Agreement to proceed letter

Dear Sir/Madam

Voluntary Conservation Agreement over your Property at                     , Queensland,
being Lot     on SP

On behalf of Noosa Council I thank you for offering to establish a registered conservation covenant
over a nominated area of your property. To progress this process Council must invest ratepayers’
funds to survey the covenant area, draft Titles Office documentation and allocate officer time and
resources to develop an environmental management plan for the conservation area of your
property.

Before the Council proceeds any further with the matter and incurs any costs, it requires your
written confirmation that if you change your mind and decide not to proceed with the conservation
covenant you will reimburse the Council for any reasonable survey and legal costs it may incur up to
the date that you notify the Council of your intention not to proceed.

The Council also requires your confirmation that (if relevant) any mortgagee or other interested
party noted on the title over Lot xxxxxxxx has been informed of your intentions to register a
conservation covenant on the title and has verbally agreed to consent to such a covenant in the form
of the draft previously provided to you.

Please sign the acknowledgement clause below to indicate your agreement to the above.

ACKNOWLEDGEMENT

I,                                           , hereby agree to reimburse the Council for any
reasonable survey and legal costs it may incur in the circumstances described above. I also confirm
that the mortgagee of my above property has verbally indicated that it will consent to the
registration over my property of a covenant in the form of the draft supplied to me.
