The lot is constrained by flooding, bushfire, riparian buffer and vegetation protection under the Biodiversity Code. Whilst the applicant has provided a potentially suitable dwelling house site outside the Probable Maximum Flood (PMF), they have failed to demonstrate that the lot has suitable access across the site’s waterway and a sufficient fire buffer is maintained to the building envelope in response to the required revegetation of the riparian buffer area. Despite requests for further information and meetings with the applicant, Council has not been supplied with sufficient detail to address concerns in regard to the impact of flooding on the access to the rear house site (depth, velocity and duration). Therefore, Council does not have an appropriate level of information that demonstrates that flooding would not comprise the safety of future residents who require safe access/egress during rain events.
