We seek to suspend the appeal period and make change representations to condition 2 as reproduced below.

2. Amended plans must be submitted to Council prior to any further development applications being made and must include the following to the reasonable satisfaction of the Manager, Development Assessment:

a. An easement for drainage purposes registered in favour of Council against the title of the subject site. The easement must:
i. be centrally located on the surveyed location of the drainage line that traverses through the site
ii. be a minimum of 1.5m or the “zone of influence” / depth=width criteria whichever is the greater
iii. include terms that refer to Council’s standard terms document No 715597508
b. The setbacks to the front, rear and side boundaries, as detailed on the plans numbered 00.0 – 09.0 prepared by Paul Clout Design and dated 15 June 2022, must not be decreased.:

Please find attached correspondence from the owners and Bryan O’Connor from 2017 (Asset Planning Manager).
The owners bought the site based on this information and the advice the site was not encumbered by any easements.

We seek for a review of this condition as it affects the entire design of the house and for the upgrading of the Preliminary Approval to a Development Permit.
