entertained.
Table 2 identifies that the estimated use area for Unit 5 is 657m2. This equates to a parking requirement of 33
spaces. The anticipated maximum occupation of the gym is 92 persons between 5:00-7:30pm. This equates to
a parking requirement of 31 spaces. As such, the Council parking requirement for the subject site will be 33
spaces.
Page 32
7. Suitability of Subject Site for a Gym
TTM acknowledge that the Council parking requirement for a gym is higher than the implied parking
requirement for Unit 5 shown in Table 2. However, it is noted that the peak parking demand of 41 spaces is
significantly below the implied parking requirement for all occupied units of 78 spaces.
Table 4 shows the surveyed parking demand at peak gym and site times. The surveyed parking rate has then
been applied to Scenario D to determine parking demand and car park occupancy for all units except Unit 5.
Table 4: Surveyed Parking Demand – Peak Gym/Site Times

Table 4 shows that with Units 7 and 9 occupied, with similar uses to existing businesses within site, site parking
demands will not significantly change from surveyed parking demands. Table 5 shows the site parking
availability with the gym based on Table 3 and 5 during peak gym/site operating times.

* Based on 85th percentile number of patrons on-site at key operating times.
Based on parking surveys of the subject site on a peak gym day and Council parking requirements, Table 5
shows that the site is expected to have a minimum of 16 spaces (17% of total supply) available with full
occupation of the site including the gym.
The primary site use is an employment centre for industrial land. The parking surveys have identified significant
parking availability at all times of the day. With this parking availability, the proposed gym/recreational use
can operate on site, however this must remain a secondary use. It is therefore TTM’s opinion that the subject
Page 33
site is suitable for a gym use, however the following restrictions should be implemented to ensure sufficient
parking availability for the primary industrial use:
No more than 3 overlapping* classes between 5:30pm and 6:30am;
No more than 2 overlapping* classes between 6:30am and 5:30pm;
No more than 1 class between 11:30am and 2:00pm.
* Classes within 30 minutes of each other are considered to result in overlapping parking demands. If one class immediately follows
another, TTM consider this an overlapping class which may not be appropriate between 11:30am and 2:00pm, however can occur
between 6:30-11:30am and 2:00-5:30pm. The current class schedule for the Morayfield gym shows 3 overlapping classed on Friday
mornings only – Yoga, Studio Cycle and Body Step – which would have an overlap between 8:45-9:30am.
Should these recommendations be written into a management plan or covenant for the gym use, it is TTM’s
opinion that providing a gym on-site will not lead to external parking.
8. Summary
TTM have reviewed parking requirements and demands of an operational industrial site at 8 Selkirk Drive,
Noosaville. The review has determined that site parking demands are significantly lower than Council’s parking
requirements. TTM have also reviewed Council parking requirements for a gym at maximum and 85th
percentile operating times. This analysis has determined that the site will have a minimum 16 parking spaces
available at 12:30pm with Council designated parking requirements.
TTM have provided recommendations to limit classes to maximise available parking for the subject site for the
primary industrial use. Based on the surveyed parking demands, TTM do not envisage external parking would
occur as a result of the gym use.
