Attached to the e-mail MCU16/0044 & REC16/0009 - PM Submission Object - Peregian Beach Business Association Inc..
Council Reference: MCU 16/0044 & REC16/0009 30" June 2016 The Chief Executive Officer Noosa Council PO Box 141 TEWANTIN QLD 4565 Attention: Glen Conforti Dear Sir, RE: SUBMISSION TO A DEVELOPMENT APPLICATION Development Application for a Material Change of Use of Premises - Commercial Business Type 1 Office, Entertainment & Dining Business Type 1 Food & Beverages, Wellbeing Type 2 - Social and Open Space Type 1 Sport & Recreation and Development Permit to Reconfigure a Lot - Boundary realignment for premises located at 253-255 David Low Way and 5-7 Rufous Street, Peregian Beach described as Lots 94 & 95 SP 137431 and Lot 1 SP 215942 This letter comprises a submission to MCU16/0044 and REC16/0009 relating to the above proposal at Peregian Beach. | wish to object to the application and submit the following grounds in support of my objection: 1. The proposal is in conflict with the outcomes of Noosa Plan specifically the Neighbourhood Centre zone, as it will negatively impact on the focal point that is the existing Peregian Beach Neighbourhood Centre. The planning report supporting the application refers to the proposal as providing for a new office building and conversion of the existing Peregian Beach Community house to an office. The Noosa Plan details that that Commercial business uses are inconsistent in the zone and insufficient grounds have been provided as justification for overriding the planning scheme. The Noosa Plan states that the neighbourhood centre is to form the focal point for the community by providing local shops, offices, restaurants and other higher order functions. The proposal for office space outside this centre area further fragments and negatively impacts on the neighbourhood centre. The supporting planning report attempts to justify that the new commercial uses are appropriate on the Community Services and Open Space Recreation zoned land due to the new Peregian Beach Community House building and open space being provided. These uses are not considered sufficient to warrant the approval of commercial uses in the zone which is to provide for community not commercial uses. The proposal to utilise publically owned land that is included in the Community Services and Open Space Recreation zones for office space is not supported. The planning statement accompanying the application clearly states that the workspace will incorporate public and private, community and commercial activities. These commercial activities

should be located in the existing neighbourhood centre zone as detailed by the Noosa Plan. 6. The proposed design of the IT Enterprise Building and new Peregian Beach Community house, detrimentally impacts on the existing neighbourhood centres’ function as it does not provide sufficient carparking to meet the demands of users that will be generated by the use as well as catering for existing users. 7. An independent parking assessment of the proposal and surrounds has been carried out by TTM Consulting Pty Ltd. This assessment indicates that parking is already at or close to capacity in the area and is reliant on the existing public parking available on the site. The TTM report recommends that parking provided as part of the development application is publically available so the development does not contribute to a reduction in public parking. 8. The TTM report indicates that the existing carparking area is needed for overflow for existing village. The proposal does not detail how this overflow carparking (which is currently provided on site and promoted by Council) will be catered for on site. 9. The TTM report indicates that additional parking measures are required to ensure that the development does not impact on the surrounding area, such as maintenance of public parking during construction, public parking availability post development and reviewing the proposed parking layout to maximise parking supply. Concerns are raised that these aspects will not be incorporated into any approval and therefore the loss of carparking will be detrimental to the area. 10. The provision of sufficient carparking on site for the use and the community was raised as part of submissions to the Draft Master Plan. The proposal is not considered to have provided sufficient carparking for the proposed use or surrounding commercial areas. 11. The site currently contains public carparking that is highly visible from the David Low Way and utilised for overflow carparking. The proposal reduces the visibility of this parking area from the David Low Way which will in lead to additional pressure on parking in surrounding areas which is not appropriate. 12. The potential reduction in pubically available carparking as a result of the proposal is considered shortsighted and does not consider the future carparking demands of the area. Development Application MCU16/0044 and REC16/0009 should be refused for the following reasons: a. The proposal does not comply with the Noosa Plan; b. The proposed uses are commercial uses which should be located in the neighbourhood centre zone not in the Community Services zone; c. The proposal will detrimentally impact on the surrounding area due to the lack of carparking provided on site; and d. The applicant has not demonstrated that sufficient public carparking to cater for existing public parking demands of the area and the proposed use is provided on site.
