GENERAL COMMITTEE MEETING AGENDA 12 DECEMBER 2022
CONCLUSION & REASONS FOR DECISION
It is concluded that the extension of the approval is warranted as the proposed changes are
consistent with the existing approval and do not introduce new impacts. While Council has
received complaints about the home-based business, the issues raised by complainants are not
substantiated. All complaints have been investigated by Council’s Development Compliance
Officer and Environmental Health Coordinator who have concluded that the business has been
operating in compliance with all development approval conditions and no environmental nuisance
was occurring under the Environmental Protection Act 1994.
The use is of a type and scale that can successfully operate as a home-based business, with the
potential impacts able to be satisfactorily mitigated for nearby residents, with noise from operations
not audible outside the sealed shed. While once a week the operator leaves the site to harvest
deer during the night and returns and unloads the wild game in the shed at the rear of the property,
this would not reasonably constitute a noise or light nuisance for residents, given it occurs only
once a week for approximately 15 minutes.
The requested changes to conditions 5, and 14, and changes to 7 and 18 remain within the
parameters of the acceptable outcomes of the Home-based business Code and are considered
minor changes pursuant to the Planning Act 2016.
The application for a minor change is therefore recommended for approval.
