Dear Council,

Bunnings Noosaville: 178 Eumundi Noosa Road, Noosaville
Extension application for a development approval (pursuant to section 86 of the Planning Act 2016)
Your Ref: REC14/0005.01
We act for Bunnings Properties Pty Ltd regarding an existing development approval issued by Noosa Council
(Council Ref: REC14/0005.01) over the land situated at 178 Eumundi Noosa Road, Noosaville (Lot 101 on
SP279285 [formerly Lot 101 SP241371]).
The development approval is for:
• Development Permit to Reconfigure a Lot (1 Lot into 2 Lots)
On behalf of Bunnings Properties Pty Ltd, we lodge this application for a two-year extension to the currency
period of the approval, seeking a new currency period end date of 25 March 2023.

Background
The development approval was originally issued by Council by way of Negotiated Decision Notice on 25
September 2014. A request to extend the relevant period was lodged and subsequently approved by Noosa
Council on the 3 October 2020 resulting in a new currency period end date of the 25 September 2020.
In July 2020 the State Government introduced a number of initiatives in response to COVID. This included an
automatic extension to timeframes for undertaking all approved development by an additional six
months. The automatic additional six months extension granted by the Minster relates to all development
approvals that are in effect on the date of the declared event (20 March 2020 - 31 October 2020).
As such the currency period for the approval for the ROL approval has been extended by 6 months, resulting
in a new end date of 25 March 2021.

Justification
The approved subdivision provides for a balance part of the site to be excised from the part of the site that
contains Bunning’s retail warehouse store. Bunnings have recently held a prelodgement meeting with Council
regarding site development potential options. Bunnings are considering their options and wish to preserve the
option of excising the balance land.

At the prelodgement meeting it was confirmed that no significant changes have occurred to the planning
scheme provisions affecting subdivision potential of the site. Accordingly, the approved subdivision remains
consistent with current town planning intents.
As such a further two year extension to the currency period will provide Bunnings with opportunity to determine
their intentions for the site, and to undertake the works necessary to enact the subdivision of the land should
these decide to do so.

The Development Approval was originally issued for the purpose of creating the following lots:

Lot Area Purpose

Lot 101 (Bunnings site) 22,590m2 Bunning Warehouse Site

Lot 103 (Northern lot) 4,073m2 Vacant Industrial Land

At the time the application was originally made in April 2014 the planning scheme in force was The Noosa Plan
2006 (superseded planning scheme), under which the subject site was wholly included within the Industry
Zone. The Noosa Plan 2006 was recently superseded by the current Noosa Plan 2020 (current planning
scheme), which was endorsed by Noosa Council on 16 July 2020 and came into effect on 31 July 2020.
Despite a new planning scheme coming into effect, the zoning for the site is has not significantly changed, with
the land still Included within an industrial zoning (medium impact industry) and the overall intent of this zone
being generally consistent with the planning intent for the site at the time of the original approval.
The key development parameters for the site under the Noosa Plan 2020 are largely reflective of the
requirements of the superseded Noosa Plan 2006. As such the approved subdivision plan is generally
compliant with the performance outcomes and acceptable outcomes of the Reconfiguring a Lot Code under
both planning schemes, including the minimum lot areas, minimum dimensions and lot layout.

The northern portion of the site (Proposed Lot 103) is not affected by Biodiversity, Waterways and Wetlands
Overlay under the Noosa Plan 2020 and site vegetation clearing would be addressed as part of any future
MCU application.
In addition to the above we note that a pre-lodgement meeting was recently had with Council to discuss the
Bunnings site (Council ref: PLM20/0019). As part of the pre-lodgement meeting Council confirmed that “the
minimum lot size and intent of the new scheme is similar to the superseded planning scheme and no significant
concerns are raised”.
