5           Regulatory Bushfire Assessment
5.1         Designated Bushfire Prone Area
Pursuant to Section 2.9.4 of the current Noosa Plan, it is noted the bushfire hazard overlay which
forms part of the planning scheme designates bushfire prone areas across Noosa for the purposes
of the Building Code of Australia (BCA). As per Figure 5 below, the subject site is identified within the
Designated Bushfire Prone Area.

Further, it is noted the BCA triggers bushfire assessment (via AS3959-2009 – Construction of Buildings
in Bushfire Prone Areas) for building classes 1, 2, 3 and selected 10a structures. This being the case,
the BCA (and AS3959-2009) is relevant to this bushfire hazard assessment.

Despite the above, it may be the case the RAC component of the facility is deemed a Class 9
structure which technically, avoids AS3959 construction requirements in Queensland. Irrespective,
construction to bushfire attack level standards is strongly recommended for the RAC and each other
residential component of the approved development on the basis of the potentially vulnerable
nature of the residents of the approved facility, and its proximity to adjoining vegetation within the
Noosa National Park.

5.1.1       Noosa Plan Bushfire Hazard Overlay
The Noosa Plan (an IPA Scheme last amended in 2018) remains the applicable local planning
instrument. The Bushfire Hazard Overlay mapping under the Noosa Plan remains relevant pursuant
to the provisions of the Building Code of Australia (BCA). The BCA nominates local government
planning scheme hazard overlay mapping as the relevant trigger for the applicability of AS3959-
2009 – Construction of Buildings in Bushfire Prone Areas. On this basis, the overlay mapping continues
to remain relevant in terms of building construction for Class 1, 2, 3 and selected 10a structures.

Figure 5 provides an excerpt of the current Bushfire Hazard Overlay map under the Noosa Plan. A
significant portion of the site comprises areas of ‘High’ and ‘Medium’ potential bushfire intensity as
well as the 100m potential impact buffer which covers most of the site.
