MCU22/0051 REPRESENTATIONS TO DEVELOPMENT APPROVAL FOR MATERIAL CHANGE OF USE - HARDWARE & TRADE SUPPLIES AT 178 EUMUNDI NOOSA ROAD, NOOSAVILLE · Report
PLANNING & ENVIRONMENT COMMITTEE MEETING 7 MAY 2024
Assessment Type Representations made to original approval
EXECUTIVE SUMMARY
This report considers representations made to a development approval issued by Council for a
Hardware and Trade supplies store to be constructed on the vacant area of the existing
Bunnings Warehouse site in Noosaville.
The applicant has suspended the appeal period and made representations to the development
approval conditions. The applicant’s representations relate to the required plan amendments
and conditions and include:
• Amended plans relating to the northern exit driveway design
• Amended plans reducing the building height to 10.94m consistent with adjoining
development to the north (note: plan amendments required a maximum height of 10
metres)
• Provision of an eave overhang
• Clarification of conditions relating to use of the site, external colours, street trees,
performance bond and acid sulfate soils requirements.
The proposed amended plans have reduced the building height from 12.14m to 10.94m and
made provision for a 0.5m landscape strip along the northern driveway and an awning to the
building façade. While the proposed building still exceeds the code’s acceptable outcome for
building height of 10m, the proposed height of 10.94m to the roof pitch is compatible with the
height of buildings in the area and will not visually impact on the streetscape.
No changes are recommended to conditions regarding the existing Bunnings Warehouse as
they are considered reasonable.
Some minor amendments are however recommended to the conditions regarding external
colours, performance bond, street trees and acid sulfate soils.
Accordingly, it is recommended that a Negotiated Decision be issued.
RECOMMENDATION
That Council note the report by the Coordinator Planning to the Planning & Environment
Committee Meeting dated 7 May 2024 regarding representations made in relation to
Development Approval MCU22/0051 for Hardware and Trade Supplies situated at 178 Eumundi
Noosa Rd Noosaville and:
A. Agree to amend conditions 3, 7, 13,15, 20 and 21 as outlined in Attachment 1;
B. Delete conditions 39 & 40;
C. Refuse the representations made to conditions 5 for the following reasons:
Condition 5
The condition is a reasonable requirement given the application was made over 178 Eumundi
Noosa Road which includes the existing Bunnings Warehouse. The retention of a significant
hardware component and trade sales area within the Bunnings Warehouse is an important
consideration in the assessment of the proposed trade supplies store and the original
Bunnings Warehouse.
D. Note the report is provided in accordance with Section 63(5) of the Planning Act 2016.
