               DEVELOPMENT ASSESSMENT DELEGATED REPORT




                         Figures 18 - 20: Portions of the dwellings within nominated north-western boundary setbacks
                                                            (Basement, Ground, First)

               Given the non-compliance with AO9.1, the proposal is required to comply with corresponding
               Performance Outcome PO9 of the High Density Residential Zone Code (refer to above PO9).
               The proposed encroachments relate to access (stairs and lift) and a powder room only. The
               Basement level encroachment is predominately backfilled, and as such not visible. The Ground
               level relates to a small portion of the basement stairs only for a length of 2.5m, whilst the First floor
               encroachment relates to the top 1.7m of the level, for a length of 3.4m only. These setbacks are
               an improvement on the existing development, which includes lesser setbacks up to 5.5m in height
               on this boundary (refer to Figure 21).
