PLANNING & ORGANISATION COMMITTEE MEETING AGENDA 22 JULY 2014
3. ASSESSMENT
3.1. Instruments for Statutory Assessment
Under the Sustainable Planning Act 2009 the application must be assessed against each of
the following statutory planning instruments to the extent they are relevant to the
development:
State Planning Policy;
The South East Queensland Regional Plan;
State Planning Regulatory Provisions; and
The Noosa Plan
Of these, the statutory planning instruments relevant to this application are discussed in the
sections that follow.
3.2. State and Other Statutory Instruments
State Planning Policy
The most applicable State Interest within the State Planning Policy’s Part E – Interim
Development Assessment Requirements relates to the proposal’s impacts on water quality.
Considering the scale of the development, the proposed agricultural use is not likely to have
an adverse impact on the surrounding water quality and is compliant with the Policy.
State Planning Regulatory Provisions
The site is located within the Regional Landscape and Rural Production area of the SEQ
Regional Plan. The proposal is for a rural activity consistent with the regional policies of the
SEQ Regional Plan.
The site is located outside the Koala Assessable Development Area and is not triggered for
assessment against the South East Queensland Koala Regulatory Provisions.
3.3. Statutory Instruments – Planning Scheme
The subject site is located in the Cooroy & Lake Macdonald Locality and is zoned Rural. The
proposed use is identified as a consistent use within the zone and is required to follow an
impact assessable application process.
Locality Provisions
The Overall Outcomes of the Locality Code seek to support agricultural industries and rural
enterprises, which are compatible with the rural zone and avoid significant adverse impacts
on the amenity enjoyed by users of other premises.
The topography of the site means that the proposed 1,000 birds are to be contained within 4
main areas of the 60ha farm. These areas are mostly located on top of the ridgelines, which
are more than 60m away from the intermittent creek lines on the property, and more than
100m away from any existing house on the neighbouring properties.
Although the proposal involves locating the chicken caravans along the ridgelines of the site,
the caravans are comparable in size to a small farm shed and will be setback more than
100m from any property boundary. The colour of the caravans may also be painted in muted
colours and hues of the surrounding landscape.
Land Use & Works Provisions
The most relevant code for assessment against The Noosa Plan is the Agricultural Uses
Code. The code seeks that new uses avoid adverse impacts on the Shire’s natural
resources of biodiversity, water, air and soil, while avoiding adverse visual and acoustic
amenity impacts to the neighbours.
