EXTENSION TO CURRENCY PERIOD – DELEGATED REPORT
The applicant states that the landowner has not been able to commence the building works, as
approved by Council on 12 October 2022. These reasons for the requested extension relate to
both personal circumstances and difficulties experienced by the local construction industry.
No other changes to the development conditions and approved plans are requested and the
landowner will commence the development should Council approve the requested extension.
2. BACKGROUND
A development approval for Building Works assessable against the Planning Scheme
(DBW21/0183) – Dwelling House was issued on 12 October 2022.
This application assessed performance-based solutions for setbacks, building height and site
cover. These solutions were supported and the application was approved, subject to reasonable
and relevant conditions.
The currency period for the development was conditioned, as reproduced below:
6. This development approval lapses if the use has not happened by 7 October 2024, unless an
application to extend the currency period is approved by Council.
The landowner did not exercise any appeal rights under the Planning Act 2016 following the
receipt of this decision notice.
3. ASSESSMENT
The applicant has requested an extension to the currency period to the development approval
under section 86 of the Planning Act 2016.
Given the circumstances and reasons for the extension, a further period of two (2) years is
considered appropriate.
The relevant matters pertaining to the assessment of the original development application that
Council must consider have not changed since the application was approved on 12 October
2022.
Since the approval has been granted there has been no changes to the Noosa Plan 2020 and
therefore the development remains consistent with the current provisions.
Furthermore, there have been no changes to the applicable planning process that would apply to
an application for the development if it was to be made now. This includes no change to the level
of assessment and no referral agencies are now triggered.
4. CONCLUSION
In consideration of the landowner’s personal circumstances and the challenges being
experienced in the construction industry, an extension to the currency period of two (2) years is
appropriate and will give the landowner the time required to complete the development.
