PLANNING & ORGANISATION COMMITTEE MEETING AGENDA 22 JULY 2014
The applicant has provided a shading diagram which indicates some minor additional
shading to the western neighbour at the winter solstice and also offers the following
justification for the proposal:
energy efficient design
6 star + rating
Extensive use of renewable materials
Recycle/reuse as much existing building materials as possible
Complements surrounding natural feel
Provide privacy for neighbours
Utilising existing building structure - to reduce impact on local tip
10 degree fall across land is the only contributing factor to request
SCC council would approve this application due to fall being >10%
No impact from street level
No impact to view for neighbour on high side
Retaining existing lower building structure has an effect on overall height
The proposal is a similar height to the adjoining dwelling and another dwelling in close
proximity and presents as 2 storeys to the street. The neighbouring dwelling is shown in
Figure 1 and the other dwelling in close proximity in Figure 2 below. There are also other
similar height unit complexes in the surrounding area, but not in close proximity.
Notwithstanding the above, 3 storey buildings are not the predominate character of this area
being for detached housing 8 metres or less and 2 storeys in height.
Figure 1 - Adjoining property Figure 2 - property 3 door to the east
The proposal is also not low rise, exceeding the required 8 metre building height by up to 2
metres. The upper storey overlooks the neighbouring properties northern balcony, a small
lower floor room and some high level windows. There is the potential to negatively impact
on the amenity of this property in terms of privacy and a minor effect on access to light to the
high level windows. Furthermore, the dwelling being nearly 10 metres high and only 2
metres from the boundary is imposing and dominating when viewed from the western
neighbour’s property. This is compounded by this neighbour being further down slope of the
proposal. While the western neighbour’s aspect is to the west (for significant views) and not
towards the subject site, the proposal will still have an adverse impact on their property.
