PLANNING & ORGANISATION COMMITTEE MEETING AGENDA 20 MAY 2014

Further, some provisions of the Bill also require greater clarity, including:
e Greater guidance is required in the Bill as to which conditions of existing
development approvals will become conditions of a water approval. For example,
while water and sewer requirements in an existing development approval would
clearly be part of a water approval, other conditions such as hours of operation,
vegetation protection, haulage routes, sediment and erosion requirements should
equally apply to the water connection aspects.
¢ Clarify that certain conditions relating to water infrastructure may be imposed by
Councils on a development approval. For example, Councils in granting
development approvals should have the ability to require the development to be
connected to the distributer-retailers reticulated water and sewer and ensure
construction works do not adversely impact on areas worthy of conservation.
Recently, Brisbane City Council, Sunshine Coast Council, Moreton Bay, Ipswich City Council
and Noosa Council wrote to the Department of Energy and Water Supply voicing their
objections to the current wording of the transitional provisions and forwarded drafting
changes, along with the support of Unitywater. However, the department have advised it will
not be putting forward any amendments to the Bill, despite indicating previously it would
consider amendments before commencement of the utility model to the transitional
             provisions.
Given the support of the major participating councils and Unitywater, | urge you to seek that
the department give this matter further consideration and so avoid the need for successive
             amendments to the legislation.
Should you require further clarification or additional information, council officers are available
            to discuss with you.

            Yours faithfully
