PLANNING AND ENVIRONMENT COMMITTEE MEETING AGENDA 11 MAY 2021
Performance Outcomes Acceptable outcomes
AO14.2
Acoustic live music (not reliant on electric or electronic
equipment) ceases to operate in outdoor spaces by
9:00pm Sunday – Thursday, and by 10:00pm Friday and
Saturday, except if located within the Hastings Street
Mixed Use Precinct or Noosa Junction Hospitality
precinct where it can operate until 10:00pm Sunday -
Thursday, and by 12:00 midnight Friday and Saturday.
AO14.3
Amplified live music ceases to operate in outdoor space
by 7:00pm seven days per week, except if located within
Hastings Street Mixed use precinct or Noosa Junction
Hospitality precinct where it can operate until 9:00pm
Sunday - Thursday and 10:00pm Friday and Saturday.
Condition 9 – Planter Boxes
9. Any solid structure for the required planter boxes/ pots must have an interesting finish such
as timber panelling or the like and not a rendered masonry finish to enhance the softening
effect of the landscaping.
Applicant’s Representation
The condition is considered unreasonable, irrelevant and overly prescriptive. The prohibition of
use of a rendered masonry finish fails to recognise that concrete rendering can have an interesting
texture, colour and finish. The condition is requested to be modified to “any solid structure for the
required planter boxes/pots must have an interesting finish to enhance the softening effect of the
landscaping.”
Assessment of Representation
The applicant’s representations are agreed.
3. CONCLUSION & REASONS FOR DECISION
It is concluded the requested changes to the operating hours and requirements for amplified music
may be supported in part to recognise the important role the Noosa Junction plays as a major
centre for the shire and as a place intended for restaurants, entertainment and live music at night.
However, this should also be balanced with the need to maintain nearby residents with a
reasonable level of amenity and for this reason it is appropriate to impose some restrictions on the
operating hours and playing of amplified music in outdoor dining areas where noise is difficult to
mitigate.
