PLANNING AND ORGANISATION COMMITTEE MEETING AGENDA 22 JULY 2014

it is recommended to rescind the delegation and where required and replace with a new
Noosa delegation in the LGAQ format as detailed in Attachment 1.

Previous Council Consideration

Nil
Legal

This report is prepared in accordance with the requirements of the Local Government Act
and various other State Government Acts. The delegation of powers to the CEO and/or
Council officers is not mandatory and Council may retain, rescind or amend a power if it
wishes.

Finance & Risk

The amendment of Council’s existing delegations has been met through Governance’s core
budget provisions. Operationally if delegations are not current or officers operate outside of
their delegated authority, the decisions made may be illegal and unauthorised. This may
expose Council to the risk of unnecessary and expensive legal action by third parties.
To manage this risk, delegated powers can only be exercised in accordance with the scope
and limitations of the subject officer’s letter of appointment and/or, position description,
qualifications, technical knowledge and legislative requirements.
Additionally, the officer must take into account any conditions of delegation, relevant Council
resolutions, policies, procedures etc.
