EXECUTIVE SUMMARY
The applicant is seeking retrospective approval for an extension to Unit 6 to increase the site cover
and gross floor area of that previously approved. The changes result in an additional 15m2 of gross
floor area and additional site cover of 12m2 across the site.
The application has been recommended for refusal due to non-compliance with the Noosa Plan
requirements for building bulk with the existing building already exceeding the scale of surrounding
buildings.

Section 5
PLANNING & ENVIRONMENT COMMITTEE MEETING AGENDA 9 NOVEMBER 2021
1. The proposal does not comply with Overall Outcome 2 ( c), Performance outcomes
PO9, PO 10 & PO11 of the Medium Density Zone code in Noosa Plan 2020 and will
result in:
a. Increased bulk and scale for a development that already exceeds the scale of
other development in the area;
b. A decrease of private open space for Unit 6, and
c. A reduction in the extent of landscape area provided for the site.
2. The proposal is contrary to the Overall and Performance Outcomes of the Dual
Occupancy and Multiple Dwelling Code in Noosa Plan 2020 as:
a. The existing building is of a bulk and scale that is not consistent with the character
existing and sought for the area and the proposed changes will contribute
additional bulk and scale; and
b. The proposed changes will reduce the private open space of Unit 6 and the extent
of landscape area on site.
B. Note the report is provided in accordance with Section 63(5) of the Planning Act 2016.
REPORT
1. PROPOSAL
The applicant seeks approval to change an existing development approval for a Multiple Dwelling
Unit development for 6 dwelling units. It is proposed to amend Unit 6 by enclosing part of an existing
balcony, extending a bathroom and bedroom into an existing internal courtyard. The changes result
in an additional 15m2 of gross floor area and additional site cover across the site. The applicant is
seeking retrospective approval, as the works have been completed. Refer Figure 1 for the Locality
and Figures 2 & 3 for the proposal plans.

2. BACKGROUND
A development approval over Lot 1 RP104599 & Lot 2 MCH3930 (11876TC – 51997.2283) for a
Material Change of Use (Multiple Dwelling Units x 6- Building B) was approved in 1998. Unit 6 is
part of this approval.
A development approval over Lot 2 RP32784 (12530TC – 51997.2397) for a Material Change of
Use (Multiple Dwelling Units x 4- Building A) was approved in 1998.
The above development approvals approved in 1998, related to 3 separate lots at that time. These
lots were then amalgamated to form Lot 3 SP110328. The survey plan reflects the built form – 10
units and common property.
In 1998 a Building approval was issued for 10 units (combining the 2 planning approvals above).
It is noted that the gross floor area (GFA) specified on the building plans is slightly different from
that stipulated in the planning approvals. The GFA was 1029.4m2 (1031.5m2 max permitted) and
site cover 730.9m2 (34%) for Lot 1 RP104599 & Lot 2 MCH3930 (amalgamated since). For Lot 2
RP32784 the GFA was 899.2m2 (900m2 max permitted) and site cover 593.1 m2 (33%). This was
calculated from building plans over lot sizes 2149m2 & 1877m2 respectively. The maximum
permissible site cover under the planning scheme at that time was 40%.
An approval for Operational works was approved in 2008 for a pontoon.
On 28 October 2016 a Generally in Accordance request was issued for Unit 2 (12530TC – approval
for 4 units) that supported some internal reconfiguring of the unit and additional floor space
(approximately 15m2), which included a part enclosure of the balcony, and extension to the

PLANNING & ENVIRONMENT COMMITTEE MEETING AGENDA 9 NOVEMBER 2021
bathroom into the courtyard area. This proposal brought the gross floor area total for the entire
site to 1872m2, which was over and above what was allowed for the site.
On 8 October 2020, an application for a minor change was refused for changes to Unit 6 to include
additional gross floor area of 15m2, which are the changes outlined in this report. The applicant
incorrectly appealed the decision to the Development Tribunal, which the Tribunal eventually
confirmed. This application is under the Planning and Environment Court jurisdiction, not the
Building Tribunal. The applicant decided to not proceed with an appeal with the Planning and
Environment court, instead choosing to lodge another application for consideration by Council.
3. ASSESSMENT
3.1. Instruments for Statutory Assessment
Under the Planning Act 2016 the application must be assessed against each of the following
statutory planning instruments to the extent they are relevant to the development:
State Planning Policy;
South East Queensland Regional Plan;
Planning Regulation 2017;
The Noosa Plan.
The following codes from the Noosa Plan are applicable to this development:
Noosaville Local Plan Code;
Medium Density Residential Code;
Medium Density Zone Code.
3.2. Statutory Process
The applicant has requested to make a minor change to a development approval under s78 of the
Planning Act 2016. An application for a minor change to a development approval can only be made
in circumstances where a change would constitute a ‘minor change’.
The proposed change to the development approval requested by the applicant is determined to
constitute a minor change on the grounds that:
the development would not result in substantially different development as the proposal is
minor in nature due to a small increase of GFA and site cover relating to an approved use;
the change does not include prohibited development;
the change would not require the application to be referred to an additional referral agency
or cause a referral agency to have regard to new mattes prescribed by regulation;
where the original application was code assessable, the change would not cause the
application to become impact assessable.
3.3. Statutory Instruments – Planning Scheme
Under the Noosa Plan 2020, the site is zoned medium density residential and is intended to be
developed for dual occupancy and multiple dwellings in a range of dwelling sizes and styles. The
proposed changes relate to approval number 11876 TC as it affects Unit 6. The proposal seeks to
change Condition 27 to reflect the new plans for Unit 6.
Condition 27
Submission to and approval by Council of building plans in accordance with the Building Act,
Council’s By-laws and Policies, the conditions of this approval and substantially in accordance with
plans 9714 SK10-12 drawn by Frank Macchia Architect and dated March 1998 and the Shire of
Noosa Planning Scheme apart from where amendments are required or dispensations have been
granted in conjunction with this approval.

Applicant’s Request
The applicant has submitted plans that results in extensions to Unit 6 as described in the proposal
section of this report which contribute to additional site cover and gross floor area.
Assessment of Request
Table 1 below compares what has been previously approved, the proposal and what was permitted
under the scheme at the time of the approval and the Noosa Plan 2020 gross floor area and site
cover requirements.

Table 2 considers both approvals across the entire site (4035m2) and establishes that although the
proposal does comply with the gross floor area provisions for the 1990 Planning scheme, it does
not comply with Noosa Plan 2020.

6.3.2.2 (c) Development makes a positive contribution to the look and feel of residential
neighbourhoods by maintaining a low scale character with well designed buildings and landscaping
that enhance the streetscape.
PO9 Development:
(a) is of scale compatible with surrounding development and the particular circumstances of the
site; and
(b) does not present an appearance of bulk to adjacent properties, roads or other areas in the
vicinity of the site.
PO10 Site cover of development:
(a) does not exceed 40% of the site area; or
(b) for small dwellings or for development which provides a ratio of at least 3 small dwellings to
one other dwelling, does not exceed 45% of the site area.
PO11 Plot ratio of development:
(a) does not exceed 0.4:1; or
(b) for small dwellings or for development which provides a ratio of at least 3 small dwellings to
one other dwelling, does not exceed 0.5:1.
The proposal includes enclosure of an existing courtyard and landscape area which reduces
outdoor open space area for Unit 6 and in turn increases the buildings footprint, increasing the bulk
and scale of the development. It is noted that the existing building is significantly larger when
compared with other buildings in the Medium Density residential zone in the general vicinity of the
site. Refer to Figure 4 – Buildings in the Medium Density residential zone with respect to the site.
Page 8 of 69
Section 9
PLANNING & ENVIRONMENT COMMITTEE MEETING AGENDA 9 NOVEMBER 2021
Figure 4 – Buildings in the Medium Density residential zone with respect to the site
The intent of the Medium Density residential zone is to maintain the small scale character of
buildings, and increasing the footprint of existing buildings where no allowable gross floor area and
site cover is available for the site, is not supported.
4. CONSULTATION
Not applicable.
5. CONCLUSION & REASONS FOR DECISION
The proposed change to the development results in additional GFA and site cover which increases
the bulk and scale of the development greater than what Noosa Plan 2020 envisages and is
therefore not supported.

EXECUTIVE SUMMARY
On 18 June 2020 Council at its Ordinary Meeting resolved to partially support proposed changes
to the development at Noosa Springs but refused to permit the outdoor dining area to operate until
midnight 7 days, maintaining the requirement for the outdoor dining area to cease trading at 10pm.
The applicant’s acoustic report did not provide sufficient evidence that noise impacts from the
outdoor dining could be appropriately mitigated after 10pm, with Council’s external acoustic
consultant concluding that noise impacts were likely to occur for residents. As a result of Council’s
decision to refuse the application, the applicant lodged an appeal to the Planning & Environment
Court seeking that the outdoor dining area be allowed to operate till midnight, 7 days a week. The
appeal was subsequently withdrawn.
This minor change application seeks to enclose the existing outdoor dining area, with the provision
of folding doors enabling the area to be either open or fully enclosed. An updated Noise
Management Plan has been provided which demonstrates that it is suitable for the area to be used
past the previous time limit of 10pm, up until midnight on the basis that the new doors are closed
at 10pm. Internal changes to the Facilities building are also proposed.

7. BACKGROUND
The site is located within Precinct F of the Noosa Springs development at Noosa Springs Drive,
Noosa Heads. Noosa Springs is a master planned residential golf resort, with most development
on the site completed. The subject resort site and an adjoining multiple dwelling site (Precinct E2)
have remained undeveloped and were recently purchased by the applicant.
On the 30 August 2007 Council approved the application for a Material Change of Use -
Resort of 155 Multiple Dwelling Units & Associated Facilities (Theatre, Restaurant, Shops &
Function Rooms), which was assessed under the Superseded Planning Scheme.
Representations were then made, and on the 5 November 2007, Council agreed to amend
or delete 18 of the 102 total conditions pertaining to the development (132005.1133).
On 6 April 2011 an extension to the currency period of the approval for 4 years to 1 November
2015 was agreed (132005.1133.2).
On 10 September 2015 an extension to the currency period of the approval for 2 years to 1
November 2017 was agreed (132005.1133.3).
On 10 March 2016 a modification to the approval was granted which altered the general
redesign of building layouts to increase efficiency and consolidate non-residential
components and remove the theatre and function room components of the approval
(132005.1133.4).
On 15 December 2016 a modification of the approval was granted which changed the
description of the approval from Material Change of Use - 155 Multiple Dwelling Units and
Associated Facilities - Theatre, Restaurant, Shops & Function Rooms to Material Change of
Use for a Resort of 151 Multiple Dwelling Units and Associated Facilities – Shop, Restaurant,
Multi-Function Room and Gym. This change also included a redesign of the building layouts
and a change to a number of conditions (132005.1133.5).
On 21 September 2017 Council agreed to further modification of the approval which changed
the description of the approval from Material Change of Use - 151 Multiple Dwelling Units
and Associated Facilities – Shop, Restaurant, Multi-Function Room and Gym to Material
Page 28 of 69

PLANNING & ENVIRONMENT COMMITTEE MEETING AGENDA 9 NOVEMBER 2021
Change of Use for 145 Multiple Dwelling Units and Associated Facilities – Shop, Restaurant,
Multi-Function Room and Gym. This change also included a redesign of the building layouts
and a change to a number of conditions (132005.1133.6).
On 18 January 2018 Council agreed to further modification of the approval which changed
the description of the approval from Material Change of Use for 145 Multiple Dwelling Units
and Associated Facilities – Shop, Restaurant, Multi-Function Room and Gym to Material
Change of Use for 137 Multiple Dwelling Units and Associated Facilities – Shop, Restaurant,
Multi-Function Room and Gym. This change also included a redesign of the building heights
and layouts and a change to a number of conditions (132005.1133.7).
On 28 November 2018 Council agreed to further modification of the approval which changed
the description of the approval from Material Change of Use for 137 Multiple Dwelling Units
and Associated Facilities – Shop, Restaurant, Multi-Function Room and Gym to Material
Change of Use for 140 Multiple Dwelling Units and Associated Facilities – Shop, Restaurant,
Multi-Function Room and Gym. This change also included a redesign of the building layouts
and a change to a number of conditions, a request to delete condition 96 (regarding
landscaping and structures to the rear of Blocks 7, 8 and 9) was refused (132005.1133.8).
On 14 May 2019 Council agreed to further modification of the approval including a number
of building layout redesigns and a change to a number of conditions, with amendments to
conditions 2, 33, 48 & 64, delete condition 72 and with amendment to advisory notes 1, 2 &
11 (132005.1133.9).
On 21 August 2019 Council issued a Generally in Accordance letter in relation to minor
changes to approved plans (132005.1133.11).
On 18 October 2019 Council agreed to further modification of the approval including changes
to the internal layout of the Facilities Building, addition to the outdoor dining area, change to
GFA and refinement to the elevations to be consistent with the layout changes, and a change
to a number of conditions, with amendments to conditions 2, 12 & 64, additional changes to
conditions 5 & 83, and amendments to advisory notes 1, 2 & 11 (132005.1133.10).
On 21 November 2019 Council issued a Generally in Accordance letter in relation to minor
changes to approved plans (132005.1133.12).
On 27 April 2020 Council issued a Generally in Accordance letter in relation to minor changes
to approved plans (132005.1133.14).
On 18 June 2020 Council at its Ordinary Meeting resolved to partially support proposed
changes to the development approval (132005.1133.13) but refused to permit the outdoor
dining area to operate until midnight 7 days, maintaining the requirement for the outdoor
dining area to cease trading at 10pm. The applicant’s acoustic report did not provide sufficient
evidence that noise impacts from the outdoor dining could be appropriately mitigated after
10pm, with Council’s external acoustic consultant concluding that noise impacts were likely
to occur for residents. As a result of Council’s decision to refuse the application, the applicant
lodged an appeal to the Planning & Environment Court seeking that the outdoor dining area
be allowed to operate till midnight, 7 days a week. The appeal was subsequently withdrawn.
8. ASSESSMENT
8.1. Instruments for Statutory Assessment
Under the Planning Act 2016 the application must be assessed against each of the following
statutory planning instruments to the extent they are relevant to the development:
State Planning Policy;
South East Queensland Regional Plan;
Planning Regulation 2017;
The Noosa Plan 2020.
Page 29 of 69
Section 30
PLANNING & ENVIRONMENT COMMITTEE MEETING AGENDA 9 NOVEMBER 2021
The following codes from the Noosa Plan are applicable to this development:
Noosa Heads Local Plan Code;
Tourist Accommodation Zone Code
Business Activities Code;
Works Codes.
8.2. Statutory Process
The applicant has requested to make a minor change to a development approval under s78 of the
Planning Act 2016. An application for a minor change to a development approval can only be made
in circumstances where a change would constitute a ‘minor change’.
The proposed change to the development approval requested by the applicant is determined to
constitute a minor change on the grounds that:
the development would not result in substantially different development as the built form of
the development and land uses remain consistent with the existing approval;
the change does not include prohibited development;
the change would not require the application to be referred to an additional referral agency
or cause a referral agency to have regard to new matters prescribed by regulation;
where the original application was code assessable, the change would not cause the
application to become impact assessable.
8.3. Statutory Instruments – Planning Scheme
The subject site is located within the Tourist Accommodation Zone under the current Noosa Plan.
The Noosa Plan identifies a Multiple dwelling as an impact consistent use in the Tourist
Accommodation zone. The uses located within the Resort Facilities Building are also identified as
impact consistent under The Noosa Plan.
Condition 2
Applicant’s Request
We request that condition 2 is updated to reflect the amended Architectural package for the
Facilities Building which includes minor changes to the enclose the existing Facilities Building. The
changes include the enclosure of the existing roofed Outdoor Dining Area with sealed airlock
openings, making the existing dining area a dual operable space as both indoor/outdoor dining
area for the restaurant component in accordance with the updated Noise Management Plan. The
changes include minor adjustments to the internal fit-out of the use areas. The changes include:
Enclosure of the outdoor dining area (187m2), to enable its use as a dual operable dining
space for both indoor and outdoor dining in accordance with the Noise Management Plan.
Relocation of the existing Convenience Store (Shop) to the previous Pizza Oven location and
reduction of the use area by 5m2.
Relocation of the Pizza Oven to the current Convenience Store Area and the current
Convenience Store GFA has been reallocated to the Café/Restaurant use (21m2)
Multi-Function Room will be used for cooking classes (no change in GFA - 71m2)
The changes result in a very minor addition of GFA (18m2). There is no change to the existing
impervious area.
Assessment of Request
The proposed built form associated with the works raises no concerns as its form is consistent with
the originally approved plans. The minor increase to GFA is supported as the total amount of GFA
still remains less than what was originally approved. Notably the extent of use area has not
changed and accordingly there is no increased requirement for car parking.
Accordingly, it is recommended that Condition 2 be amended to reflect the updated plans set.

equivalent to 75 dB(A) + 5 = 80 dB(A) LAeq, adj, T at 3 metres from the speakers.
ix. Any live performer must be required to play through the in-house system. No
speakers (in addition to the in-house system) are permitted on site.
b. Within 20 business days of the commencement of trading of the restaurant/café use,
Council must be provided with a Noise Management Plan which is specific to the use
and prepared on the basis of physical and technical assessment of noise from the

operation of the restaurant. Primarily, this relates to using the previously identified outdoor area
until midnight as it can now be enclosed. The applicant states:
The updated Noise Assessment Report and Noise Management Plan demonstrates that the minor
changes to enclose the dining area comply with the necessary regulatory standards. The enclosure
caters for sealed airlock openings.
Specifically, the applicant has requested:
We request minor amendments to condition 83 including:

Reference to the updated Noise Management Plan; and
Point (vii) updated, given that the space is operable as an outdoor and indoor dining area in
accordance with the Noise Management Plan.
Point (viii) updated to allow for increased amplified noise through the sound limiting device
The applicant has requested the condition to be amended to read as follows:
83. The development shall comply with the Noise Management Plan (Report No:
R19084/D3295/Rev.4/30.03.20) R21055/D3295/Rev.0/25.08.21) prepared by David Moore &
Associates and dated 30 March 2020 25 August 2021 to the reasonable satisfaction of
Council, including:
a. The necessary and appropriate noise control measures incorporated into the façade
of the apartments and within the restaurant/café in the Resort Facilities Building.
These measures shall include:
i. Upgraded glazing and air-conditioning to the potentially affected apartments;
ii. Strategically placed wing walls on balconies to screen the apartment and
balconies from outdoor dining areas;
iii. Revised hours of operation to no later than midnight for the restaurant/café
(indoor area only);
iv. The outdoor dining areas associated with the restaurant/café use is to operate
between the hours of 6am and 10pm only;
v. After 10pm, all patrons must be within the building confines with doors/windows
closed, except for the ingress and egress of patrons and staff;
vi. The underside of all roof elements over outdoor dining areas associated with the

vii. Outdoor dining is confined to the 185m2 187m2 roofed area (i.e. when all
windows/doors are open) as shown on the approved plans.
viii. All amplified noise at the premises must be conducted through a sound limiting
device at all times to ensure that noise does not exceed the following: during the
daytime and evening (0600 to 2200) must not exceed 92 dB(A) LWA, which is
equivalent to 75 dB(A) + 5 = 80 dB(A) 90dB(A) LAeq, adj, T at 3 metres from the
speakers.
ix. Any live performer must be required to play through the in-house system. No
speakers (in addition to the in-house system) are permitted on site.
b. Within 20 business days of the commencement of trading of the restaurant/café use,

Assessment of Request
The provided Noise Management Plan has been reviewed by a consulting acoustic expert for
Council who has advised:
1. The noise impact assessment report has provided updated ambient noise monitoring data
and revised the noise limits for the use.
2. The noise impact assessment report has provided assessment of resultant noise levels with
the proposed new windows and doors closed, specifically for the post 10pm to 12MN time
period.
3. The noise impact assessment report identifies that noise criteria will be achieved with the
proposed windows and doors, enclosing the outdoor dining area to form a single indoor area.
4. I have reviewed the noise report and the updated noise management plan and consider that
they appropriately assess potential noise impacts and provide appropriate measures for
management of the venue to comply with the relevant noise criteria.
A couple of specific matters relevant to noise that come from the noise reporting and noise
management plan are;
1. The new glazing/doors and building envelope is to achieve a minimum noise reduction of 25
dB(A) with windows and doors closed and
2. As part of enclosure of the area, new (additional) air-conditioning units are proposed on the
roof above the pizza oven area.
The application letter prepared by JFP dated 25 August 2021 provides suggested changes to
Condition 83 to reflect that changed application and specifically the amended noise management
plan dated 25 August 2021.
On the basis of the proposed changes to Condition 83, and the drawings provided as part of the
application representing the amended built form and new enclosure details I consider that the use
has been demonstrated to comply with the noise limits between 10pm and 12MN as a fully
enclosed use area.
It is my recommendation that the minor change application be approved with the Applicants’
suggested changes to the conditions relevant to noise being appropriate.
I suggest however, that it would be appropriate that following construction works that Council
require Certification from an appropriately qualified acoustic consultant that the as-constructed built
form achieves the minimum 25 dB(A) noise reduction identified in the noise management plan and
that all plant and equipment including the new air-conditioning plant achieves compliance with the
development approval noise limits.
The proposal, providing the ability to enclose outdoor dining areas provides a greatly improved
acoustic outcome in respect to protection of surrounding resident’s amenity.
As noted by the consulting acoustic engineer the proposal includes an updated Noise Management
Plan which demonstrates that the works provide for an improved outcome with regards to the
protection of surrounding residential amenity. Accordingly, the proposed changes to the operation
of the restaurant are supported however the proposed wording of the condition can be improved
to reflect the new plans and improve the legibility of the condition.
It is recommended to add an additional condition, as per the consulting acoustic engineer’s advice,
requiring certification from an appropriately qualified acoustic consultant that the as-constructed
built form achieves the minimum 25 dB(A) noise reduction identified in the noise management plan
and that all plant and equipment including the new air-conditioning plant achieves compliance with
the development approval noise limits.
It is also recommended to include an additional condition to ensure that the area identified as being
used for ‘Cooking Classes’ is not used as part of the restaurant use.

should be the only additional charge.
It has also been requested to update Advisory Notes 1, 2 and 11 with the date of the current change
application and updated Infrastructure Charges Amount.
Assessment of Request
As the development has been completed and the associated Infrastructure Charges paid it is not
possible to update Condition 64 and Advisory Notes 1, 2 and 11. Whilst additional infrastructure
Charges will be applicable attributable to the additional GFA the details of the new charge are to
be included as an additional Advisory Note.
9. CONSULTATION
9.1. Referral Agencies
The application was not required to be referred to any referral agencies.
9.2. Other Referrals
The application was forwarded to an external acoustic engineer whose comments form part of this
report.
10. CONCLUSION & REASONS FOR DECISION
This minor change application seeks to enclose the existing outdoor dining area, with the provision
of folding doors enabling the area to be either open or fully enclosed. An updated Noise
Management Plan has been provided which demonstrates that it is suitable for the area to be used
past the previous time limit of 10pm, up until midnight on the basis that the new doors are closed
at 10pm. Internal changes to the Facilities building are also supported.
Accordingly, it is recommended to amend conditions 2 and 83 to reflect the updated plans and
noise management requirements and add a new condition 98 to ensure that the works undertaken
comply with the updated Noise Management Plan. It is also recommended to add a new condition
which requires that area identified on the plans for cooking classes does not form part of the
restaurant use.

EXECUTIVE SUMMARY
This report reviews and recommends settlement of a current appeal with the Planning &
Environment Court against Council’s decision to refuse an application to extend a Hire and Storage
Building associated with a commercial jetty at 256 Gympie Terrace, Noosaville.
During the course of the appeal, the applicant provided:
amended plans of the shed extensions improving the building’s presentation to the foreshore;
demonstrated that the size and number of craft and operational activities could be reasonably
contained within the lease area;
agreed on a set of operational management conditions; and
demonstrated that the extensions would not result in any significant increase to commercial
operations on the river than previously approved in 2015.
It is therefore recommended that the appeal be settled, with a number of conditions to ensure the
business remains at an appropriate scale, and the use operates within the lease area.
RECOMMENDATION
That Council note the report by the Manager Development Assessment to the Planning &
Environment Committee Meeting dated 9 November 2021 regarding Planning & Environment
Court Appeal No. D12 of 2021 and agree to settle the appeal generally in accordance with the
following conditions:

(1994) and the Environmental Protection (Water) Policy 2009.
18. After completion, the proposed works must be maintained in a sound state of repair in
accordance with the approved plans.
REPORT
On 17 December 2020 Council at its Ordinary meeting resolved to refuse an application to enclose
a front deck area and rear portion of an existing shed for U-Drive boat hire for the following reasons:
1. The proposal is contrary to Overall Outcome (ad) and Performance Outcomes PO22 and
PO23 of the Noosaville Local Plan Code as the proposal will result in increased commercial
development on and adjacent the Noosa River and lead to the business operating outside
their lease area.
2. The proposal is contrary to Overall Outcome (b) and Performance Outcome PO2 of the
Waterways Works Code as the proposal will result in an increase in gross floor area and an
increase to the scale and intensity of commercial operations on the Noosa River.
3. The business already exceeds the operational capacity of the lease area, as evidenced by
the site’s compliance history, and increasing the enclosed storage space supports the
continued operation of the business at a scale and intensity that is not consistent and/or
compatible with the designated lease area.
Council also resolved at the meeting to request staff to meet with the applicant to discuss temporary
alternative solutions to storage and staff safety issues due to the COVID-19 restriction
requirements.
Officers met with Mr Phillips from U-Drive boat hire on 23 December 2020 to discuss potential
solutions. At the meeting officers explored a number of options with Mr Phillips to address the
requirements of the business but no agreement was reached, with Mr Phillips indicating he would
not proceed with anything until after the busy Christmas period. At the meeting the following was
noted by officers:
There appeared opportunities to reorganise the shed and undertake some minor
modifications such as enlarging the servery window;
the lease requirements were not being met, with many craft located outside the lease areas
on community land;
As a result of Council’s decision to refuse the application, the applicant lodged an appeal to the
Planning & Environment Court seeking that the extensions to the Hire and Storage Building be
approved subject to reasonable and relevant conditions.

PLANNING & ENVIRONMENT COMMITTEE MEETING AGENDA 9 NOVEMBER 2021
Figure 3 – East Elevation as lodged with the application
Figure 4 – Revised Plan of Shed provided during court mediation
During the course of the appeal, mediation was attended with the Court registrar wherein the
applicant offered a revised plan for the shed, to improve the building’s presentation to the foreshore
area. Council’s reasons for refusal were also discussed with the applicant wherein officers
suggested an operational plan be produced to demonstrate how the business could reasonably
operate within the lease area and not be in continual breach of Council’s local laws. Following the
mediation the applicant produced a basic operational plan. Plans of the lease area were also
provided to demonstrate that the size and number of craft that could be accommodated in the lease
area and ensure briefing of patrons of craft usage also occurred in the lease area.
Through this process the applicant was able to demonstrate that the extensions to the hire and
storage shed would not result in any significant increase to commercial operations on the Noosa
River. Further that the number of craft associated with the business would remain generally
consistent with the operations at the time of the last expansion to the jetty in 2015, albeit with a
minor reduction to craft numbers and improved operational practices.
It is therefore recommended that the appeal be settled, with a number of conditions directed at
ensuring the business remains at an appropriate scale, and the use operates within the lease area.

That Council note the report by the Manager Development Assessment to the Planning &

Finance & Risks
Should Council not wish to settle the appeal, there will be further costs in defending the appeal and
while advice on prospects has not been received from Council’s barrister, based on the
amendments made to the plans and additional information provided by the applicant, a favourable
outcome by trial is unlikely.

EXECUTIVE SUMMARY
This report provides a list of development applications decided by officers during September 2021.
In total there were 61 development applications decided this month, and these included a range of
small scale developments but also the last of the applications lodged under the Superseded
Planning Scheme for short term accommodation.
Notably this month there were 5 applications made for exemption certificates under the Planning
Act 2016. The giving of an exemption certificate negates the need to obtain an approval for
development made assessable by the planning scheme. They are only issued in exceptional
circumstances and generally deal with an inappropriate requirement to lodge a development
application or if the effect of the development is considered inconsequential.
RECOMMENDATION
That Council note the report by the Development Assessment Manger to the Planning &
Environment Committee Meeting dated 9 November 2021 regarding planning applications that
have been decided by delegated authority.
REPORT
The Local Government Act 2009 allows, by resolution, a local government to delegate its powers
to the Mayor, CEO, a standing committee or a joint standing committee and the CEO to delegate
those powers to another employee of Council.
Under the current delegations for the Planning Act 2016 the ability to manage, assess and decide
a range of development applications are delegated to officers with the exception of the following
which are reported to Council for a decision:
a) an application for a variation request mentioned in section 61 of the Planning Act 2016 to
vary the effect of the planning scheme;
b) the approval of an application where there is substantial non-compliance with a stated policy
of the Council or a high order provision of the Planning Scheme being a desired
environmental outcome, or an overall outcome of a code;
c) the refusal of any application where Council is the assessment manager;
d) requests for change representations, and change applications to change or delete conditions
that were imposed by Council at an Ordinary Meeting or a Special Meeting;
e) and an application for a proposed development of significant community interest.
It should be noted though that due to the strict time frames of the Planning Act 2016, officers under
the current delegations have the ability to decide an application where the application has the
potential for 'deemed approval'.
In accordance with the current delegations, a wide range of development applications are decided

by Council officers each month, with a limited number of applications reported to Council for a
decision.
Attachment 1 lists applications that are decided by delegated authority during the month of
September 2021 (excluding applications seeking to remove a tree(s) adjacent to a building or
structure):
