Tony Wellington
Other Councillors in attendance: Crs Joe Jurisevic and Frank Wilkie
8 REGISTER OF PREQUALIFIED SUPPLIERS FOR THE SUPPLY OF ECOLOGICAL
RESTORATION SERVICES 1718T077
Cr Jurisevic declared a perceived conflict of interest in this matter (as defined in section 175D of the
Local Government Act 2009) due to his being volunteer for the Heritage Park Bushland Care Group
in which the tenderer Bush Renewalls has provided services to and is also a volunteer member. Cr
Jurisevic elected to leave the meeting room for the debate and decision on this matter.
Cr Stockwell declared a perceived conflict of interest in this matter (as defined in section 175D of the
Local Government Act 2009) due to the fact that as a Sole Trader in his business Watershed Australia,
he has both been contracted by, and have subcontracted officers of, Noosa and District Landcare
prior to becoming a Councillor. He is also an ordinary member of the group with long standing
association as one of the founding members. Cr Stockwell believed that he could consider this item
impartially and in the public interest and requested to remain in the meeting room to participate in the
debate and vote on this matter.
Pursuant to section 175E(4) of the Local Government Act 2009, the remaining Councillors gave
consideration to whether the conflict was a real conflict or perceived conflict and whether Cr Stockwell
may participate in the meeting for the debate and vote on this matter or whether he must leave the
meeting for the debate and vote on this matter.
Council Resolution
Moved: Cr Wellington

Development Application for Material Change of Use of Premises – Entertainment and Dining

A. Refuse the application for the following reasons:
1. The proposed development is an inconsistent use in the Rural Zone and the
increase in traffic on Marara Street from the proposed development is not
contemplated by The Noosa Plan.
2. The proposed development is contrary to the Transport, Roads and Drainage
Code as the development will compromise the capacity and safety of Marara
Street.
3. The current condition of Marara Street is not capable of safely accommodating
any increase in traffic from the proposed development and a satisfactory solution
has not been identified to address the constrained sections of Marara Street
given the current road formation and environmental constraints.
4. A number of properly made submissions have been received raising valid
grounds of objection.
B. Advise the applicant that an indoor play centre does require a further development
approval to operate from the site and such a use would significantly impact on the
