EXECUTIVE SUMMARY

RECOMMENDATION
That Council note the report by the Infrastructure Assessment Coordinator to the Planning &
Environment Committee Meeting dated 6 October 2020 and adopt the “Noosa Shire Council
Charges Resolution (No.5.1) 2020” provided at Attachment 1 to the report, to replace the “Noosa
Shire Council Charges Resolution (No.5) 2020” and take effect on 16 October 2020.
REPORT
Council issues infrastructure charges on development under its “Charges Resolution” to help
fund provision of “trunk” infrastructure identified in its Local Government Infrastructure Plan
(LGIP).
Council’s current adopted “Charges Resolution (No.5)” recently took effect on 31 July 2020 to
cater for commencement of the new planning scheme. However this maintained a base date of 1
July 2019 for the 2019-2020 Financial Year to correlate directly with the “Planning Regulation
2017, Schedule 16 Prescribed amount” current at that time and reliance on Council Resolution
section “9.5 Automatic increase provision of levied charge” and the “Planning Act 2016 section
112(2)” for indexation of charges to the current 2020-2021 financial year.
On 28 August 2020 through the “Planning Legislation (Fees and Other Amounts) Amendment
Regulation 2020”, the State Government amended the “Planning Regulation 2017, Schedule 16
Prescribed amount” that now applies for the current 2020-2021 financial year. This replaces the
alternative indexation methodology under the “Planning Act 2016, section 112(2)” that would
otherwise apply with resulting differences being negligible due to rounding.
The Queensland Legislation web-page was updated on 2 September 2020 with the amended
“Planning Regulation 2017, Current as at 28 August 2020” with updated prescribed (maximum)
amounts equating to an average 3.02+% increase from the previous financial year. A full
comparison of all rate increases is provided for Council information in Attachment 2.
To maintain direct consistency with the most current legislative/regulatory amendment, it is
recommended that Council’s current “Charges Resolution (No.5) 2020” be amended and
replaced with an updated “Charges Resolution (No.5.1) 2020” provided as Attachment 1 to this
report to take effect on 16 October 2020.
