PLANNING & ORGANISATION COMMITTEE MEETING AGENDA 22 JULY 2014

RECOMMENDATION
That Council note the report by the Planning & Environment, Manager to the Planning &
Organisation Committee Meeting dated 22 July 2014 regarding Planning & Environment
Court Appeal D94/2014 for the Attunga Heights development and agree to defend the
appeal.

REPORT
A report on this application to extend the relevant period for the development approvals for
Attunga Heights for 2 years was considered by Council at its Ordinary meeting of 1 May
2014. Council resolved to refuse the request for the following reasons:
1. The development is contrary to the Noosa Plan’s Overall and Specific Outcomes for
         the Noosa Heads Locality.
2. The application was publicly notified in 2004 and given the time lapsed, the community
is unlikely to be aware of the development approval.
3. The proposed development were it to be publicly notified today, is likely to receive
submissions objecting to the development, given the significant non-compliance with
         The Noosa Plan.
An appeal was lodged with the Planning and Environment Court on behalf of the applicant
on 2 June 2014. The appeal seeks to overturn Council’s decision.
It is in order for Council to defend the appeal and the recommendation is worded
accordingly.
Previous Council Consideration
A report on this application was considered by Council at its Ordinary meeting of 1 May
2014.
Finance & Risk
There will be significant costs for Council involved in defending the appeal and it is
premature to advise on the appeal prospects.
